Ohio State Law - 1345.03 Unconscionable consumer sales practices.

(A) No supplier shall commit an unconscionable act or practice in connection with a consumer transaction. Such an unconscionable act or practice by a supplier violates this section whether it occurs before, during, or after the transaction.

(B) In determining whether an act or practice is unconscionable, the following circumstances shall be taken into consideration:

(1) Whether the supplier has knowingly taken advantage of the inability of the consumer reasonably to protect his interests because of his physical or mental infirmities, ignorance, illiteracy, or inability to understand the language of an agreement;

(2) Whether the supplier knew at the time the consumer transaction was entered into that the price was substantially in excess of the price at which similar property or services were readily obtained in similar consumer transactions by like consumers;

(3) Whether the supplier knew at the time the consumer transaction was entered into of the inability of the consumer to receive a substantial benefit from the subject of the consumer transaction;

(4) Whether the supplier knew at the time the consumer transaction was entered into that there was no reasonable probability of payment of the obligation in full by the consumer;

(5) Whether the supplier required the consumer to enter into a consumer transaction on terms the supplier knew were substantially one-sided in favor of the supplier;

(6) Whether the supplier knowingly made a misleading statement of opinion on which the consumer was likely to rely to his detriment;

(7) Whether the supplier has, without justification, refused to make a refund in cash or by check for a returned item that was purchased with cash or by check, unless the supplier had conspicuously posted in the establishment at the time of the sale a sign stating the supplier's refund policy.

You may obtain an application form by downloading it here BMV Form 4826.

You may also obtain an application form at any local license agency
or by calling 614-752-7800 and one will be mailed to you.

It is against Ohio Law for anyone to park in a Designated Handicapped Parking Area
without displaying proper Handicapped License Plates or Placards!  If you see this
happening at any public, private or governmental place of business, find the agency or
business manager and politely ask for the offending vehicle to be moved so you can park.

REMEMBER: They are required by Ohio State Law to remove any offending vehicles!  AND ....
Designated Handicapped Parking Areas are just that - Designated Handicapped Parking Areas!

Whistleblower Laws & Whistleblower Employee Protections

"In 1986, Congress added anti-retaliation protections to the
False Claims Act. These provisions, which did not exist previously,
are contained in 31 U.S.C. Sec. 3730(h):

Any employee who is discharged, demoted, suspended, threatened,
harassed, or in any other manner discriminated against in the
terms and conditions of employment by his or her employer because
of lawful acts done by the employee on behalf of his employer or
others in furtherance of an action under this section, including
investigation for, initiation of, testimony for, or assistance in
an action filed or to be filed under this section, shall be
entitled to all relief necessary to make the employee whole.

The protection against retaliation extends to whistleblowers
whose allegations could legitimately support a False Claims Act
case even if the case is never filed. The statute of limitations for
Sec. 3730(h) claims is 6 years in most jurisdictions, but is
currently shorter in California and a few other locations."

or call the National Fraud Hotline, please be ready to provide
as much information as possible, including:

The name of the Medicaid client.
The client's Medicaid card number.
The name of the doctor, hospital, or other health care provider.
The date of service.
The amount of money that Medicaid approved and/or paid.
A description of the acts that you suspect involve fraud or abuse.
