It is surprising to note how much FIA is worried about Indian Motor sports that they had to release a Press Release, which is totally uncalled for and giving FALSE and BIASED version ONLY TO PREJUDICE THE MINDS OF THE WORLD MOTOR SPORTS COUNCIL MEMBERS AND THE GENERAL ASSEMBLY.
The following would prove this :
1) The FIA had admitted that they have received letters from the Government of India dated 15th May and 10th July. But did not want to say to its General Assembly Members of its contents why ? The letter from the Government of India dated 10th July states :
"This is to clarify that the so called license submitted by the MAI to the FIA is a license of incorporation issued by the Ministry of Finance, Government of India. This issuance of a license of incorporation is in accordance with the provisions of the Companies Act 1951 for which the Ministry is the competent authority.....
In so far as the matter of sports is concerned the MINISTRY OF YOUTH AFFAIRS AND SPORTS IS THE COMPETENT MINISTRY UNDER THE GOVERNMENT OF INDIA (ALLOCATION OF BUSINES) RULES TO GRANT RECOGNITION TO THE NATIONAL SPORTS FEDERATIONS WHO ARE RESPONSIBLE FOR THE PROMOTION OF DIFFERENT SPORTS AND ALSO TO CONDUCT NATIONAL / INTERNATIONAL COMPETITIONS IN ACCORDANCE WITH THE LAID DOWN GUIDELINES....
THIS IS TO BRING TO YOUR NOTICE THAT SINCE MAI IS NOT A RECOGNIZED BODY BY THE MINISTRY OF YOUTH AFFAIRS AND SPORTS IT IS ALSO NOT AUTHORIZED TO ISSUE AND GUARANTEE FIA CUSTOMS DOCUMENTS AS ONLY RECOGNISED SPORTS BODIES ARE ENTITLED TO ISSUE AND GUARANTEE CUSTOM DOCUMENTS. AT PRESENT, THE FEDERATION OF MOTOR SPORTS CLUBS OF INDIA IS THE ONLY BODY RECOGNIZED BY THE GOVERNMENT OF INDIA FOR PROMOTING MOTOR SPORTS IN INDIA.
This is for your information and further necessary action in the matter as it is apparent THAT RECOGNITION GIVEN BY FIA TO MAI IS BASED UPON MISREPRESENTATION AND IS IN CONFLICT WITH THE SOVERIGN FUNCTIONS OF THE GOVERNMENT OF INDIA."
From the above it is clear that
1) The Government
of India does not recognize MAI and
2) MAI cannot authorize
or guarantee FIA customs documents
BOTH THESE ARE PRE-REQUISITES OF THE FIA MEMBERSHIP, WHICH THE MAI HAS GROSSLY VIOLATED.
Don't you think, that this should have been put on the AGENDA of the General Assembly to be discussed as the Government of India has clearly stated that "Mr.Hoosein has misrepresented facts", WHICH IS A SERIOUS MATTER PARTICULARLY CONSIDERING THE FACT THAT MR.HOOSEIN IS THE VICE-PRESIDENT OF THE FIA WHO HAS MIS-REPRESENTED AND THE VICE-PRESIDENT'S CHARACTER IS IN QUESTION.
2.Last sentence of Para 3 of the press release states
"IN OTHER WORDS, SHOULD THE PERFORMANCE OF THE MAI BE FOUND TO BE WANTING AFTER A REASONABLE PERIOD OF TIME, THE FIA WILL DECIDED WHAT TO DO WITH THE SPORTING POWER. IT CANNOT, UNDER ANY CIRCUMSTANCES, BE PRESUMED THAT THE SPORTING POWER WILL REVERT TO THE FMSCI."
The question is firstly how the MAI got the Sporting Power when they have not FULFILLED THE CRITERIA OF MEMBERSHIP AS PER THE FIA'S REQUIREMENTS ???
HOW DID THE FIA'S OFFICE DECIDE THAT THE SPORTING POWER WILL NOT REVERT TO THE FMSCI. WHO GAVE THEM THE AUTHORITY TO DECIDE ??AGAIN, IT MUST BE NOTED THAT IT IS THE GENERAL ASSEMBLY WHICH HAS TO TAKE A DECISION, AND IT IS VERY CLEAR THAT THE FIA CANNOT TALK LIKE THIS WHEN THE MATTER HAS NOT BEEN DISCUSSED BY THE GENERAL ASSEMBLY. THIS IS NOT THE FIRST TIME THAT THE FIA HAS TAKEN THE WORLD MOTOR SPORTS COUNCIL MEMBERS / GENERAL ASSEMBLY FOR GRANTED.
PLEASE NOTE THAT THE FIA HAD TO WORK AT THE DIRECTION OF THE GENERAL ASSEMBLY AND NOT THE OTHER WAY ROUND.
3. FIA Press Release states that "The established feeling within the FIA is that the FMSCI spends far too much time on irrelevant matters.
Who is this "within the FIA" is that Mr.Mosley and Mr.Pierre De Coninck ?
Irrelevant Matters :
A) The Government of India saying that they donot recognize MAI and they recognize only FMSCI and Mr.Hoosein has misrepresented is "Irrelevant".
B) Mr.Hoosein by misrepresenting facts has CHEATED the WORLD COUNCIL MEMBERS / GENERAL ASSEMBLY is "Irrelevant".
C) Mr.Hoosein has NOT APPOINTED DR.VIJAY MALLYA AS CHAIRMAN OF MAI as per the DIRECTIONS OF THE GENERAL ASSEMBLY thereby BLATANTLY VIOLATING FIA STATUTES is "Irrelevant".
MAY SOMEONE EXPLAIN TO US WHAT IS "RELEVANT" ???
4. The FIA HAS TAKEN SERIOUS VIEW OF THE GOVERNMENT OF INDIA GUIDELINES and they have PARTIALLY QUOTED THE ARTICLES IN THIS.
DO YOU THINK THAT THE GOVERNMENT OF INDIA IS NOT AWARE OF THEIR OWN GUIDELINES ??? THEY HAVE SPECIFICALLY SENT A LETTER TO THE FIA ON THE 15TH MAY 2001 and 10th July 2001.
CAN ANYONE EXPLAIN WHEN THE FIA HAD TAKEN THE GUIDELINES OF THE GOVERNMENT OF INDIA SERIOUSLY, WHY HAVE THEY NOT TAKEN THE LETTER WRITTEN BY THE GOVERNMENT OF INDIA STATING THAT THEY RECOGNIZE ONLY THE FMSCI AND MR.HOOSEIN HAS MISREPRESENTED FACTS SERIOUSLY ?????
THIS SIMPLY GOES TO SHOW THE REAL MOTIVE OF THE FIA PRESS RELEASE IS JUST TO DIVERT THE ATTENTION OF THE WORLD MOTOR SPORTS COUNCIL FROM THE FACT THAT MR.HOOSEIN HAS MISREPRESENTED AND HAS GROSSLY VIOLATED THE GENERAL ASSEMBLY'S DIRECTION AND TO PREJUDICE THEIR MINDS.
IT'S
TIME TO PROVE TO THE HIGH HANDEDNESS OF SOME AT THE FIA THAT THE WORLD
MOTOR SPORTS COUNCIL / GENERAL ASSEMBLY CANNOT BE TAKEN FOR GRANTED !!
