Nazir caught red handed !! - Will FIA realise their mistakes ?

Before we go in to the details of the recent strongly worded letter from the Government of India to the FIA (which I received from one of the members of the MAI !!!) wherein they have clearly stated that "THE MAI IS NOT AUTHORISED BY THE GOVERNMENT OF INDIA AND NO RECOGNITION HAS BEEN GRANTED TO MAI AND THEY CANNOT ISSUE OR GUARANTEE FIA CUSTOMS DOCUMENTS", let us first examine the requisite of the FIA with regard to the affiliation to the FIA :

The dossier for affiliation to the FIA clearly states that

"A Government letter or certificate testifying that the Club enjoys the Authorities' trust for dealing with

Matters relating to motor sport
Matters relating to Touring and the Automobile

and indicating in particular that the Club will be authorized to issue and guarantee FIA customs documents after affiliation of the Club"

The recent letter from the Government of India clearly states that the MAI does not enjoy the Authorities' trust and cannot issue and guarantee FIA Customs documents.

1. It is  a known fact that firstly the MAI's affiliation was discussed in the World Motor Sports Council.

The World Motor Sport Council decided to transfer the Sporting Power from FMSCI to MAI.  The important point to be noted here is that the World Motor Sports  Council had been given a false picture of MAI having submitted their papers required for their affiliation.  In short some one has CHEATED the World Motor Sports Council. Who ????

2. The FMSCI went to the International Court of Appeal, wherein the question of MAI submitting the papers of affilation was clearly brought out.  The ICA brushed this under the carpet.  Who was behind this ???

3. The matter of affiliation was also brought before the General Assembly.  When the paper work was not complete, this was even taken up in the General Assembly, making a FOOL of the entire World.  Why and by Whom ???

Do you think such a CHEATING is possible without Mr.Pierre De Coninck and Mr.Max Mosley and of course our good friend Mr.Nazir Hoosein ?

To prove this :

1) If the FIA had acted in a proper manner, they would have easily found out that the MAI had not submitted the required letter from the Government.  This becomes important as the FMSCI had submitted such a letter from the Government of India when they applied for their affiliation with the FIA.

2) This fact was brought before the ICA

But Mr.Nazir Hoosein, Mr.De Coninck and Mr.Max hand in hand decided to CHEAT not only their fellow WORLD COUNCIL MEMBERS but also went to the extent of CHEATING the entire World by putting this improper application to the FIA GENERAL ASSEMBLY.  The FIA World Council and the General Assembly had no other option except to believe that all the paper work had been completed by the MAI and properly checked by the FIA Office.

3) It is not only that these three, cheated the WMSC and the General Assembly  but tried to cover these up also.  The following would prove this

a) The FMSCI wrote a letter to Mr.Pierre De Coninck on 16th March asking them to clarify if the MAI had produced a Government of India certification which is a pre-requisite to any membership of the FIA ?

Mr. De Conick's reply on 16th March 2001, is given below :

"We confirm that the MAI has produced Government of India certification when they submitted their affiliation dossier last year"

b) The FMSCI requested for a copy of the Government of India certification submitted by the MAI for records on 17th March

Mr.Pierre De Coninck sent a reply stating that he is very busy with the meetings and would come back after the meeting is over.

c) Mr.Pierre De Coninck sent a reply on 30th March stating

"For your information, we would like to point out that we are not authorized to communicate any affiliation dossier of our clubs for obvious confidentiality reasons.  You will certainly have the possibility to discuss this matter during your meeting with Mr.Nazir Hoosein"

This simply goes to show that the MAI never submitted this document requested for as this is a simple letter from the Government of India recognizing MAI and THERE IS ABSOLUTELY NOTHING CONFIDENTIAL IN THIS.  Particularly when the FMSCI is also in India and its Government of India's recognition letter is given to MAI.

In the mean time the Government of India sent a letter to the FMSCI dated 15th May 2001 which reads as follows :

"Sub : Recognition of Federation of Motor Sports Clubs of India (FMSCI) as the only National Federation for promotion of Motor Sports in India

Sir,

I am directed to refer to your letter dated 30th April 2001, on that above subject and to certify that Federation of Motor Sports Clubs of India (FMSCI) having its office at "Krishna Towers - I", VI Floor, Apt.25, 9-13 Sardar Patel Road, Chennai 600 113 is the only National Sports Federation recognised by the Government for the promotion of Motor Sports in India.  As per the existing Government guidelines , Government of India recognises only one National Sports Federation for one discipline"

The Government of India also sent a letter to Mr.Pierre De Coninck on the same day as follows :

"Dear Sir,

I am directed to refer to FIA's Press Release regarding deliberations held in the meeting in Seville on 6th October, 2000 wherein  it was decided to give the sporting power for India to Motorsport Association of India (MAI).

It has been observed from the Dossier for Affiliation to the FIA that a body applying for Motor Sporting powers should produce a Government letter or certificate testifying that the Association enjoys the Authrities' trust for dealing with : matters relating to Motor Sports and matter relating to Touring and the Automobile and indicating in particular that the Association will be authorised to issue and guarantee FIA Customs documents after affiliation of the Association.

It is brought to your notice that such a letter from Government of India, Ministry of Youth Affairs and Sports, a nodal Ministry for such purposes, has NOT BEEN ISSUED in favour of Motorsports Association of India, having its office at Bombay.

The Government of India, Ministry of Youth Affairs and Sports recognizes a single National Organization for a particular discipline only after it fulfils the required criteria.  Government of India recognized the Federation of Motor Sports Clubs of India (FMSCI) having its office at Chennai for the development of Motor Sports in India and FMSCI still continues to be recognized by the Government of India for the development of Motor Sports in India.

In the circumstances, it is requested that the FIA may kindly indicate the circumstances under which MAI has been granted motorsporting powers for India even without a certificate from Government of India".

It is very clear from this letter

1) That the Ministry of Youth Affiars and Sports (as the name itself suggest) is the nodable ministry for granting recognition to the National Sporting Federation
2) The FMSCI is the National Sporting Federation
3) MAI has NOT BEEN ISSUED any recognition letter by the Government of India
4) There can be only one such National Sporting Federation

Taken aback and knowing fully well that the rabbit is out of the basket, Mr.Pierre De Coninck tried to cover up the issue by sending a letter as follows :

"The MAI has already submitted to us a license issued by the Ministry of Finance, Government of India granting a licence FOR THE FORMATION OF THE MAI whose objectives are in accord with our requirements.  This aspect therefore stands closed"

The important point to note here are

1) When the Government of India clearly stated that the Ministry of Youth Affairs and Sports is the nodable ministry, Pierre De Conicks talks about the Ministry of Finance

2) The affiliation dossier talks of Authorities trust for matters relating to Motor Sports and not matters relating to Finance

If you read Mr.De Conincks letter clearly it states that they have received a license issued by the Ministry of Finance granting a licence for THE FORMATION OF THE MAI.   In Short, it is just a license issued by the Ministry of Finance for any company as a matter of fact.  If the FIA feels that such a letter is only required, then there will thousands of application to the FIA from India, as the above is issued to almost every company in India.  When the dossier talks of the authorites trust after the formation of the company, Mr.Pierre De Coninck conveniently talks about the Formation of the Company.

It is also to be noted that when the Government of India says that it is the ministry of Sports which has to deal with the matters relating to sports, FIA states that it has received a letter from Ministry of Finance !!!!!

Obviously not happy with the response from the FIA, the Government of India, which is the largest democratic Country in the World, had issued the recent letter to the FIA, the relevant portion is given below :

"This is to clarify that the so called license submitted by the MAI to the FIA is a license of incorporation issued by the Ministryof Finance in accordance with the provision of the Companies Act 1951 for which the Ministry of Finance is the competent authority.  This does not constitute recognition by the Government of India in the matter of undertaking promotion of sports activities in India which only the Ministry of Youth affairs and sports is competent to grant.

This is to bring to your notice that MAI has not yet applied for recognition to the Ministry of Youth Affairs and Sports for promotion of motor sports in India.  Since it is not a recognised body, it is also NOT AUTHORIZED TO ISSUE AND GUARANTEE FIA CUSTOMS DOCUMENTS as only recognized sports bodies are entitled to issue and guarantee customs documents. At present, the Federation of Motor Sports Clubs of India is the only body recognised by the Government of India for promoting motor sports in India.

This is for your information and further necessary action in the matter as it is apparent that recognition given by FIA to MAI is based upon MISREPRESENTATION  and is in conflict WITH THE SOVERIGN FUNCTIONS OF THE GOVERNMENT OF INDIA."

It is very clear from the above that the MAI does not enjoy any recognition in India and Mr.Nazir Hoosein has totally CHEATED the entire world motor sporting fraternity for his personal gains, using the rapport he has with Mr.Max Mosley.

Oh this is the reason why they hurriedly wanted to grant FINAL Affiliation to the MAI (again by violation and CHEATING) in the Extraordinary Generally Assembly is it ????

It is also to be noted that Mr.Nazir Hoosein now representing Peoples Republic of China is controlling the motor sports in India !!!!

WHERE ARE WE HEADING GUYS ?  NOW IT IS VERY CLEAR THAT UNLESS WE ASSERT OUR RIGHTS, BEFORE THE MATTER GOES OUT OF HAND, AND PUT AN END TO THE HIGH HANDEDNESS OF SOME OF THE PEOPLE IN THE FIA, THESE PEOPLE WOULD KILL THE  SPORT ONCE AND FOR ALL.  LET US JOIN HANDS AND PUT AN END TO THIS MASSACRE.  UNLESS THESE PEOPLE REALISE THEIR MISTAKES, IT IS LIKELY THAT FIA WOULD BECOME AN NON-ENTITY AS FAR AS INDIA IS CONCERNED.
