This meeting was called to order by Kimberly Tarnacki at 
10:05 a.m Kim welcomed all the members and each member and
staff introduced themselves.  Laura Lanngford, Executive 
Director of the Health Profession Bureau, introduced herself
and welcomed the Committee Members.
 

                     DISCUSSION ITEMS 

Role of Committe member- Kim explained to the Committe that 
their main mission is to protect the health and welfare of 
the citizens of Indiana. 

Anne continued by explainingthe Open Door Law and the Access 
to Public Records Act. She advised the committee that Jeff 
McQuary the Committee's legal Advisor would be at all their 
meetings and that the rules would probaly be their first 
order of business. 

Mr.Mason expressed concerns about false information being 
disseminated about the Hypnotist profession. Anne advised 
that the Committee couldn't enforce anything legally to 
ensure that false information was not spread. Anne suggested 
that the Committee compose a letter to advise advertisers 
of correct information in regards to the Hypnotist 
profession. 

Mr. Frye expressed concerns about out of towners coming into 
the state and professing to be hypnotists. Jeff explained 
that this concern can elaborated upon in the rules. 

Tax forms, travel, per-diem - Maureen Bennett explained to 
the Committee travel, perdiem and tax forms matters. Maureen 
informed the Committee of the expeneses for which they would 
be reimbursed and the importance of completing the travel 
voucher completely. 

Election of officers - Kim explained the procedure for 
election of officers and that the Medical Licensing Board 
must approve all elected officers.Kim called for the 
nomination of an Acting-Chairperson. 

Motion made to nominate Jack Mason as the Acting-Chairperson.

Mr. Jack Mason is the first Acting -Chairperson for the 
Hypnotist Committee. This nomination will be forwarded to 
the Medical Licensing Board at their December 4 meeting for 
approval. 

Mr. Mason expressed concerns about the length of term the 
chairperson should serve and notes that this is not in the 
statute. Mr. Mason suggested that the term 
be for two years. Jeff explained that the rules should 
contain the length of  term for an officer. 

Dr. Keglar expressed concerns about how the meeting would 
be conducted and if the Roberts Rules of Order would be 
used. Jeff explained that it is the committee's decision 
on how they wish the meeting to be conducted. 

Concerns were expressed about the Chairperson voting. 
After discussion, the Committee agreed that the Chair-
person should vote only in the case of a tie, but may 
participate in the discussion.

Enabling Legislation - Kim explained that the Hypnotist 
Committee is a sub-section of the Medical Licensing Board. 
Kim continued by explaining that the word"board"in the 
statute refers to the Medical Licensing Board and the word
"committee" refers to the Hypnotist Committee. Kim also 
explained that the enabling legislation is state law and 
that she would be the Committee's liaison for the 
Governor's Office. 

Committee members expressed concerns about the length of 
service on the Committee. Kim explained that this was set 
in the statute and that memberships continues until a 
member resigns, which may be before or after the members 
term of expiration, or until a member is reappointed or 
replaced. 

Mr. Mason explained that the state of Indiana is the first 
state to pass this law and the Committee should be very 
careful in what it does. 

Kim continued to explain the statute as it refers to what 
the Committee shall do. At this time Kim referred the 
Committee to the application packets that they had been 
given and suggested that they may want to look these over 
for possible usage in developing an application for the 
Hypnotist application. 

Mr. Mason interjected that he had already asked other 
orgaizations to send him samples of their certifications 
criteria. 

The Committe expressed concerns about giving everyone who 
wishes to practice Hypnosis in the state of Indiana an 
opportunity to do so. A suggestion was made that the 
Committee certify applicants as a Hypnotist an/or 
Hypnotherapist. 

The Committee also wished to note that the following 
associations have been very cooperative in supplying 
information to the Committee: 

* International Medical and Dental Hypnotherapy 
  Association 
* The American Council of Hypnotist Examiners 
* The National Board for Hypnotherapy and Hypnotic 
  Anaesthesiology 

The following associations opted not to supply information 
to the Committee: 

* The National Guild of Hypnotists 
* The American Institute of Hypnotists 

After further discussion, Dr. Brashear and Dr. Keglar 
will request examination and certification information from 
their respective associations. 

Kim continued her explanation of the enabling legislation 
by bringing the Committee's attention to Section 10. Kim 
explained that this section states that an individual may 
not profess to be a hypnotist or hypnotherapist, use the 
title "hypnotist or hypnotherapist" or use prefix "hypno"  
unless the individual is certified under this chapter. An 
individual who violates this section commits a Class B 
Misdemeanor. Jeff explained that a Class B misdemeanor is 
punishable by less than one year confinement and/or be fined. 

Kim then brought the Committee's attention to Section 15, 
16, 17, 18, and 19 which deal with examination, certification, 
renewals and retirement/inactive status. Kim noted to the 
Committee that the statute states that these are things that 
they shall do. Jeff informed the  Committee that these 
subjects can be elaborated upon in the rules. 

Mr. Mason expressed concerns about the MLB approving schools 
for training. 
Jeff explained that the Committee can put a list together for 
their approval and that these could be included in the rules. 

Sandra Gyer and Rebecca Carter of the Indiana Commission on 
Proprietary Education asked the Committee for help in 
interpreting their role in certifiying approved schools. 
They suggested the Committee might be confronted with 
students who have been trained through these already 
approved programs. Ms. Carter will supply the Committee 
with a list of approved schools. 

Kim continued by noting Section 23-8d which states an 
individual who applies for certification to the Indiana 
Hypnotist Committee before January 1, 1998 may be 
certified as a hypnotist without taking the examination 
if he/she meets the qualifications listed in this section. 
Kim informed the Committee of the impossibility of getting 
an application ready before January 1, 1998. Suggestions 
were made the Committee accept reistrations in lieu of 
applications in order to comply with the statute's January 
deadline. 

Motion made to offer pre-registration for applicants who 
wish to take advantage of the January 1, 1998 deadline date; 
to prepare a media notice to inform the public of this 
deadline date and that their registration form must be post 
marked by January 1, 1998.

Goals - The Committee set the following dates for their 
meeting:

             *Monday, December 8, 1997 

The meeting topics should include the following items: 

             *Examination questions 
             *Sample applications 
             *Wall certificates 
              *Fee schedule 

                            Application 

Review of procedures to create application/certificates - 
The Committee will reveiw the application packets presented 
to them at their next meeting. 

There being no futher business, the meeting was adjourned at 
11:32 a.m.
