CAPPRA has re-filed the law suit in DuPage County Court in September.
The law suit addresses the zoning violation (Reliant builds a private merchant power plant in an area zoned for PUBLIC utilities), and the plaintifs were now required to show the harm caused by the peaker plant's location in that
zoning area.
The group is taking two routes:
Noise study within 1200 feet around the plant. Funding for the study has been approved by the City Council of Warrenville on Oct.5.
Libertyville, McHenry, Zion, and Aurora community groups have met on Oct 14 and have
formed Illinois Citizens Power Coallition. The group's goals include sharing
information and experience gained in individual fights against proposed power
plants and represent citizens' recommendation to Illinois Pollution Control
Board and Illinois legislators with regards to proliferating peaker plants.
