PETITION - IRATE

Councillor Pocock tabled a petition from IRATE requesting that Council support the closure of Port Kembla Copper until a full investigation is carried out into the safety of the Company.

ITEM 7 – ENVIRONMENT, PLANNING AND DEVELOPMENT COMMITTEE – 11 JUNE 2002 – PORT KEMBLA COPPER – COMMUNITY CONSULTATION REVIEW – REPORT OF MANAGER ENVIRONMENT AND HEALTH (ARH) 3/6/02

258 RESOLVED on the motion of Councillor Pocock seconded Councillor Mott that –

1 Council support the request from IRATE and State Member Colin Markham that a temporary closure be undertaken of Port Kembla Copper while all safety and health measures are addressed at State Government level in conjunction with other interested stakeholders.

2 Recognising the potential impact of Port Kembla Copper’s operations on the City Image Campaign’s effectiveness and noting ongoing community concerns with the Company’s operations, an approach be made to Port Kembla Copper seeking a meeting to discuss community health concerns generally, as set out in the report, as well as the recent Occupational Health and Safety concerns.

8. Sandon Point Issues ITEM 18 – SANDON POINT – FACILITATION PROCESS (SU18673) – REPORT OF DIRECTOR ENVIRONMENT AND PLANNING (MJM) 19/6/02

In January 2002, Council engaged Mr Rick Farley to act as facilitator for the Sandon Point project. This stage of the process has now been complete. Attached is Mr Farley’s report.

This report also provides a status on related aspects of the project and seeks Council’s direction on a number of outstanding issues.

250 RESOLVED on the motion of Councillor Martin seconded Councillor Pocock that –

1 Council accept the ‘Farley Report’ and thank Mr Farley for the contribution he has made to improving relationships between the stakeholders associated with the Sandon Point development.

2 Council allocate up to $25,000 to obtain external consultancy support to aid in the ‘fast tracking’ of the DCP/Masterplan Review.

3 Council endorse the proposal set out in this report to seek community membership on the DCP/Masterplan Review Committee by seeking a member from each of the following:

- one representative of the Process Committee established for the ‘Farley Process’;

- one representative from Neighbourhood Committee 3, and

- one representative from the Northern Illawarra Chamber of Commerce.

4 While Council has previously resolved to host a ‘summit’ to facilitate the fast tracking of the LEP based Masterplan, as an alternative Mr Papps, Executive Director of planningNSW be invited to participate in the DCP/ Masterplan Review Committee in a bid to achieve the same outcome.

5 The General Manager and Director of Environment and Planning hold a further meeting with Stockland to seek their cooperation in relation to the development of the Masterplan and the ongoing monitoring of the implementation phase of Stages 1-6.

6 The Master Plan Review Committee recommend to the WCC how best to cement a Master Plan for the Stockland development in its planning and approval processes. The recommendations should recognise that Stockland can lodge new development applications at its commercial discretion.

7 The Master Plan Review Committee consider the areas of agreement and disagreement in this report as initial items for its agenda.

8 The Master Plan Review Committee consider funding requirements for development and implementation of a Master Plan and recommend to the WCC any amendments to the existing S94 plans.

9 The WCC allocate specific resources for operation of the Master Plan Review Committee.

10 The WCC review and, where necessary, amend the LEP for the northern suburbs.

11 Council elect the Deputy Lord Mayor as a further representative on the Master Plan Review Committee and appoint the Deputy Lord Mayor as interim Chairperson during the upcoming absence of Councillor Martin.

9. Private Certifiers

CERTIFICATION OF CONTENTIOUS DEVELOPMENT APPLICATIONS

251 RESOLVED on the motion of Councillor Kershaw seconded Councillor King that Council write to the Minister suggesting the legislation be amended to enable Councils to act as Certifiers on development applications which have been determined by Full Council or the Land and Environment Court.

10. Headlands Austinmer- Coastal Council & Planning NSW PUBLIC ACCESS FORUM – MR ANTHONY ROIWAN – HEADLANDS PROPOSAL, AUSTINMER Mr Anthony Rowan, a Planning Consultant, expressed support for the recommendations contained in Item 19 of Council General Business of 24 June 2002.

ITEM 19 – HEADLANDS HOTEL SITE – LOTS 87-95 DP 9233 HEADLAND AVENUE, AUSTINMER – SUPPLEMENTARY REPORT (D195/02) – REPORT OF DIRECTOR ENVIRONMENT AND PLANNING (MJM) 20/6/02

This item is to be read in conjunction with Item 3 of the Environment Planning & Development Committee of 11 June 2002.

On 11 June 2002, the Environment Planning & Development Committee considered a report regarding the draft Development Control Plan and the status of the Development Application for the Headlands Hotel site at Austinmer.

The Committee made a number of recommendations including:-

“Council seek input of relevant external authorities including planningNSW, NSW Coastal Council and Department of Land and Water Conservation in relation to the draft Development Control Plan.”

This report outlines the outcomes arising from a meeting held on 13 June 2002 with Representatives from planningNSW, NSW Coastal Council and Department of Land and Water Conservation.

253 RESOLVED on the motion of Councillor Yates seconded Councillor Wood that –

1 planningNSW, the NSW Coastal Council and the Department of Land and Water Conservation be given the opportunity to provide further input into the draft Development Control Plan for the Headlands Hotel prior to its exhibition.

2 Council continue to facilitate discussion between the applicant, owner, planningNSW, the NSW Coastal Council and Department of Land and Water Conservation in the development of the Headlands Hotel site in order to clarify planningNSW design and planning criteria for the formulation of the Development Control Plan for the site and to assist the applicant with the preparation of the development application documentation.

3 Following modifications to the DCP it be brought back to Council along with any modifications to the application prior to placing on exhibition.

4 Council officers discuss with planningNSW the role of the Minister for Planning in relation to the redevelopment of this site.

11. Medium Density - DCP 49

ITEM 8 – ENVIRONMENT, PLANNING AND DEVELOPMENT COMMITTEE – 11 JUNE 2002 – DRAFT DEVELOPMENT CONTROL PLAN NO 49 – MULTI-DWELLING DEVELOPMENT (SU18826) – REPORT OF MANAGER STRATEGIC PLANNING (AC) 3/6/02

259 RESOLVED on the motion of Councillor Martin seconded Councillor King that this item be considered in conjunction with Item 5 of Council General Business of 24 June 2002.

260 RESOLVED on the motion of Councillor Martin seconded Councillor King that –

1 Sections of Development Control Plan 9 relating to "Residential Flats" being three (3) or more dwellings be repealed. These sections of Development Control Plan 9 are only to apply in the circumstances described in Recommendations 3, 4 and 5.

2 Council adopt Development Control Plan No 49: Multi-Dwelling Development to take effect immediately from the date of advertising which will occur on 27 June 2002.

3 Applications already lodged with Council for multi-dwelling development will be determined using the existing Development Control Plan No 9.

4 Applicants who have undertaken formal pre-lodgement meetings between 1 March 2002 and 8 July 2002 and have submitted their applications to Council by 5 August 2002 will have their applications determined using the existing Development Control Plan No 9.

5 Applications demonstrating exceptional circumstances including evidence that substantive discussions have been undertaken with Council Officers in formalising a development application under Development Control Plan 9, will be considered and may be reported to Council.

6 DCP 49 be reviewed after twelve (12) months of implementation.

7 Council delegate authority to the General Manager to complete minor formatting and wording changes necessary for final publishing of the DCP 49 document.

12. Street Trees Issues

ITEM 15 – ENVIRONMENT, PLANNING AND DEVELOPMENT COMMITTEE – 11 JUNE 2002 – PROPOSED REMOVAL OF TREES – GRAY STREET, WOONONA

265 RESOLVED on the motion of Councillor Martin seconded Councillor Christian that this item be considered in conjunction with Item 16 of Council General Business of 24 June 2002.

266 MOVED Councillor Martin seconded Councillor Christian that –

1 The matter be deferred to the Council meeting to be held on 22 July 2002 pending a further report being submitted which examines options for the retention of those trees which, in the opinion of Council Officers, can be retained without significant financial or structural impact.

2 The report provide Council with some costings in relation to options for preservation and/or removal of the trees.

An AMENDMENT was MOVED by Councillor King seconded Councillor Jonovski that –

1 Council endorse the approach of consulting with Councillors, the RSL, Neighbourhood Committee, media and residents of Gray Street via a mail-out outlining reasons why the trees can no longer be retained.

2 Consultation be undertaken with the RSL and residents, particularly Mrs Christiansen with respect to the construction of an appropriate memorial including the use of cuttings from the fig trees for new plantings within the memorial.

3 The trees be removed within one (1) month after the mail-out.

4 Repairs to the footpath commence as soon as practicable following removal of the trees.

5 Suitable mature replacement species be planted.

The AMENDMENT on being PUT to the VOTE was LOST.

The MOTION was PUT and CARRIED.

13. Plan of Management for Thomas Gibson Park Thirroul

ADMINISTRATIVE, WORKS AND COMMUNITY SERVICES COMMITTEE – 17 JUNE 2002

RE-EVALUATION – DRAFT PLAN OF MANAGEMENT – THOMAS GIBSON PARK

270 RESOLVED on the motion of Councillor Christian seconded Councillor King that –

1 In any future re-evaluation of the Draft Plan of Management for Thomas Gibson Park, an assessment relating to the potential for the provision of a skateboard facility within the Park be undertaken and if appropriate the facility be placed on the priority list.

2 Should Thomas Gibson Park not prove to be a suitable location for a skateboard facility, other locations in the area be investigated.

ITEM 5 – ADMINISTRATIVE, WORKS AND COMMUNITY SERVICES COMMITTEE – 17 JUNE 2002 – THOMAS GIBSON PARK DRAFT (PR49438) – REPORT OF MANAGER PROPERTY (WAD/JB) 11/6/02

269 RESOLVED on the motion of Councillor King seconded Councillor Kershaw that Council defer consideration of the draft plan of management for Thomas Gibson Park and give further consideration to this matter upon completion and adoption by the Council of the overall master plan for the Stocklands development at Sandon Point.

14 Bushfire Issues

1. Bushfire Asset Protection Zone Risk Management Study Stage 1 - tender to prepare study accepted at May meeting of Council - noting also Rural Fires & Environmental Assessment Legislation Amendment Bill - councils need to map the areas declared by the RFS Commissioner to be bushfire prone land & LGSANSW has problems with setback and infill development arrangements - makes the application of Planning for Bushfire Protection mandatory - preparation of Draft Bushfire Environmental Assessment Code to be prepared

15. Central Wollongong Planning Committee established and meetings commenced in May - next meeting is at 5.00pm on Wednesday July 3 at 5.00pm - members include - David Papps & Neil McGaffin (planning NSW), Terry Wetherall (Illawarra Business Chamber), Arthur Rorris (SCLC), David Laing (Planning Institute of Australia), Neville Fredericks (Urban Development Institute of Australia), Cr Darling, Cr Martin, Cr Wood & Mike Mouritz (WCC)

- Wed's meeting to cover City Centre Revitalisation Study, Urban Development Assessment Policy: City Centre, City Centre Revitalisation : Cultural Precinct

16. WCC Development Assessment & Compliance - Quality Reform and Benchmarking Project

- benchmarking & studying other councils in regard to DA Teams, Principal Certifying Authority Teams, DA Fast Track Teams, One Stop Subdivision Teams

WCC Coastal Advisory Committee - to be established to develop a plan of management for the Coastal Zone and to include councillors, council staff, reps from govt and non govt organisations and NSW Nature Conservation Council, community reps including from Indigenous groups and relevant industry groups
