Official Offer from the State of Georgia Department of Natural Resources to the Ed Weaver Estate

Please note that this offer was sent by certified mail to the Estate's attorney and is dated five months PRIOR to Scott Fletcher's acquisition of the property and has never been officially declined.

Dear Mr. Thomas:

I am a sorry that we were unable to meet on January 22, 1998. Since our last meeting, August 26th, 1997, the Department has maintained its interest in acquiring the 1,219 acres in Gordon County, Georgia, owned by the Estate of Edward L. Weaver.

In keeping with this spirit, we had both of our appraisals updated to reflect current market conditions. Since our last written communication with you, we have received the second updated appraisal, and it has been approved. The appraiser has indicated that there is sufficient market data available to warrant an increase in value.

There fore, I am enclosing for your consideration four (4) revised copies of an Agreement for Sale and Purchase of Real Estate between MR. JAMES D. THOMAS, ATTORNEY FOR THE ESTATE OF EDWARD L. WEAVER and the State of Georgia.

Based upon the recent updated appraisal, this price is the highest approved appraised fair market value. Consistent with this determination of value, we are able to offer TWO THOUSAND THREE HUNDRED FORTY FIVE AND NO/100 DOLLARS PER ACRE ($2,345.00 Per Acre -- $2,858,555.00), for the subject property. Please keep in mind that in selling to the State of Georgia there is no real estate transfer tax.

As you are aware, the Georgia General Assembly is currently in session. Funding for this acquisition is currently provided for in our budget. However, due to the volatility of election year politics, it is doubtful we can protect this money through the end of the current legislative session.

In light of the forgoing, the State of Georgia is making this final offer to purchase the subject property. Please respond to us, in writing, no later than 10 days after receipt of this letter. If you find this agreement acceptable, please sign both redline originals and one copy, have notarized and return them to me. I will have the same executed and return a copy to you. You may keep the enclosed copy for your records.
