Companion Contract

This agreement is made and entered into this___________ day of _________________ 20________ by and between Arvind & Joyce deBraganca (SELLER), and ___________________________________________

___________________________________________________________________________(BUYER), for the purpose of setting fourth the terms and conditions of purchase by the Buyer of a purebred __________

_______________________ from a litter whelped on___________________________________________

out of ____________________________________and_________________________________________

For $________________, the Seller agrees to sell and the Buyer agrees to purchase a _______female;

__________male companion puppy from the litter described above subject to the following terms:

1. Seller warrants that the above described puppy/dog is a purebred:________________________________ registered with the American Kennel Club and the registration papers have______have not__________been provided to the Buyer as of the date of the completed purchase together with a true copy of it's pedigree.

2.  Seller warrants that the above described puppy/dog is in good health at the time the Buyer assumes ownership. This puppy will come with a Health Certificate. Buyer agrees to have the puppy examined by a licensed Veterinarian within (2) two days (not including weekend and holidays) of receipt of puppy/dog. If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the Seller for a refund. If the Buyer elects to return the puppy, Buyer shall, within 10 days after the date of the signing of this contract, send to Seller by certified mail a written Veterinarian's certificate stating that the puppy/dog was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy/dog to Seller at Buyer's expense.  Upon receipt of the puppy/dog, the Seller shall be obligated to refund all monies received from the Buyer toward the purchase price of the puppy/dog, and further performance under this contract shall be null and void. All action taken to return the puppy/dog shall be done with the best interest of the puppy/dog in mind including temperature at the time of shipment, non-stop flights when possible. 

3. Seller warrants that the puppy/dog sold hereunder is progeny of animals with the following health testing:__________________________________________________________________________________

4. Ownership of the puppy/dog will be transferred to the Buyer for the sale price of $________________ to be paid as follows: $_________________non-refundable deposit on execution of the Agreement with the balance of $_______________to be paid on or before the puppy/dog leaves the Seller's premises. If the balance is not paid by:________________________________________, this Agreement shall be canceled and the Buyer forfeits the deposit given hereunder.

5. If delivery is requested by Buyer, it shall be via air freight to a designated location. Buyer is responsible for the cost of the crate/shipping charge/insurance and this must be paid in full prior to shipping.

6. The Seller has determined that the puppy/dog is being sold as a companion and NOT suitable for breeding. In such case, Seller shall provide Buyer with Limited AKC Registraion Certificate. Buyer further agrees to spay/neuter this puppy/dog.

7. Puppy/dog will carry the Passport kennel name.

8. Buyer agrees that he/she is not acting as an agent in the purchase of this puppy/dog and that the Buyer will not sell this puppy/dog  to any agent, broker, pet store or otherwise unsafe/unsuitable situation.

9. Buyer agrees that if it becomes necessary to dispose of this puppy/dog that Seller will be notified and the animal may be returned to Seller at any time. No refunds are given.

10. Buyer agrees that puppy/dog will reside at the home of the Buyer, have access to a fenced yard, not be chained, tethered, and will be provided with proper housing, a good quality diet,  and exercise. Buyer agrees that this puppy/dog will receive adequate veterinary care and adhere to proper vaccine protocol.  Seller strongly recommends and Buyer agrees to at least one basic obedience training course will be completed with this puppy/dog. Buyer further agrees to adequate socialization for this puppy/dog.

This agreement is made and signed by both parties to insure the well being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligation under this Agreement and has the right to repossess the puppy/dog.
