CRY OUT FOR FREEDOM

Presently Rob is serving a natural life sentence in Florida, though he was originally sentenced to quot;DEATH". The Florida Supreme Court overturned his death sentence March 11, 1993.

This [alleged] crime occurred on April 1, 1989 and what you are about to read is startling.

Rob's case raises many questions of law, his rights under Florida and Federal Constitution as well as the integrity of our present court system. Rob's case is a true example of a "MANIFESTED INJUSTICE" as the courts refuse to apply/follow well established Florida case law.

In the early morning hours [2:30 am] on Saturday April 1, 1989 Rob stopped at a donut shop as he had been drinking heavily and doing narcotics. While eating, the deceased approached Rob seeking help. After a brief conversation, it was revealed they both knew the same drug dealer. Upon leaving the donut shop the deceased asked Rob to drive her to a few different places in hopes of finding her friend.

After not locating anyone, Rob told the deceased he had to get home, the deceased accompanied Rob to his apt. where she used the telephone with no luck. Rob was drinking a beer which the deceased made a crack pipe out of, Rob smoked a joint or two while deceased smoked crack cocaine. At this point, Rob told deceased he had to get up early and headed to his bedroom where he passed out.

Upon awakening at around 6:00 am or so, Rob came out to shower and deceased appeared to be high still. Rob showered and before leaving for work he told deceased if she left to lock up, that she could shower and left the telephone number of his place of employment, next to the phone for her in the event she needed to contact him, the deceased was very much alive when Rob left for work that morning at 6:30 am or so.

At around 10:30 or 11:00 am, the deceased called the shop where Rob worked and asked Rob what time he would be home from work. Rob told deceased sometime around 6:30 pm. When Rob arrived home, he found the deceased dead on his living room floor with the crack pipe and some crack rocks, cocaine beside her. Rob flushed the crack-cocaine and crushed the can deceased was smoking from and disposed of it.

Then Rob left the state and went to Texas, leaving all his personal belongings in the apt. The reason Rob left was, he had just been released from prison after a re-trial where the jury acquitted him of all charges, and Rob felt they would accuse him of the deceased death....which they did anyway.

The State Prosecutor solicited Wesley John Pope, a "jailhouse" snitch under the promise of helping him secure a parole. Pope knew Rob and hated him and agreed to help the State Prosecutor convict Rob.

In the State's opening argument to the jury, he told the jury the evidence would show that Rob had choked/strangled the deceased as well as sexually assaulted deceased. Although the State's own expert witness Edward Corcoran M.E., testified there was NO evidence or trauma of the neck area or petechia, NO evidence that any kind of sexual assault occurred with deceased and the he [Dr. Corcoran] was not even "ABSOLUTELY SURE" as to the actual cause of death . 

Contrary to what he [Dr. Corcoran, ME] wrote as to cause of death, "PROBABLY ASPHYXIATION" due to "HOMICIDAL VIOLENCE". There is NO physical evidence, medical evidence to establish the State Prosecutor's theorized story he told the jurors. The State's entire case was solely based on his personal theory, there is NO physical evidence to justify Rob's conviction or sentence.

Presently, Rob has a Petition To Invoke All Writs Jurisdiction which is a constitutional writ pending before the Florida Supreme Court. Said petition was filed July 17th, 2002. You can find said information under flcourts.org, Case No.:SCO2-1086.

Rob was convicted for his past rather than the charge he stood trial for, as the State Prosecutor used "WILLIAMS RULE" evidence [Rob's past] to secure a conviction. Though the State contacted Rob's trial attorney and told him..."if we can't use Rob's past, you file a motion to dismiss the charge and we won't object".

To sum it up, deceased's brother told police his sister had a bad crack-cocaine habit. Deceased was smoking crack-cocaine while 18-19 weeks pregnant, and was a nude dancer. WHY didn't the state charge Rob with the death of the fetus?

WHY wasn't DNA done as ANY medical personnel knows that cocaine would go directly into the fetus, said cocaine would be easily located in the soft tissue of the fetus although NO such test was performed by the State's expert witness, Dr. Corcoran ME ....WHY???? Would you ask this question?

In addition, two police officers state in their reports that there was NO signs of a struggle or violence to indicate a homicide had ever been committed in Rob's apt.

Shortly thereafter Rob's apt. was burnt down and ruled as arson but no one ever bothered to investigate it.  With that, I leave you with this thought.... "WHAT IF IT WAS YOUR LOVED ONE WHO WAS WRONGFULLY CONVICTED UNDER THESE CIRCUMSTANCES? ... HOW WOULD YOU FEEL ABOUT THE INJUSTICE?"

Wife's statement: My husband is innocent, I have read the trial record, police reports, autopsy report and do have a background in the medical field. I can tell you with all my heart my husband is a victim of the judicial system. I am in no way knowledgeable of the law but it does not take an attorney to read what I have and ask HOW DID THEY EVER CONVICT THIS MAN?
