Firm's Practice Areas


RHETT TRABAND is a Senior Litigation Associate with the Firm. Mr. Traband concentrates his practice areas in securities and complex commercial litigation as well as appeals. Mr. Traband also represents clients in securities arbitrations before the National Association of Securities Dealers and the New York Stock Exchange.

Mr. Traband is admitted to practice before all Florida state courts, the United States District Courts for the Southern and Middle Districts of Florida, the United States Circuit Court of Appeals for the Eleventh Circuit, and the United States Supreme Court.

Mr. Traband graduated from the University of Miami (B.S. with honors, 1991) and Villanova University School of Law (J.D., 1994) where he was a member of the Villanova Environmental Law Journal and the founding Editor-in-Chief of the Villanova Sports and Entertainment Law Journal.

Among the legal publications Mr. Traband has authored are: “The Case Against Applying the Co-Conspiracy Venue Theory in Private Securities Actions,” 52 Rutgers L. Rev. 227, 1999; “An Erie Decision: Should State Statutes Prohibiting the Pleading of Punitive Damage Claims be Applied in Federal Diversity Actions,” 21 Stetson L. Rev. 225, 1996; “The Acton Case: The Supreme Court’s Gradual Sacrifice of Privacy Rights on the Altar of the War on Drugs,” 100 Dickinson L. Rev. 1, 1995; and “New York v. United States: The Constitution and Environmental Fallout for Low-Level Waste Disposers,” 5 Villanova Environmental Law Journal, 267, 1994.

•     FPA Securities Litigation
Along with other members of the Firm, Mr. Traband represents the former President and CEO of a public company in defense of various actions alleging violations of the securities laws. The actions are pending in Federal Court in San Diego.

•     Partsbase Securities Litigation
Along with other members of the Firm, Mr. Traband represents a public company and its officers and directors in defense of a Federal class action alleging violations of the securities laws. The case is pending before the United States District Court for the Southern District of Florida in Miami (Ungaro-Benages, J.).

•     Cash 4 Titles Litigation
Mr. Traband, along with other members of the firm is one of counsel for a class of persons defrauded in connection with a Ponzi scheme. The class action against the Bank of Bermuda (Cayman) Limited, alleging a R.I.C.O. claim recently settled for a payment of up to $67.5 million to the Class.

•     Tarmac America, Inc.
Along with partners of the Firm, Mr. Traband represented Tarmac at trial before the Circuit Court for Miami-Dade County, Florida. The case was settled on terms favorable to Tarmac following a week-long jury trial.

•     Exotic Gardens, Inc.
Mr. Traband was lead counsel for Exotic Gardens in connection with an Appeal before the Eleventh Circuit Court of Appeals of an order denying an award of attorneys’ fees. Following oral argument, the Eleventh Circuit entered an order in Exotic Gardens’ favor.

•     SunGard
Mr. Traband is lead counsel for SunGard, which is a leading provider of information availability services, in a breach of contract case pending in the Circuit Court in and for Miami-Dade County, Florida.

•     John Michael Grimley, Sr.
Along with a partner of the Firm, Mr. Traband represents Mr. Grimley in a NASD arbitration against Salomon Smith Barney, Inc. and others seeking to recover compensatory damages in excess of $5 million.

•     CalPERS
Mr. Traband was one of counsel who represented CalPERS and several prominent venture capital firms in a securities action involving claims of accounting fraud against Arthur Andersen in a case before the United States District Court for the District of Arizona. The case was settled on terms favorable to the clients. •     FinishMaster
Mr. Traband represented FinishMaster, Inc., the largest distributor of automotive paint products in the United States in a case before the United States District Court for the Northern District of Florida (and other matters) involving violations of covenants not to compete. The case was settled prior to trial on terms favorable to the client.

•     National Partnership Investment Company
Mr. Traband was one of counsel for NAPICO in a case before the United States District Court for the Southern District of Florida (Ryskamp, J.) involving complicated tax credit and development partnership issues which resulted in a judgment for NAPICO following a bench trial. The representation included three successful defenses of appeals to the Eleventh Circuit Court of Appeals.
