Dear Kay,

My name is John M. Jagade and I'm here at Union CI.  A friend of yours named Michael told me you may be able to help me.

I'm currently in confinement for a real bogus charge.  On April 14, 2001, while doing a cell search, the officer came up with two bags containing a powder substance.  I was called out to the lieutenant's office, and when entering his office, I was told that they found two bags of powder that tested positive for amphetamines.  I said, "I don't know anything about any drugs.  I did have a bag of Acrylic, which I used to fix my headphones where the plastic broke." He showed me a picture and I said, "The little bag I had - the other may have been an old bag of it, but it's Acrylic," and I told them they could go to the Dental Lab and there is tons of it to make custom trays and bit trims [sp?] for false teeth.  I said "I don't do drugs," and volunteered to give them a urine sample.

He said okay and I urinated in a cup.  They tested it on the spot and it was negative for all drugs, which I thought they would let me go.  But then the lieutenant said the captain said to lock me up, but that they would send the acrylic out to be tested.  This never happened. 

I was taken to confinement that night late April 14, 2001 and that was on Saturday.

On Monday an investigation Sergeant brought me a DR, which means disciplinary Report.  It charges me with possession of Narcotics!  I explained that I was told by Lieutenant Crosby that they were sending the powder out to be tested and I would like to postpone this DR.  She stated, "Well, we don't send substances out as far as I know, only urine samples."  She wouldn't listen and told me she was giving me the DR anyway.

On Wednesday, April 19, 2001, I was brought before a Disciplinary Committee of two people, my classification officer and Lieutenant Harden.  Both refused to postpone my hearing and I explained the powder was acrylic and I was told that they would send the powder substance out to be tested or analyzed by outside lab.  They said, "Appeal it!" and told me to write the inspector of the institution.

I went back to the cell in confinement and was sentenced to spend 60 days in confinement and lose 180 days of gaintime.

I wrote up my appeal and sent it to the warden of Union CI, also requesting the powder be analyzed.  He denied the appeal.  I wrote to the lieutenant, the captain, the warden and assistant warden.  I wrote to the classification inspector and the inspector general in Tallahassee.  No one would listen to me.  

Lieutenant Crosby, who locked me up, stated that he sent officers to the dental lab and they got a little of the acrylic from there and tested it and it showed up negative for drugs and mine positive.  I thought this is impossible because I know the stuff I had was acrylic.

I wrote the inspector here, Mr. Jernigan, at Union CI.  He said he believed Lt. Martin was handling it cause I asked him to help.  I talked to him and he said that my story didn't come out true.  He tested the acrylic at the dental lab and it came up negative.  I asked if he used the same test they used on the powder they tested from my room.  He stated he wasn't sure. 

So, I filed to the inspector at this and was very upset.  Because if this was in fact drugs inside an institution, it's the inspector's job to handle it and if they were real, why didn't I receive outside charges?  I wrote several grievances explaining that this stuff was acrylic and begging for them to test the powder on the street in a lab, but all grievances were denied.

The inspector finally got involved some.  He went to dental lab, got some acrylic and tested it with the same test they used on the powder I had.  It came up positive.  He wrote me back saying this, "I may have some good news for you, but I have not finished with my testing.  I did test the powder taken from you and a sample of powder from the dental lab.  They both tested the same and they were indicative of amphetamines.  One more test will be run on the powder in your possession to confirm this.  You may be hearing something from classification if it comes out in your favor.  Do not write me.  You will hear about the results."

This proved my story 100% all along, but he said he was having one more test run, so I assumed he was sending it to a lab, but no, he didn't do this.  He sends it to PRIDE, the company in charge of the dental lab and tag plant and furniture factory, which they said they tried to mix some and it didn't work right so they said they didn't know what5 it was but its not acrylic.  These people don't know what5 their doing!  The powder may take a special hardener to get hard.  I had two different types of acrylic and I had the same problem with white acrylic not wanting to get hard.  I believe you need special type hardener or monomer.  The blue and pink acrylic uses the same monomer.

Anyway, they haven't released me and I finished my 60 days in confinement, but was told they want to CM me now, which means possibly years in confinement for this.  I've offered to pay for an outside lab to test the powder.  They wouldn't listen and they say they won't spend the money to do it even after they contacted the people who make the kit test called "NARK #6 MANDELIN REAGENT AMPHETAMINE TEST".  They said some substances do show a positive result that are not drugs.  Which means they should of done another test at a lab because everything I said came out true and even the acrylic in the dental lab showed a positive with their test.  I should of never had the stuff true enough.  But it was not drugs and therefore I shouldn't have been charged for drugs.  But they should of charged me for contraband which would of only been 15 days box or confinement, 30 days lost gaintime and they couldn't CM me for that.  Now they don't want to release me and admit I'm not guilty and they messed up and need to give me all my gaintime back and drop all charges and take it off my record.  They also can't charge me for contraband cause they already charged me and sentenced me and you can't go back and give a lesser charge.  They would have to drop it altogether.

I need your help bad.  My sister lives in Canada and it's impossible for her to come down here to help, but she did say she would call inspector Jernigan here at the institution to tell him she would pay for the test to have powder analyzed in a lab to prove it's acrylic not drugs.

Any help would be greatly appreciated.  I've been in prison on and off a total of 13 years in and have never had a dirty urine or drug charge.  I have never seen meth or crank amphetamines in my whole life.  I never used them, never handled them, or sold them!!!  NEVER IN MY LIFE!!!!

P.S.  I have in black and white where they stated they tested acrylic in the dental lab and it also came up positive same as the powder I had.
