THEN PUNISHED BY GUARDS FOR NOT WANTING TO GO BACK FOR MORE!

UPDATE:  July 5 2001

I received a note a few days ago from my son with a form he was served with. He's been charged (they hold court within the prison dealing with internal charges) with Disorderly Conduct by Officer Dean. The same guard who tried to force my son into the cell with the psychotic inmate so he could "finish the job".

The Disorderly Conduct charge was for Lance refusing to go back in the cell.

The form says: " STATEMENT OF FACTS: ON JUNE 25, 2001 AT APPROXIMATELY 7:55 WHILE ASSIGNED AS CLOSE MANAGEMENT HOUSING OFFICER IN BRAVO DORM. I WAS SUPERVISING THE SHOWERING IN WING II. INMATE FIERKE, LANCE #357774 WHO IS HOUSED IN B-2211U. WHILE ATTEMPTING TO ESCORT INMATE FIERKE TO HIS ASSIGNED CELL HE BECAME COMBATIVE BY SCREAMING AND YELLING. INMATE FIERKE STATED I AIN'T GOING, AIN'T GOING. THE SHIFT SUPERVISOR WAS NOTIFIED AND AUTHORIZED THIS REPORT TO BE WRITTEN. INMATE FIERKE WILL REMAIN ON HIS CURRENT STATUS PENDING DISCIPLINARY TEAM ACTION. REPORT WRITTEN; 05/25/01, AT 20:40 OFFICER DTK01 - DEAN, T.K. (date delivered to inmate Fierke 6-27-01 by JB Steene)

Obviously this is damage control by Officer Dean. Notice that this report makes no mention of trying to force Lance into the cell or using unnecessary force on him. Dean is trying to make out like the incident never proceeded beyond the shower.

After the incident my son was put in a cell with a former room mate that was nonviolent but today I received a letter from Lance saying the room mate was moved out already and he is by himself. Unfortunately he was in a cell by himself when they moved the psychotic Hyatt in so it isn't necessarily safe then, to be alone. FONT>

Anyway, that is the latest. I wish I could be optimistic and say that he'll be ok under PM, Protective Management in a single cell but I can't realistically assume he'll be ok, not after the track record of these guards.

Regarding My Son, Lance

I'm receiving emails from people I've never heard of before and this is a good thing! Thank you all so much for your concern.  I'm getting reports like this, not only from Lance's Aunt, but from people all over the world!!!!!!

"I have been unable to get through to anyone! The prison hangs up on me and the answering machine at Greg Drake's office say the phone lines are all filled at this time, and to try again later. I just hope the reason I can't get through is because he is getting so many calls about Lance, his lines are clogged."

My son is still in grave danger. I received a cryptic note from Lance today with a form in it. The form was a Disorderly Conduct charge brought by Officer Dean (the Officer who used unnecessary force). He said Lance was being combative for refusing to go back in the cell with his psychotic rapist/killer.

My son is to be released one month from now but Officer Dean seems determined to get him raped and/or killed. This Disorderly Conduct charge means Lance will be subject once again to being moved to a cell with a psychotic inmate, and it could affect his release date.

It is imperative that these people hear from the public so they will know they are being monitored. We need to call Santa Rosa in protest, whether it's in regards to my son or any of the inmates.  

I've been working in this arena (inmate rape) for some time trying to get reform. I was hoping my son would not fall victim to it but it was not to be.  I hope you will grasp this opportunity to exercise power for change, so at least my son's suffering won't have been in vain. 

Phone calls and emails are our weapons against oppression.

LANCE FIERKE'S REPORT OF THE RAPE AND BEATING

6-26-01

Hi Mom,

It's me again. I've got good news and bad news. The good news is I saw my counselor Mrs. Hooten today and she has set me up with a counselor when I am released in a month. 

OK, here's the bad news. When I lost my good roommate because he got a job, another roommate moved in from CMII named Hyatt. We didn't get along at all. Not only did he overpower me and try to choke me, but he RAPED me! This happened on 6-24-01 at 8:30 am. I was ashamed of what happened, so when I talked to the officers about getting moved on 6-25-01, I was denied.

Around 6:25 pm last night (6-25-01) we were taken to the showers. I refused to go back in the room after they took my roommate back to the cell. Officer Duremus came to me in the shower and offered me protective management and I agreed to it. Then Sgt. Gilow (sp?) came to me and said, "What's this about you refusing to go back in your cell?" I told him I requested P.M. (Protective Management) and he walked away. Then Officer Dean approached me 5 minutes later. He told me to cuff up and go back to the cell or I was going to be gassed in the shower. 

So I cuffed up and when I got back to the cell my room mate (Hyatt) was yelling, "Keep me out of your business (which means anus), I'm going to fuck you up!"

Hyatt had already told me he was going to rape me again when I came back from the shower. So I looked at Officer Duramus and Officer Dean and said, "Please don't put me in that cell." When they opened the cell door I turned to run. Officer Dean grabbed me (I was still cuffed up from behind) and told me to stop and stated, "You're fixing to get slammed on the ground."

Before I knew it I was slammed on the ground and Officer Dean had put his left knee on my right knee. Then he bent my right leg into an "L" shape, pulling up on my ankle trying to dislocate my kneecap. He wrenched the handcuffs on my wrists till there was no circulation as he continuously tried to pry my leg upward while holding it with his knee. I was then put in shackles on my ankles and taken to medical.

I told Captain Burnham why I was scared of my room mate and I asked her if I was going to be stripped or gassed or what? She told me she was going to give me a room change. Another Officer (I don't know who) said, "Take him to the hospital". They put chains on me and took me to the hospital in Defuniak Springs where they examined my anus and ran a blood test. 

When I got back (2:30am) they took blood in Medical for STD`s. I was then seen by Captain Rhodes. I made a complete statement against Officer Dean. I also asked him how I could be safe here with the guy who raped me working as an orderly and his homeboys working as orderlies? He said "maybe" they will transfer me closer to home since I am so close to getting out.

Bottom line, the hospital couldn't find any proof because it was a day later that I was examined. I tried my best though. I have every intention of filing charges against inmate Hyatt. So not only does Captain Rhodes have my witness statement against Officer Dean but Captain Burnham has my witness statement informing her about the rape and use of force.

If you like you can give a copy of this to the FBI and FDLE. As soon as you get this letter let me know as things have a way of getting lost in the mail.

Saturday, June 30, 2001

My sister (in Hawaii) called Santa Rosa tonight (6-30-02)....and was told the same old "witnesses are just inmates" shit.   The guy (no name unfortunately) said that inmate witnesses don't count. Yeah, until they're testifying for the prosecution....

I got a letter from Lance saying he has another room mate now,
and a change of cell #. He's had this roommate before. so as far as I know
this one is ok (non predatory). His new cell address is: B-2113 . His
roommate is Robert Grimsley DC# 461382.

He's still in a lot of danger because he filed a statement against Officer Dean and inmate Hyatt. He should be transferred out of there, period. He's not going to drop the complaints.

COMMENT FROM LANCE FIERKE'S MOTHER

I'm going to try and call the prison but when I've done that in the past, like the time his nose was broken. They wouldn't talk to me, yet others got through on his behalf. Lance has already had contraband put on him in setups countless times. Not drugs though, cigs and notes to be passed, stupid stuff like that, but enough to get him in trouble. Certain guards have terrorized him ever since he got in that Hellhole. So I think they're trying to get him before he's released. 

They already got him raped and almost strangled like Steven Stonebraker. If he'd been a little guy like Steven he'd probably be dead now. I still say though that the inmate *Hyatt (I still don't have a first name) must be psychotic to choke a man. I could tell by Lance's letter that the choking part surprised him. Usually a man will beat, kick, or use a weapon in there. Choking another man is nuts. So that would make him extra strong as well. My email is DRae@watchmail.com

TWO OF THE WITNESS LETTERS

6-25-01

Dear Mrs. Fierke,

I'm writing you to inform you that Tree (aka Lance Fierke DC# 357774) was a victim of unnecessary use of force by Officers Dean, Officer Duramus and Sgt. Gielow. 

At approx 8:01 pm on 6-25-2001, I witnessed these officers slam him to the ground and punched and kicked him while he was handcuffed behind his back.

Tree is OK! So don't worry. He is not hurt, just shook up. .

It's wrong what was done to him and I just wanted to let you know what has happened.

Dear Donna,

I have a little bit of bad news for you. Last night Tree tried to get moved out of his room because his room mate threatened him. When he told the officers that he was in fear of his life and didn't want to go back into the room with his room mate after he showered, they tried to force him to go back into the room. They forced him to the floor and put shackles on his feet, picked him up and carried him to the shower and brought the Captain (a lady) in. Tree explained to the Captain that he was in fear of his life. 

They took him to Medical. I saw him limping when he came back from Medical. 

Now he is in a "protective custody" cell. Generally, from what I can tell, he seems to be o.k. If you call up here, the Captain who was working when the incident took place was Captain Burham. She works from 3:00pm to 11:00pm. Also, you can call Captain Rolle (who works 11:00pm to 7:00am) if you want to ask questions or do your own investigating. 

Just trying to be there for you both as a friend. Hope to hear from you soon.

A LITTLE CONJECTURE ABOUT THE RAPIST

There is a serial rapist in Santa Rosa nicknamed "Papa Smurf". Inmates are so scared of him they won't give his real name (or possibly some don't know it). I'm wondering now if Hyatt, Lance's rapist, is this Papa Smurf. I'm also wondering if Hyatt is the one who raped and choked to death Steven Stonebraker in Santa Rosa. No one was ever charged with that murder. 

Hyatt is also an orderly who can move freely, so he could have had the opportunity to kill Steven and leave the scene of the crime. Hyatt has to be exceptionally strong because Lance is very strong. He is 6'5 and 200 lbs, so if Hyatt could overpower him, I'd have to say he's psychotically strong. Which brings me to my next point, WHAT is the DOC doing celling psychotic rapists/killers with non violent room mates?

Some inmates and guards have info about Hyatt, "Papa Smurf" and Steven Stonebraker.  Some are still in Santa Rosa and some have been transferred, but if they have been hurt by Hyatt or "Papa Smurf", or one of the officers involved, they need to take this "opportunity" to speak out since Lance is pressing charges against Hyatt and Officer Dean.

My many Santa Rosa contacts are keeping their eyes on the situation and will keep us informed.  Nothing is guaranteed, but we are watching their every move and, if they have any common sense, that should hopefully keep the dogs at bay until Lance is moved or released and a real investigation can prove whether Mr. William Hyatt is Papa Smurf and whether Hyatt or Smurf is the killer of Steven Stonebraker..
