WAITING FOR BELATED DNA
"It's easy to put an innocent man in prison on Death Row. There's a lot of injustice and corruption going on in the justice system and if you can't afford a good attorney, you're not going to get a fair trial."
Thomas Lee Gudinas
I always try to stay mentally strong, but there are times when I feel depressed or stressed, feeling all alone. I don't usually tell anyone when I'm feeling this way, but then again, I wish I had someone to rely on and talk to at these times. For the most part I just take things one day at a time now, and it's helped me deal with this situation better. Right now, I'm stronger than I've ever been.
You can't trust attorneys completely when they get paid by the same state branch that is trying to put you on Death Row and have you executed.
I didn't get a fair trial. My trial attorneys failed to locate my alibi witness. My trial attorneys failed to get the DNA tested when I have always wanted it tested.
The state got a court order to take DNA samples from me before trial. They took blood, hair, pubic hair, and a swabbing from inside my mouth. Where is all this evidence of DNA samples they took from me? I told my attorney I want DNA testing. My trial attorneys failed to get the DNA tested and made a deal behind my back with the state not to test the DNA. Why did the state supposedly not test it when they charged me with the rape and murder of a 27 year old female?
Here's why: At a hearing with the judge, the state prosecutor, Jeff Ashton, told the judge that he didn't plan on doing anymore DNA tests... that it would be "of no value" to him. The judge said, "It could be of value to the defense."
The so called deal that was made without my knowledge was, if the state didn't bring up a bloody shirt that was found (that was not mine), my attorney wouldn't bring up the lack of DNA. But the state brought this bloody shirt into trial and cut the blood stains out of the shirt and told the jury "this is where the blood was".
They put semen and saliva and other DNA evidence into evidence at trial and never told the jury whose DNA it was. So the jury assumed it was my DNA.
My attorney called one witness during guilt phase, Detective David Griffin, to question him about other suspects who all had their blood drawn for DNA tests. Where are these results? This is the same detective who wanted and asked for me to be given the death penalty.
God does work in mysterious ways. I won my appeal for DNA testing. I will keep you informed of any developments. Thank you for your encouraging words. I will definitely hand on to my faith.

GYPSY DANCER ~*~
The Dream
Out walking through the woods one night,
a Harvest moon on high...
Ting, Ting, Ting, I heard them ring...
Their rhythmic ting's came drifting by.
I followed the sound through the trees
and a voice began in song.
Then there it was - a Gypsy camp
and I beheld a Gypsy girl
her tresses black and long
I watched her swing and sing and sway,
a tambourine in her hand.
Then she began a barefoot dance
in twirls and leaps
through dusty sand.
"Come in from the shadows, friend
and you're welcome in our camp."
The woman had a grasp like steel,
her hair of silver long and damp.
She led me forward from the trees
and the music ceased to play
I was simply passing by...
"Relax," she'll softly say.
Come and I will read the cards
"Come, boy, if you dare..."
She'll lead me up the wagon steps
and I'll feel the other's stare
"Sit, my prince," she'll whisper low
and brew for me this drink.
As I drink she will incant
to somehow form this magic link.
Before my eyes her years will fade
till again she's in her youth,
becoming the dancer that I saw,
or so it seemed to me in truth,
with skin as soft as satin
and fragrant like a rose
For her I'll be an artist
and she my clay to pose.
Could this be enchantment true
or a curse of carnal bliss?
For I awoke back in the woods
longing for my dancer's kiss!!
