It has just been called to my attention that over 16000 retired carpenters are actually suffering Under your leadership.

Their checks have been cut in half with no cost of living increase. A 500 dollar check Under Social Security has risen to 775 dollars in your time frame. It does not take a financial wizard to figure that they have a check value of 225 dollars left. Nor the fact that most of them were paying into the pension {$2.62 per hour{ $105.80 per week when they retired. If you calculate closely you will see that we paid our good dollars in and only getting back only $15.40 short of what you actually took out of our pay checks in only two weeks. This could be a reason alone for an investigation of any pension fund, let alone ours that did show a loss of 84 million just a few years ago when you, Mr. McCarron, become president of the carpenters’ union.

Two Billion is a lot of money and the ones that put it in should be benefactors first of all - not ignored and shut out of all negotiations, not treated like we do not exist. We desperately need action to avoid the need for national attention. Law suits and reasons to help destroy all the good things that other unions do and are still doing could be and can still be avoided. It is time to double our pensions now before the government starts taxing our profits as excess.

Mr. Tietz and his wife have both past away in the last three months I and we all have all lost a man who would stand up and be counted when it came to the Carpenters Union.

The {CENTER} is collecting evidence of whether or not the Carpenters Pension Plans Illegally underpaid an unknown number of participating retirees by 20-50-or 100 per-cent. Starting with PAST SERVICE, SERVICE PENSIONS. IF YOU HAVE ANY INFORMATION ON THIS SUBJECT, PLEASE CONTACT ME.

I and other retirees in the year 1992, claimed union fraud, we brought up the subject to the PRECINCT REPORTER, Staff Writer W. K. Berry, and they printed a article on Thursday, June 18, 1992. I was informed by some of Leaders of the CARPENTERS UNION THEY WERE GOING TO SUE MY BEHIND OFF. I said, “ Please do will sue you all in class action suits, and with others, plus each and ever one of us participants would sue each and every one of the leadership and each and every one of these UNSCRUPULOUS PEOPLE, who were in to this UNION FRAUD, which under the law we could each do”.

IT IS TIME TO TAKE THESE PEOPLE TO COURT BY NOT ONLY THE CARPENTERS, & THE LATHERS AND OTHER RELATED

My Dearest Senator, Diane Feinstein,

I am writing you from Orange County and as you are aware we are not a little country any more. In fact Broardcom lists 500 of its employers as millionaires and I am sure that you can tell me more about us than I can.

The point I would like to make is that when we were a lot smaller we had eight carpenter halls and today they are gone. We do have a drywall local in Orange and that is where this story begins. To hold your attention I want you to know that your husband is deeply involved and I hope that you will read on. Labor supports you and I personally love the fact that we have not one but two women senators. I believe they are more honest than men. I’m sure you have heard the famous Thomas Jefferson quote “If all men were honest we would not need a government.” That also should pertain to unions especially since they are handling billions in pension money. It so happens that your husband makes more money from our pension than any one else that we know of. Our pension is being run wrong by having five active carpenters continually vote themselves raises and through peanuts to the retired carpenters. What they have done to us is reduce our standard of living by not giving us raises. The average pension check is $500.00 and if you compare it to a cost of living index with our Social Security you will find a $500.00 Social Security check has risen to $775.00. They are making us second class citizens by reducing our original pension in half.

As Democrats {and my daughter and I were delegates to the last convention in Sacramento} we stand for anything that benefits mankind and that I always thought is what unionism was also all about. What you can do for the 16,500 retired carpenters in Southern California is ask your husband if they are being fair with us or not. He has heard their side only. we are nothing to them not even the Labor Department has done anything for us and they know our story. We realize that there is nothing in the rules that says they owe us a cost of living. However when five active officers vote on it and we always come out losers there is something wrong.

Ask your husband to see our side of it!

1. Who put the money in to start the pension?

2. When Douglas McCarron took over we gave him $900,000,000 to work with.

3. We were paying in $2.62 an hour, $104.80 a week.

4. We were funding half the pay roll for the retirees then.

5. We could only get $40.00 credit for 1800 hours of work - that would be a Maximum of $40.00 for10 years.

6. They voted to reduce what they pay in to $1.01.

7. The total work hours produced only $16,000,000.

8. They escalated the $40.00 to $200.00.

9. It took us 10 years to make $400.00. Now they can make $480.00 in one year.

Senator Feinstein, please ask your husband to come to our aid! The rest of the country is being fair to their retired people and it would only take someone like him to just say to Mr. McCarron. “You are the President of the Carpenters Union and you actually cast the tie breaking vote to not give the retires a raise and every time you had the chance. Don’t you think it would be ethical if you give up control of the 2 billion Dollar pension fund. The ethical purpose of any pension is just to make the payroll and thank God you are not running Social Security or we old people would be hurting.

My name is included in the carpenters’ pension and more important to me is my wife’s {SenaRADES, BUT FOR THE PUBLIC AS WELL IN IN THIS YEAR 2000. OTHERS ARE PULLING THESE SAME TRICKS ON THE PUBLIC.

The {CENTER}, will be asking any and all to have {PUBLIC HEARINGS ON ALL OF THESE PROBLEMS}. I HAVE TAKEN CARE OF ONE PROBLEM, I WAS INFORMED THEY WOULD HAVE MEMBERS JOIN AND TAKE CARE OF ME , BY HAVING ME, REPLACED AS PRESIDENT OF THE UNION ALL-PENSION AND DEMOCRATIC RESEARCH CENTER, INC. (BYLAWS STATE NO MEMBERS ) IN THIS WAY ANY AND ALL WHO WANT TO BE COMMITTEE MEMBERS NO DUES CAN KEEP THE (CENTER), AND ITS PRESIDENT ON TRACT AS WELL AS ALL OTHERS WHO MAY FOLLOW. We will update on Mr. Bowen, when new revelations and facts come to light. TED Bet: Some one turned Mr. Bowen in to the I.R. S. He told the I. R. S. he had not cashed said check for $6,401.00 dollars, the I. R. S. said, “he owed $1,200 dollars, and could not GET THE NAME OF WHO CASHED HIS CHECK TILL HE paid this sum”. This is going to get interesting as the FEDS., I. R. S. and the Police Department might get into this game.

Mr. Bowen, paid the I. R. S. the sum of $1,200.00 dollars.

Mr. Bowen, on said check stated, “DON’T OWE FRAUD DEPT”.

INTERESTING AS ALL OF THE CHECKS BEFORE WERE FOR $4,300.00.

THIS CHECK WAS FOR THE SUM OF $6,401.00.

ALSO MR. BOWEN, (PROTEST PAID IN FULL TO THE I. R. S).

Mr. Bowen, date of 2-15-20, has been advised that some one cashed his check by the I.R.S., his tax advisor is asking all concerned with the cashing of said check. Mr. Bowen, did not cash this check. We are going to find out who cashed this check and who turned him into the I.R.S

. I Elvin F. Scott, was dispacthed 3-28-66, 3-29-66, arrived at job site 7:30 AM foreman was not there. The superintendent name Bob Leslie. Started to roll out cords, saws. There was a problem and problems from the start, crips were wrong on the headers windows and the doors. Layout was incomplete. Two other members started house next door.

9:15 foreman gave us our checks and at the same time two other carpenter members had their checks. Mr. Mansfield, Financial Secretary, Mr. Kirkwood Business Representative, Mr. Kolder, our President of our Local. Mr Mansfield said, “Some thing must be done about this”, “He said meet him out at the Walter Sholtz Job, when we arrived Mr Mansfield, Mr. Kirkwood, and Mr. Kolder, the foreman and the rest of us met two of the suprtintendents for Walter Sholtz.

The foreman told why he had laid us off he said, “That he was not runing a school”, “ I told him when you lay four men off in less then an hour when you were not even here you had to start writing these checks as we were laying out the cords at 8:15. It takes about 15 mimutes to write out the checks and to be laid off in 30 ninutes was not right. I also informed all of them that to clean up these mistakes would take a couple of hours, the ones laying out this house needed schooling.

The foreman and the two superintendents ask us to go back to work, I informed Brother Mansfield, we would not last a day or if we did second day we would get layoff checks. The Foreman for Walter Sholtz, did lay us off the second day, after saying you do this house for the sum of $85.00, I said, $120.00, he said would go for $95.00. This was March the 30-66.

What could get a man into this mess???

Mr. Kirkwood was being blamed for what was going on I did not Blame him or any other member of our Local. A fight over this at the Union Meeting came to a head by one of these misguided members, he picked a steel chair, to keep this on an even keel I also picked a steel chair. I lost and was on the floor when this so called chair came to a halt about a quarter of an inch from my nose, this old boy said, “I am trying to kill you”, I said you got that right”. We met at a bar the next night I said, “lets go out side”, He said , “Let’s talk we both said liked Mr. Kirkwood”. He said, “would not come to another Meeting”. He kept his word.

We wish to call to your attention that a dispute exists between Carpenters Local Union 1062 And Walter Scholtz Building Corporation , a member of the Home Builders Association.

The dispute involves alleged violations of Article 11, Paragraph 207, and Article 1V, Paragraphs 405,406 and 408. Walter Scholtz Building corporation during the period of March 28, 1966 through April 22, 1966, On their building project located on stork road in Goleta, California and known as University Village, consistently discharges carpenters referred to them in complice with Article 11 of the Collective Bargaining Agreement because they refused to work lump work or piece work.

We are requesting that if the company is found quietly of these alleged violations that the Joint Adjustment Board assess penalties in accordance with Article 1V Paragraph 408.

Violation of Section 55 (1) - Causing dissension among the members of the United Brotherhood. COMES DOWN TO ME MAKING MISSTATEMENTS OF FACTS CONCERNING THE AFORE MENTION DISPUTE. The facts that were stated by me were all true period . Violation of Section 55,A (5) - Willful slander or libel of any officer and any member of the United Brotherhood. I did not at any time slander the ones who should have stood up for the members. I DID FORCE THE UNION TO DO THEIR JOB THEY TOLD ME NO ONE WOULD SHOW UP I SAID, “WILL GET THE MEMBERS TO FILE CHARGES AND WE WOULD SHOW UP”. WE ALL SHOWED UP AT THE HEARING IN Los Angeles and we all testified period.

The KICKER: Violation of Section 55.A (13) - Violating the Obligation. BEAT ON THIS ONE BY A TRICK PULLED THE NIGHT I WAS TO BE TRIED BEFORE THE MEMBERS. Mr. Mansfield said, he could not be at this meeting, did not notify me of this till the night of said meeting . I could have beat this rap the members would not have found me Guilty that night.

I attend this meeting and was sandbag by Brother Mansfield, not showing because he was the one who was putting these charges against me. To those who do not know they have to let the members try you, on this date of Tuesday July 19 1996 at 7:00 PM. Easy as 1 t o 3, on this night members were showing up that never came to a UNION MEETING AND THEY THREW OUT EVER CHARGE THAT HAD BEEN THROWEN AGAINST THEM. (ONE ON ME}.

August the 11, 1996 fined the sum of $100.00. Paid said fine. INTERESTING TO NOTE ALL OF US SHOWED UP IN LOS ANGELES WITH MR. ROBERT FELTT, OUR BUISNESS AGENT TO PROTECT OUR RIGHTS AS MEMBERS OF CARPENTERS LOCAL UNION #1062. OFFICERS SAID, “NOT ONE MEMBER WOULD SHOW UP, ONLY ONE MEMBER WHO SAID, “I WILL NOT SHOW UP BECAUSE THEY JUST GAVE HIM A WORKING OVER A FEW MONTHS BACK, HE STILL HAD SOME SAND LEFT HE FILED THE CHARGES, IN MY BOOK THAT WHATS COUNT.

The adopted rules, set up by these Board of Trustees of all our carpenter pension plans, is not in the best interest of all of the participants and all of the beneficiaries of our pension plans, and is detrimental and also unfair. Very unfair to many of the participants who performed work in in these different time frames. Throughout the years up to this date 2-18-20.

The Board of Trustees, as fiduciaries, has the obligation to protect plan assets and provid benefits to meet the needs and the exceptions of all of the participants. By commitment to all the participants of 42-L, the Board of Trustees of their pension plan has followed their pension plan has followed their fiduciary duties: “SLOELY IN THE INTEREST OF THE PARTICIPANTS AND BENEFICIARIES, AND IN ACCORDANCE WITH ALL OF THE DOCUMENTS AND INSTRUMENTS GOVERNING THE PLAN”.

LOCAL 42-L SAVED ALL THEIR ASSETS, THEY RASISED THE SUM OF $20,000 BY THEIR MEMBERS. AT A LATTER DATE ALL OF THE TRUSTEES WERE PUT OUT TO PASTURE AND OTHERS TOOK OVER. CHANGES MADE BY THE TAKE OVER YES YES.

The Board of Trustees fail in their fiduciary duties in not giving the monthly amount of retirement income payable on account of an EMPLOYEE’S PAST SERVICE CREDIT THAT SHOULD BE DETERMIND BY THE TRUSTEES, ON YHE BASIS OF A VALIED CURRENT ACTUARIAL EVALUATION PROVIDED THAT ALL EMPLOYEES IN A SIMLER CIRCUMSTANCES ARE TREATED IN A SIMALER MANNER.

TYPICAL OF THESE ADOPED RULES FUTURE SERVICE CREDIT SHOULD ALSO BE COUNTED THE SAME, AND SHOULD APPLY AS STATED BEFORE THE CHANGES WERE MADE IN THE DIFFERENT TIME FRAMES.

“COMPENSATION”, means all earnings and any other taxable compensation received for a year, month or day from any EMPLOYER, or from any company in an Employer’s group or affiliated service group with in the neaning of sections 414 (b), (c) or (m) of the Interal Revenue Code. Other Codes also may apply as an Example: section 415 (e) of the Internel Revenue Code.

It should be applied as if all the EMPLOYERS were a singal Employer, with out Distinguishing among them as to the source of a PARTICIPANT’S BENEFITS, AND CONTRIBUTIONS, EARNINGS OR SERVICE.
