Mansfield, my and our Financial Secretary of Carpenters Local Union #1062, in Santa Barbara, California, Military counted same as Social Security, told this same story by Officials of the Carpenters International Union.

What a WEB, these unfair persons CAN come up with for allowing some participants to receive benefits due them and denying others under these same circumstances not to receive pension credits due them.

Now to reveal how some of these kickers come in through the cracks that the GOVERNMENT lets Happen to all of us when we are supposed to have their protection, as some of you are going to find out you have no protection at all, in the year 2000. How can these Union Officials and the Trustees of your BENEFIT PLANS get away with all of this fraud and corruption. They all get together and pull what you are about to see in these records that the (CENTER), is going to produce from their own records. Was it necessary that a person be a member of a Carpenters Local Union prior to the establishment of the carpenters Pension Trust Fund for Southern California 1959 in order that person could receive past service credit toward his eventual pension benefit? If so were there ANY EXCEPTIONS WHATSOEVER?

Did the CSCAC make any effort to assist Mr. Scott in obtaining any possible record information which might then, in 1959, have been available from Gladding McBean. I Elvin F. Scott, can testify in year 1959, and almost ever year to year of 2000, I have tried to have the Trusts and all of the Subordinate Bodies of the Brotherhood of Carpenters in the State of California, help me bring up my Military Time. Refused every Time. Plus having the Carpenters Pension Manager in Southern California, tell my witness not to help me in any way, if called into the court room he under stood the truth would be told by him. Year 1989.

***Told by one of the secretaries a Ms. Cerices, who informed me, on date of 3-24-78, she had orders not to accept my Military papers or any other information about my work history. I explained that since the year 1959 tried to have my MILITARY and WORK HISTORY put in order. I was denied time after time through these years, was told not until you retire can you bring your pension up to date. I was teed off demanded to see the Manager of the CARPENTERS PENSION TRUST FUND.

Mr. Roger Lopez, MANAGER of the CARPENTERS PENSION TRUST FUND PLAN, in Southern California on date of 3-24-78, refused to take my MILITARY PAPERS as well as any of my work history , "By saying you have 141/2 years for PAST SERVICE AND FOR FUTURE SERVICE PERIOD. I explained the Trust had never seen my discharge papers.

How could he refuse to take MY MILITARY AND WORK HISTORY. Mr. Roger Lopez, is the same man who threatened my witness in year 1989. Mr. Roger Lopez is the same OLD BOY, who said, "You do not deserve any MILITERY TIME on date of 3-24-78, as others had received Military TIME and they did not deserve it.

This GOOD OLD BOY, Mr. Roger Lopez, also said "You do not deserve your OVERSEAS TIME which was five years". I asked why? Mr. LOPEZ, then stated to me, "you worked all year round for those five years other MEMBERS ONLY WORKED HALF A YEAR". Our MANAGER FORGOT TO SAY ALL OF OUR OFFICIALS WORKED ALL YEAR ROUND AND GOT ALL OF THEIR PENSION CREDITS PLUS THOUSANDS OF CARPENTERS ALL THROUGH THE UNITED STATES RECEIVED FULL CREDIT FOR FULL YEARS WORK, ALSO SAME IN THE STATE OF CALIFORNIA.

I informed Mr. Lopez, that the guard was not going to save him it was two floors down And he was going to be on the bottom.

I also said, "That the date had better be on my Social Security Papers". (3-24-78) Mr, Roger Lopez, last words to me, HE STATED, "it would be over his dead body before I received any MILITARY PENSION CREDIT FOR MY SERVICE TIME

Believe ME, at this TIME I DID NOT UNDERSTAND MR. ROGER LOPEZ PLUS OTHERS WERE GOING TO SEE TO IT I LOST ABOUT HALF OF MY PENSION CREDITS. And was also going to see to it I would loose my SERVICE PENSION. 04-27-1998, CLAIM FOLDER LOCATION FLD DESTROYD

GUARDING THE FOURTH INTERCEPTER COMAND IN BURBANK, CALIFORNIA Used the BAYONET in teaching my fellow guards men a lesson not to tell me, "they were going to run right over me, that I would not shoot them, you only have three rounds" BIG MISTAKE, "I informed them there was a hole down the way go out there, I am guarding this front GATE and not one of you are going through it". I further stated, "Three of you are going to be limping and the rest of you are going to be running as these bayonet is going to work. I had some help from the Captain of the Guard who said he was an expert BAYONET. No one ever tried to get past me again, of course they had good reasons. AS YOU WILL SEE.

In your letter of September 18 1985 to Mr. Scott, you state at paragraph 2 that, "AFFIDAVITS from individuals are not accepted as proof of employment for the purpose establishing pension credit under the Trust". As you read on what they do except is ways to cheat you period. In the guard I had reason to use the BAYONET, I learned that putting it on the rifle and telling people or persons I can't miss at this range be sure that this BAYONET will not miss.

Also by firing a few rounds here and there your own men will come up and asked before they Go through your guard area, as will others even when they had the right to do so, or thought they Had the Right because of their RANK. Will put in a tid bit now and then. Dear Ms. Barkinge:

Our last contact with the Carpenters Southern California administrative corporation (CSCAC) was by a letter dated July 8, 1986 at which time we advised you that Mr. Scott had withdrawn his Veterans' Reemployment Rights (VRR) claim, but that event did not prevent him from again opening a claim at a subsequent date. Re: California Pension Plan/Colonel Bowen

To Whom It May Concern:

I Frank Silva during the years 1984 through 1990 was Financial Secretary Treasure for the Lathers Local 42-L in Los Angeles, California. I was also Trustee in the California Pension Plan, representing the members of the now defunct Local 42-A in Los Angeles.

Local 42-A was a housing nail-on local that merged with Local 42, which was an iron local in the year sixties. The California Pension Plan was comprised of five locals, which were Los Angeles, Pasadena, Santa Ana, San Bernardino, and Palm Springs. The members of 42-A were provided with the option of drawing their money out of the fund in one lump sum or leaving their money in the fund. The trustees of the California Pension Plan as I understood at the time where to invest the money and at one time earned as much as 16% or possibly even more interest on the money.

A number of years have gone by and quite a few of the members of the California Pension Plan were not located. In addition no effort was made to locate these previous members. I personally made a motion at a trustee meeting to locate these members however the motion was not seconded.

One of the members Colonel Bowen, decided to draw out his money and according to Colonel Bowen a check was mailed to Colonel Bowen. Mr. Bowen refused the check on the basis that it was made out for the wrong amount. The check was considerably less than what he had coming. The check was never cashed and according to Mr. Bowen the check had been returned to the California Pension Trust. I told the trustees that we should send him another application and attempt to resolve the issue. Mr. Eugene Miller the Trust Attorney stated, "Let him come to the office and pick up an application, or let him SUE US!

I was told by the trust Administration that Mr. Bowens' money was in a Non-Interest Account…Even a checking account draws interest. It is a trustee's responsibility to invest pension funds in a prudent manner. To my knowledge, I don't believe this was done. Colonel Bowen should be paid his money plus what monetary gain the plan has INCURRED. The trustees want to pay Mr. Bowen the amount they had previously offered many years ago. These funds belong to the past 42-A members and have been invested in the Pension Fund and are not in a dormant account but an interest bearing account.

Scotty, I certainly hope this deposition will assist you in your case.

I Col L. Bowen, certify that this is my deposition of true facts against the Lathing Institute And the Carpenters Union Lathers Local 42A, 42L, and 440L Lathers and Trust officers: Jack White 440L, John Huff 440L, at Box 6468 Santa Ana CA 92706. Also the United Brotherhood-Carpenters listed in John Does 1-50.

Therefore I hereby file charges of fraud against the Union Trustees of misusing the Trust. I made application for my Trust money which was held by Trust over 40 years.

Two years have passed since Tom Domford the International Representative, told me that Jack White (A Trust Representative) took 1/3 of my $6,600 plus, and never invested the money, which is over 40 years initially due to me plus interest.

Therefore I ask the Department of Fraud to indite them and force them to court to pay me my money

I would also like to ask and pray that the Federal Court will look into this matter as a Fraud And Civil Rights Violation.

Since the inception of the Southern California IBEW-NECA Pension Trust the administrators and Trustees have loaded the plan with overpaid shyster law firms and with unnecessary consultants, advisors, co-trustees, investment managers and real estate managers. This is at a cost of millions of dollars that rightfully be longs to the legal participants and to their widows.

If we complained about theft and kickback scheme, we were threatened with court action by the shyster attorneys. Very few of the members of this plan can afford a costly lawsuit. The shysters are paid with our trust money and should be representing the rank and file participants.

Can your office halt this theft of our trust funds? A reply will be greatly appreciated.

During the construction of the Alaskan pipeline there were hundreds, perhaps thousands, IBEW Travelers working there. The contractors put over three dollars per hour into the IBEW Local Union No. 1547 Pension Plan for each hour each Traveler worked.

Very few Travelers, if any, ever collected pension benefits from the Local 1547 Pension Plan. Have you or your clone and trained rat, Edwin D. Hill, ever made any effort to collect pension benefits for these members?

If you two phonies were serious about protecting our pensions you would see to it that we had immediate vesting and full portability of our pension benefits.

LAWSUIT ALLEGES MISHANDLING OF PENSION FUNDS Three retired Carpenters Union members have filed a lawsuit in federal court alleging that the trustees and a prominent financial advisor to their unions nearly $2 billion. Southern California pension fund have engaged in improper self-dealing" by investing pension money in businesses in which they have "direct and substantial" financial interests.

It is interesting to note I have brought this up to every ones attention over the years. I have also brought up that Mr. Ricardered C. Blum Inc. received the sum of $7,788,567 for The year 1997, SCHEDULE C (FORM -5500). Also put out to all the years 90, 91, 92,94,95, 96. 93 has evaded me up to this date of 2-1-00. (TID BET)

Other defendants in the complex case filed in Los Angeles include Douglas McCarron, president of the United Brotherhood of Carpenters and Joiners of America, and all of the trustees of the Southern California pension fund as well as a separate $500-million pension fund for union officials, the United Brotherhood of Carpenters fund.

The three retired carpenters Horacio Grana, Phillip R. Helsius, and Walter J. Sprenger, contend that the "breaches of fiduciary duty and self-dealing alleged… Are so egregious" that a federal judge should order the removal of the trustees and Blum as the pension funds' investment advisor. The plaintiffs also seek an injunction barring the trustees and the financial advisor from taking any action with respect to pension assets.

The three who have filed these law suits , one Mr. Walter J. Springer, who offered me a thousand dollars in 1987, the first day we met at the retirees CLUB. To go out and put a stop to the discrimination, Walter Scholtz was doing to Local Union 1062 members. R. W. Mansfield who was Financial Secretary and Business Agent of Local 1062 and a Trustee of the California Trust told me in his office we had to put a stop to this discrimination, so older workers could enjoy their full pension and health benefits in the years to come.

Also a matter of record, that Brother Harold C. Brandt as a member of Local Union 1062 was dispatched by Business Representative Robert Flett on a work referral dated 4-4-66. Also it is A matter of record, that Brother Harold C. Brandt in his January 30, 1985, To Whom It May Concern, that he was dispatched to Walter Scholtz in April of 1966, also in his Declaration dated April 29, 1985 that he was acquainted with Elvin F. Scott since April 1966 Walter Scholtz job.

Also it is a matter of record , that I Elvin F. Scott preferred a complaint against Walter Scholtz Building Corporation. At the time of my employment as a Carpenter dispatched on a work referral by Robert Flett, dated March 28, 1966. Second time dated April 5, 1966. I filed charges on April 23, 1966, with Local 1062 separately from other Brothers of Local 1062. Other Brothers of Local 1062 at this time filed charges separately, Harlod C. Brandt, J. A. Hays, Raymond E. Cox, Neal Crispin. They all tried to cover UP my work HISTORY up to the year 2000.

Scott Employer No. 177202 Deposit No 9796 Date Deposited 4-12-66 work period 3/66 hours reported 16.00, and also Deposit No 0196 work period 4/66 hours 2.00, showing same time frame as my vacation statement, and same time as my two check stubs and in same time as my Social Security Earnings for year 1966. All a matter of record. (Keep in mine 25 years and out SERVICE PENSION)

From 4-10-66 To 6-5-66, I Elvin F. Scott was job Steward for Margate. Harold C. Brandt, a member of Local Union 1062, testified he and I worked together in April 1966 for Margate and in Brother Brandts To Whom It May Concern, dated 1-30-85, stated That I Elvin F. Scott had served as job Steward on jobsite for Margate. Harold C. Brandt in his April 29-1985 Declaration he also says the same. All of the above is a matter of record.
