AARP February 2001…New bill highlights retiree benefit issue By Trish Nicholson. Rep. John F. Tierney, D-Mass, thinks he has the answer to retirees' worst nightmare. He plans to introduce a bill this month to keep companies from slashing medical benefits for former workers after they retired. Tierney, who serves on the Committee on Education and the Workforce, wants to amend the Employee Retirement Income Security Act of 1974. Dear Mr. Scott: I have been asked by the Army Board for Correction of Military Records to reply to your request for correction of your Army records.

I have also been asked to assure you that it was only after the Board had determined that no error or injustice existed and that your application should be denied that it considered the statute of limitations. Had the Board found your case meritorious it would have excused the failure to timely file. The Board has never rejected an application simply because of a failure to apply within the time prescribed.

In the absence of new evidence showing that it would be in the interest of justice to excuse your failure to timely file, further consideration by the Board is not appropriate. A copy of The Memorandum of Consideration stating the Board's reasons for denial is enclosed.

At this time EVIDENCE OF RECORD: The applicant's reconstructed military records show: He enlisted on 11 December 1942 and was honorably discharged on November 1945.. THE PUBLIC AS MONGOOSES, ALL HAVE A CHANCE TO GET A PIECE OF THE ACTION IN THIS YEAR 2001 FOR ALL RETIREES.

I was met by the new superintendent who informed me, he had two plants that need repairing. First minute on this job I told him full wages, he said, " would pay me same as his best men". I said, "OK". Paid before and after Army service top pay. (Trust used this letter against me, saying I worked as a Kiln Placer) They had no classification in this time frame for a carpenter maintenance man, paid me 85 cents a hour before Army and $1 dollar an hour after the Army. I never gave the Sargent any number for Kiln Placer. DID NOT KNOW SAID NO.

CARPENTERS SOUTHERN CALIFORNIA ADMINISTRATIVE CORPORATION February 21, 1985 Eye of the "BEHOLDER"

Mr. Scott was denied Past Service Credits, for military service as there is no evidence that he was employed as a carpenter (or in Covered Employment) prior to his military service. Mr. Scott has appeared before the Trust's Appeals Committee on at least two occasions accompanied by legal council, and represented in testimony that he was hard by Gladding McBean as a Kiln Placer for almost 2 or 3 months before going into the Army. This is not a job classification recognized as Covered Employment by this plan. In addition, the military discharge documents presented to the trust by Mr. Scott states the civilian occupation as Kiln Placer 6-66,623. "NO WAY"……… "Much can transpire when fabricated by folks"

"It is the constant, and determined effort that breaks down resistance and sweeps away all obstacles" . Army Sargent said, "he had a hot date would it be ok if he made my papers out next day", OK by me. He did not put my C. C. C. time for #912 and 2926 which was six months in Related Trades of the Carpenters, and he did not put my time in for the "CALIFORNIA STATE GUARD" which was ten months, I had a rifle on my shoulder at 10 a.m. December 7. 1941 at 11:a.m. I had a broom on my shoulder guarding the State Guards Armory in Van Nuys, CA.

Also guarded the Seventh Interceptor Command at the Burbank Airport in CA about six months, interesting.

I Elvin F. Scott, believe records to be in error or unjust in all of the following updated particulars. Plus: See the new explanation's as to the date year 2001.

I never said, " to any of these Trustee's, or anyone that I was hired by Gladding McBean for 2 or 3 months as a Kiln Placer". I have said, " was hired as a Kiln Placer by the girl in the office" The new supper hired me by saying as I walked up to the Foreman, " This man is mine he is my carpenter maintenance man. This I have repeated hundreds of times through the years.

Following discharge, Mr. Scott claims that he worked about 20 days for Gladding McBean as a carpenter. Since Mr. Scott was not working in Covered Employment before his military service, the Pension Plan provisions do not allow for credit for military service time. For some yes, yes.

True about 20 days: UNION OUT, would only pay ONE DOLLAR AN HOUR, I went out for better wages, was receiving ONE DOLLAR AND THIRTY CENTS IN 1946, in RELATED TRADES OF THE CARPENTER'S in SOUTHERN CALIFORNIA INTERESTING. I was making 5 cents more then the best men working for this company, these RELATED TRADES OF THE CARPENTERS HAD THE EMPLOYER'S TAKE OUR UNION DUES OUT OF OUR PAY CHECKS BEFORE WE WERE ALLOWED TO START WORK WE HAD TO SIGN A POWER of ATTORNY PERIOD IN THIS TIME FRAME YEAR 1946 foreword PAST SERVICE. Keep in Mine 25 years and out. WEB-SITE: www.Battlefieldpensions.com "MILITARY"

To WHOM IT MAY CONCERN: Thomas R. Sain, For the following year and years: I Thomas R. Sain, wish to verify and can testify that he and I worked for the firm of Gladding McBean and Co., in the year of 1948. We worked for the firm of Los Angeles Period, in the year of 1946, where we helped to install a Related Union of our United Brotherhood in Southern California. Brother Scott also worked for the firm of Pacific Trailer in the year of 1946-1947.

Also in these same time frames we both worked for the firm of Columbia Trailer in the year of 1947, in Glendale California. IN THESE TIME FRAMES OF THE YEAR AND YEARS OF 1946, 1947 AND 1948, OUR UNION DUES WERE PAID BY OUR EMPLOYER AND/OR EMPLOYERS OUT OF OUR PAY CHECKS EACH MONTH, TO OUR UNION AND/OR UNIONS OF OUR BROTHERHOOD OF CARPENTERS REALATED PLAN AND/OR PLANS, IN THE SOUTHERN CALIFORNIA AREA. Brother Scott has shown me a copy of Mr. John G. Dunkle's declaration which was executed on August 30, 1985, in which he states. On one occasion in the latter part of the year 1942, I accompanied Mr. Scott to another of Gladding McBeans and Co., plants and observed him repairing windows and screens at that Plant. "PBGC search locates missing pensioners"

Sent letter dated November the 6, 1980 to Office of Veteran's Reemployment Rights, LMSA, United States Department of Labor, Washington D. C. 20216 U.S. Department of Labor Letter dated Jan 9 1981, Elvin F. Scott Re: Veteran's Reemployment Rights: Dear Mr. Scott: As we discussed in our telephone conversation of January 2, 1981, it is now premature for you to file a claim for pension benefits based upon your military service time. Charla J. Low, Investigator Will ASKED FOR A HEARING ON THIS FOR NOT ONLY ME, but all others who have been placed or forced into this mess of Military PENSION TIME 2001.

Letter dated 11-May 90 DEPARTMENT OF THE ARMY: Due to the passage of Public Law 95-126 on 8 October 1997, the application which you summated on DD Form 149 is returned. One of the features contained in this new law was to remove the 15 year limitation in applying to the Army Discharge Review Board (ADRB) for an upgrade of discharge, if the application was received By January 1980. Requirement's put in place by all is unjust when only a few month's stand between my request for correction of my Army records year 2001. Keep in mine Carpenter's Southern CA took a percentage out to pay for PAST SERVICE CREDIT.

We all should be looking at the Fiduciary Irresponsibility of the Trust Officials of the Carpenter's Union Southern and Northern California as well as OTHER'S in year 2001. Examples, Regulations and Changes and/or Rules and the Modifications that were being made by Carpenter Pension Trustee's.

A Veteran, on his Military time, could not get his full pension credits due him.
