AS YOU ARE READING AND LOOKING AT THIS MATERIAL I WILL IN DIFFERENT TIME SLOTS, ADD OR PLACE SOME FACT OR FACTS SO YOU AS A READER WILL HAVE A BETTER UNDER STANDING AS THE PUBLIC.

TO WHOM IT MAY CONCERN: APRIAL 5-1991 MADS J. MUNK,

I Mads J. Munk, went to work as a Carpenter Business Agent in 1958, at that time I was told to tell the carpenter members their working hours would be treated the same as Social Security hours.

(THE SOUTHERN CALIFORNIA APPEALS COMMITTEE DID NOT DO THIS PERIOD).

TiD;;;;;;; BiT,,,,,,,,, I FROM MY FIRST CHECK OR CHECKS FROM YEAR 1984, AND THIS INCLUDES RAISES IN PENSION AND ALL OF THE SO CALLED13 CHECKS FROM BOTH OF THESE TRUSTS OF THE CARPENTERS PENSION IN THE STATE OF CALIFORNIA.

I SIGN ALL THESE CHEKS ((((PARTIAL PAYMENT, OR WORDS TO THAT EFFECT. )))))

THIS WAS AND IS BEING DONE TO SHOW ALLOF THE PUBLIC, I KNEW FROM THE START WHAT THEY AS TRUSTEES WERE DOING. I LOOK AT IT IN THIS WAY OR FASHION, A JURY, JUDGE, COURT ROOM OR ANY ONE LOOKING AT THIS WOULD VOTE IN MY FAVOR.

WOULD LIKE TO HEAR FROM ALL OF YOU THE PUBLIC, IF I AM IN THE RIGHT IN MY THINKING. The year 1960 the members were told they would have to acquire a minimum of 200 hours in a 90 day period-Jan-Feb-March-April-May-June-July-Aug-Sept-Oct-Nov-Dec.

Point : Another way to do you out of your pension:

I asked the Trust Office-why the cancellation?

If you have you had less than 200 hours why you could not pay the difference-plus what expense to add to your hours of delinquency-I then brought this up a number of times which caused a lot of discrepancy. Before the next election their were (2) international men 1 from Northern California and one from Southern California came to Santa Maria-they had the Union books locked up-They called a special called meeting to have me removed from office-They had false charges against me I was fined $150.00 with my book removed- I called the Union Lawyer paid $150.00 for a new book (Plus Dues). Two men went out in the field told the members to be sure and vote me out of office the next election. Which they did June 4th 1965, after serving 7 years.

I declare this to be true in all respects, Mads J. Munk.

Notary Public year April 5, 1991 THIS IS ONE OF THE DIRTY TRICKS: THERE ARE MORE: I CALLED FRANK WARD (UNION LAWYER, I WAS REINSTATED JUNE 27, 1962. I HAVE MORE FROM Mr. MUNK. SAVE IT FOR THE COURT ROOM.

TiD-BiT: DUE TO A FEDERAL LAW WITH THE ACRONYM HIPPA(HEALTH INSURANCE PORTABILITY ANDACCOUNTABILTY ACT) YOU MAY BE ELIGIBLE ((TO REENROLL IN THE CARPENTERS PLAN.

I BELIEVE NOT TO MANY OF YOU CARPENTERS HAVE EVEN HEARD OF THIS ACT, I HAD A NEW WIFE AND USED THIS IN NORTHERN CALIFORNIA SHE NOW HAS INSURANCE COVERED BY THE CARPENTERS.

MY POINT:::: WHAT ABOUT ALL OF THE OTHERS WHO ALSO DO NOT KNOW ABOUT THIS LAW. CHECK IT OUT.

LETTERS WERE SENT BY MY LOCAL UNION #2046, BEFORE 1984, AND AFTER 1984, I ALSO SENT LETTERS AND OTHER LOCALS ALSO SENT LETTERS.

WILL AS WE GO ALONG GIVE YOU AN INSIGHT TO WHAT AND HOW THESE LETTERS WERE ANSWERED.

CARPENTERS NATIONAL RANK AND FILE CONFERENCE

Sponsored by Carpenters for a Democratic Union and the Association for Union Democracy. 617-267-7798 cd@cdu2.com

AUD is a national non-profit organization which promotes union democracy for a strong labor movement.

AUD helps union members defend their rights within the union by providing legal referrals, education and organizing support. 718-855-6650 www.uniondemocracy.com These are just the start of the HORENT’S, that the CENTER, is going to ask to join the NEST, as we are going to ask all of the PUBLIC to come JOIN THE NEST.

MORE ON THE BOSTON, MA MARCH THE 3rd & 4th meetings at, Mass. College of Art, Huntington avenue NEW YORK CITY April 7,8,9 we would also welcome all of these HORNET’S to the NEST.

The CENTER, on date of March 1st 2000, went to the Commonwealth Club, to hear what Mr. John Sweeney, President of the A. F. L-C. I. O. had to say. The CENTER, ask that Mr. Sweeny, be given the material that was on its Web-Site the latest being the HORNETS NEST. Met some interesting people two who were in the BUS Drivers Union, until they were informed when they went in to check their benefits, they did not belong to said union. One of them said, “I have been paying dues to this union for four and a half years”. He was informed, “ That it does show you paid in for the last four and a half years, you still do not belong to this union.” Investigating further the found out about half of their members were also in the same boat. They brought this to not only the CENTER, but to Mr. Sweeney, who said, “would look into this for them.”

These two are now HORNET’S, plus some STEELWORKERS who said “ we are HORNET’S as we shook hands on I t”. The CENTER WAS ALSO NOTIFIED ON THIS DATE THAT A PRODUCER SAID, “We do some follow up on your last TV show, plus three half hour shows and then a one hour special.” I know you want to have six or eight shows in the can before you start you own, I said, “YOU BET”. I was making copies and a man came up said, “We had a round table and as an example we would put say 27 names for benefits ON table, pick two and throw away the list”. I did not ask if they had already taken care of their friends. I gave him about fifty pages of what the (CENTER),, had on their WEB-PAGE, plus 12 pages not on the WEB.

I Elvin F. Scott, now ask THIS QUESTION, “DID THEY TAKE CARE OF THEIR FRIENDS BEFORE THEY TOSSED THE LIST AWAY?”

Latest Update Wednesday, March 01, 2000 15:14:12-0500 http://www.unionplainfacts.com/ McCarron has broken BC law. So says BC Labor Relations Board ruling that deals a major blow to I international restructuring plans in BC. The February 17, 2000 ruling demands natural justice for union members and membership ratification votes for local mergers. BC Carpenters Union members have already stopped restructuring dead in their tracks with their powerful protests and persistent resistance. This decision only confirms that McCarron is not above the BC. Law.

A little TiD---BiT: These UNION”S were taken over by Brother McCarron, and these Officials who were going to use their resources to fight this corruption, were all fired. Point: Interesting we had meetings out of town and before we could get out the door one of us had spilled the beans.

To Whom This May Concern:

RE: CARPENTERS PENSION

Elvin F. Scott,

Dear Sirs:

This letter is to update that the below listed Local Unions are very much interested in seeing Brother Scott, receive his Pension Credits due to him.

There has been so much corruption in the Carpenters Trust Funds, that we know, the only way it is going to be cleaned up, is if the Department of Labor gets involved. If there is any further assistance needed, feel free to call upon us at any time. THE CENTER CALLS ON ALL OF THE PUBLIC NOT JUST THE CARPENTERS AND LATHERS OR RELATED TRADES, PLUS THE DEPARTMENT OF LABOR TO JOIN IN THIS CLEAN UP. .LOCAL UNIONS DESTROYED: #1052, #42-L, #1752,# 769,#1478, OTHER UNIONS EFFECTED BY #1062, #944,#2477, AND AT A LATTER DATE CARPENTERS LOCAL UNION #25, AND OF COURSE MANY OTHERS. TiD-BiT : FOR 10 YEARS THEY COULD NOT SET FOOT IN CARPENTERS LOCAL #25, COURT ORDER. More at a latter date.

This is one of the cover ups that the UNIONS AND THE TRUSTS TRIED TO COVER UP I AM GOING TO GIVE YOU THE LOW DOWN OF WHY LEADERS OF THE CARPENTERS AND THESE TRUST FUND PLANS ROBED, SWENDLED USED THIS FRAUD AGAINST THE MEMBERS AND THEIR FAMILIES. CARPENTER UNIONS ARE SUBORDINATE BODIES OF THE INTERNATIONAL UNION:

TiD-BiT: INTERNATIONAL SAY’S THE TRUSTS ARE SEPARATE AND WE CAN NOT INTERFEAR: THESE UNION’S ARE NOT SEPARATE THEY ALL COME UNDER THE INTERNATIONAL, WHO ARE RESPONSIBLE FOR THEM PERIOD: THEY ARE ALSO RESPONSIBLE FOR THE ACTIONS OF THEIR MEMBERS AND ALL OF THE OFFICIALS OF THEIR SUBORDINATE BODIES :

THEIR OFFICIALS SENT MEN AND/OR WOMEN OUT TO THESE JOB SITES EXPLAINING TO US THAT OUR BEBEFITS WOULD BE THEIR FOR US, I CAN NAME LOCALS WHO PULLED THIS NOT ONLY ON ME, Elvin F. Scott, but other members as well, will give you TWO examples: CARPENTERS LOCAL UNION #1062, OFFICIALS TOLD ME, IN YEAR 1968, AS A CARPENTER MEMBER IN SOUTHERN CALIFORNIA, MY PENSION CREDITS WOULD COUNT FOR SOUTHERN CALIFORNIA, PENSION CREDITS. FROM NORTHERN CALIFORNIA.

NORTHERN CALIFORNIA CARPENTERS LOCAL IN TAHOE SAID, “YOUR WORK IN NEVADA COUNTS FOR CALIFORNIA PENSION CREDITS AND THEY SENT ME, AND ALL OF THE OTHER CARPENTERS OF THIS LOCAL OUT TO THESE JOB SITES, FOR OUR WAGES AND BENEFITS. CARPENTERS LOCAL UNION #1062, OFFICERS TOLD OTHER MEMBERS THEIR PENSION CREDITS COUNTED AS SOUTHERN CALIFORNIA PENSION CREDITS PERIOD. WHEN THEY WERE IN STATE AND OUT OF STATE. I HAVE SOME DOCUMENTS THAT I CAN PROUDUCE IN A COURT ROOM, IN YEAR 2000. THIS COST THE BROTHERHOOD MEMBERS AND THEIR FAMILIES A BUNDLE UP TO 2000. McCain slated for DVC rally, 3-5-20,passed out copies of the HORNET NEST, We need all the HORNET’S we can get in year, in the year 2000.

My Dearest Senator, Diane Feinstein, I am writing you from Orange County and as you are aware we are not a little country any more. In fact Broardcom lists 500 of its employers as millionaires and I am sure that you can tell me more about us than I can.

The point I would like to make is that when we were a lot smaller we had eight carpenter halls and today they are gone. We do have a drywall local in Orange and that is where this story begins. To hold your attention I want you to know that your husband is deeply involved and I hope that you will read on. Labor supports you and I personally love the fact that we have not one but two women senators. I believe they are more honest than men. I’m sure you have heard the famous Thomas Jefferson quote “If all men were honest we would not need a raises. The average pension check is $500.00 and if you compare it to a cost of living index with our Social Security you will find a $500.00 Social Security check has risen to $775.00. They are making us government.” That also should pertain to unions especially since they are handling billions in pension money. It so happens that your husband makes more money from our pension than any one else that we know of. Our pension is being run wrong by having five active carpenters continually vote themselves raises and through peanuts to the retired carpenters. What they have done to us is reduce our standard of living by not giving us second class citizens by reducing our original pension in half.

As Democrats {and my daughter and I were delegates to the last convention in Sacramento} we stand for anything that benefits mankind and that I always thought is what unionism was also all about. What you can do for the 16,500 retired carpenters in Southern California is ask your husband if they are being fair with us or not. He has heard their side only. we are nothing to them not even the Labor Department has done anything for us and they know our story. We realize that there is nothing in the rules that says they owe us a cost of living. However when five active officers vote on it and we always come out losers there is something wrong. Ask your husband to see our side of it!

1. Who put the money in to start the pension?

2. When Douglas McCarron took over we gave him $900,000,000 to work with.

3. We were paying in $2.62 an hour, $104.80 a week.

4. We were funding half the pay roll for the retirees then.

5. We could only get $40.00 credit for 1800 hours of work - that would be a Maximum of $40.00 for10 years.

6. They voted to reduce what they pay in to $1.01.

7. The total work hours produced only $16,000,000.

8. They escalated the $40.00 to $200.00.

9. It took us 10 years to make $400.00. Now they can make $480.00 in one year.

Senator Feinstein, please ask your husband to come to our aid! The rest of the country is being fair to their retired people and it would only take someone like him to just say to Mr. McCarron. “You are the President of the Carpenters Union and you actually cast the tie breaking vote to not give the retires a raise and every time you had the chance. Don’t you think it would be ethical if you give up control of the 2 billion Dollar pension fund. The ethical purpose of any pension is just to make the payroll and thank God you are not running Social Security or we old people would be hurting.

Here is an example of the letter that it would take for him to see the light:

Dear Mr. McCarron, My name is included in the carpenters’ pension and more important to me is my wife’s {Senator Dianne Feinstein’s}. She has a remarkable record as a Democrat and believes in all its principals and is a strong supporter of Labor, as you well know. It has just been called to my attention that over 16000 retired carpenters are actually suffering Under your leadership.

Their checks have been cut in half with no cost of living increase. A 500 dollar check Under Social Security has risen to 775 dollars in your time frame. It does not take a financial wizard to figure that they have a check value of 225 dollars left. Nor the fact that most of them were paying into the pension {$2.62 per hour{ $105.80 per week when they retired. If you calculate closely you will see that we paid our good dollars in and only getting back only $15.40 short of what you actually took out of our pay checks in only two weeks. This could be a reason alone for an investigation of any pension fund, let alone ours that did show a loss of 84 million just a few years ago when you, Mr. McCarron, become president of the carpenters’ union.

Two Billion is a lot of money and the ones that put it in should be benefactors first of all - not ignored and shut out of all negotiations, not treated like we do not exist. We desperately need action to avoid the need for national attention. Law suits and reasons to help destroy all the good things that other unions do and are still doing could be and can still be avoided. It is time to double our pensions now before the government starts taxing our profits as excess.

This letter was sent to the {CENTER}, by Mr. John Tietz, President of Retirees Club #20 Who said, “I am enclosing a letter from one of our retired carpenters”. “I thought you might like it to add fuel to the fire”.

Mr. Tietz and his wife have both past away in the last three months I and we all have all lost a man who would stand up and be counted when it came to the Carpenters Union.

Any and all participants can contact these Government Offices Who are in Southern California or who have worked in Southern California.

The {CENTER} is collecting evidence of whether or not the Carpenters Pension Plans Illegally underpaid an unknown number of participating retirees by 20-50-or 100 per-cent. Starting with PAST SERVICE, SERVICE PENSIONS. IF YOU HAVE ANY INFORMATION ON THIS SUBJECT, PLEASE CONTACT ME.

I and other retirees in the year 1992, claimed union fraud, we brought up the subject to the PRECINCT REPORTER, Staff Writer W. K. Berry, and they printed a article on Thursday, June 18, 1992. I was informed by some of Leaders of the CARPENTERS UNION THEY WERE GOING TO SUE MY BEHIND OFF. I said, “ Please do will sue you all in class action suits, and with others, plus each and ever one of us participants would sue each and every one of the leadership and each and every one of these UNSCRUPULOUS PEOPLE, who were in to this UNION FRAUD, which under the law we could each do”.

IT IS TIME TO TAKE THESE PEOPLE TO COURT BY NOT ONLY THE CARPENTERS, & THE LATHERS AND OTHER RELATED TRADES, BUT FOR THE PUBLIC AS WELL IN IN THIS YEAR 2000. OTHERS ARE PULLING THESE SAME TRICKS ON THE PUBLIC.

The {CENTER}, will be asking any and all to have {PUBLIC HEARINGS ON ALL OF THESE PROBLEMS}.

I HAVE TAKEN CARE OF ONE PROBLEM, I WAS INFORMED THEY WOULD HAVE MEMBERS JOIN AND TAKE CARE OF ME , BY HAVING ME, REPLACED AS PRESIDENT OF THE UNION ALL-PENSION AND DEMOCRATIC RESEARCH CENTER, INC. TiD Bit: Some one turned Mr. Bowen in to the I.R. S. He told the I. R. S. he had not cashed said check for $6,401.00 dollars, the I. R. S. said, “he owed $1,200 dollars, and could not GET THE NAME OF WHO CASHED HIS CHECK TILL HE paid this sum”. This is going to get interesting as the FEDS., I. R. S. and the Police Department might get into this game. Mr. Bowen, paid the I. R. S. the sum of $1,200.00 dollars. Mr. Bowen, on said check stated, “DON’T OWE FRAUD DEPT”. INTERESTING AS ALL OF THE CHECKS BEFORE WERE FOR $4,300.00. THIS CHECK WAS FOR THE SUM OF $6,401.00. ALSO MR. BOWEN, (PROTEST PAID IN FULL TO THE I. R. S). TiD BiT: LET THE GAMES BEGIN. MR. I Elvin F. Scott, was dispacthed 3-28-66, 3-29-66, arrived at job site 7:30 AM foreman was not there. The superintendent name Bob Leslie. Started to roll out cords, saws. There was a problem and problems from the start, crips were wrong on the headers windows and the doors. Layout was incomplete. Two other members started house next door.

9:15 foreman gave us our checks and at the same time two other carpenter members had their checks.

Mr. Mansfield, Financial Secretary, Mr. Kirkwood Business Representative, Mr. Kolder, our President of our Local. Mr Mansfield said, “Some thing must be done about this”, “He said meet him out at the Walter Sholtz Job, when we arrived Mr Mansfield, Mr. Kirkwood, and Mr. Kolder, the foreman and the rest of us met two of the suprtintendents for Walter Sholtz.

The foreman told why he had laid us off he said, “That he was not runing a school”, “ I told him when you lay four men off in less then an hour when you were not even here you had to start writing these checks as we were laying out the cords at 8:15. It takes about 15 mimutes to write out the checks and to be laid off in 30 ninutes was not right. I also informed all of them that to clean up these mistakes would take a couple of hours, the ones laying out this house needed schooling.

The foreman and the two superintendents ask us to go back to work, I informed Brother Mansfield, we would not last a day or if we did second day we would get layoff checks. The Foreman for Walter Sholtz, did lay us off the second day, after saying you do this house for the sum of $85.00, I said, $120.00, he said would go for $95.00. This was March the 30-66.

What could get a man into this mess??? This add appeared in the paper.

Mr. Kirkwood was being blamed for what was going on I did not Blame him or any other member of our Local. A fight over this at the Union Meeting came to a head by one of these misguided members, he picked a steel chair, to keep this on an even keel I also picked a steel chair. I lost and was on the floor when this so called chair came to a halt about a quarter of an inch from my nose, this old boy said, “I am trying to kill you”, I said you got that right”. We met at a bar the next night I said, “lets go out side”, He said , “Let’s talk we both said liked Mr. Kirkwood”. He said, “would not come to another Meeting”. He kept his word.

To those who do not know they have to let the members try you, on this date of Tuesday July 19 1996 at 7:00 PM. Easy as 1 t o 3, on this night members were showing up that never came to a UNION MEETING AND THEY THREW OUT EVER CHARGE THAT HAD BEEN THROWEN AGAINST THEM. (ONE ON ME}.

August the 11, 1996 fined the sum of $100.00. Paid said fine. INTERESTING TO NOTE ALL OF US SHOWED UP IN LOS ANGELES WITH MR. ROBERT FELTT, OUR BUISNESS AGENT TO PROTECT OUR RIGHTS AS MEMBERS OF CARPENTERS LOCAL UNION #1062. OFFICERS SAID, “NOT ONE MEMBER WOULD SHOW UP, ONLY ONE MEMBER WHO SAID, “I WILL NOT SHOW UP BECAUSE THEY JUST GAVE HIM A WORKING OVER A FEW MONTHS BACK, HE STILL HAD SOME SAND LEFT HE FILED THE CHARGES, IN MY BOOK THAT WHATS COUNT.

I hope this information and the facts presented so far will help some of you out there. Will get to the MILTARY and explain some of the ways they have CHEATED the VETERANS. I was saving this for the 2 hour live TV Program in San Francisco, California. (INTERNET WEB-PAGE I BELIEVE WILL HIT MORE OF THE PUBLIC) (IN THE YEAR 2000)

AND ALL OF US WHO HAVE HAD ENOUGH OF THIS FRAUD AND CORRUPTION. NEW YORK HARD HAT NEWS OUR ADDRESS: NEW YORK HARD HAT NEWS PO BOX 1786, NEW YORK NY 10159- 1786. They have stared a pension column…See past two issues. They are on the Centers list.

The adopted rules, set up by these Board of Trustees of all our carpenter pension plans, is not in the best interest of all of the participants and all of the beneficiaries of our pension plans, and is detrimental and also unfair. Very unfair to many of the participants who performed work in in these different time frames. Throughout the years up to this date 2-18-20.

The Board of Trustees, as fiduciaries, has the obligation to protect plan assets and provide benefits to meet the needs and the exceptions of all of the participants. By commitment to all the participants of 42-L, the Board of Trustees of their pension plan has followed their pension plan has followed their fiduciary duties: “SLOELY IN THE INTEREST OF THE PARTICIPANTS AND BENEFICIARIES, AND IN ACCORDANCE WITH ALL OF THE DOCUMENTS AND INSTRUMENTS GOVERNING THE PLAN”.

LOCAL 42-L SAVED ALL THEIR ASSETS, THEY RASISED THE SUM OF $20,000 BY THEIR MEMBERS. AT A LATTER DATE ALL OF THE TRUSTEES WERE PUT OUT TO PASTURE AND OTHERS TOOK OVER. CHANGES MADE BY THE TAKE OVER YES YES.

The Board of Trustees fail in their fiduciary duties in not giving the monthly amount of retirement income payable on account of an EMPLOYEE’S PAST SERVICE CREDIT THAT SHOULD BE DETERMIND BY THE TRUSTEES, ON YHE BASIS OF A VALIED CURRENT ACTUARIAL EVALUATION PROVIDED THAT ALL EMPLOYEES IN A SIMLER CIRCUMSTANCES ARE TREATED IN A SIMALER MANNER.

TYPICAL OF THESE ADOPED RULES FUTURE SERVICE CREDIT SHOULD ALSO BE COUNTED THE SAME, AND SHOULD APPLY AS STATED BEFORE THE CHANGES WERE MADE IN THE DIFFERENT TIME FRAMES.

“COMPENSATION”, means all earnings and any other taxable compensation received for a year, month or day from any EMPLOYER, or from any company in an Employer’s group or affiliated service group with in the meaning of sections 414 (b), (c) or (m) of the Internal Revenue Code. Other Codes also may apply as an Example: section 415 (e) of the Internal Revenue Code.

It should be applied as if all the EMPLOYERS were a single Employer, with out Distinguishing among them as to the source of a PARTICIPANT’S BENEFITS, AND CONTRIBUTIONS, EARNINGS OR SERVICE.

BY THEIR ACTIONS: THE BOARD OF TRUSTEES OF ALL THE UNITED BROTHERHOOD OF CARPENTERS AND THE BUILDING AND CONSTRUCTION INDUSTRY PENSION PLANS THROUGHT OUT THE STATE OF CALIFORNIA. HAVE SET IN MOTION “PRECEDENTS” FOR ALL OF THE PAST SERVICE, MILITARY AND SERVICE PENSIONS AS WELL AS ALL OF OUR FUTURE SERVICE CREDIT DUE THE “PARTICIPANTS OR BENEFICIARIES FROM 2-18-20, AT THE TIME OF THEIR RETIREMENT.

Keep in mine: The Teamsters members receive three to four times as much as we carpenters receive, in the near future more benefits. The “WTC Plan” can make this statement to the PARTICIPANTS AND THEIR FAMILIES.

I want to give you a little story that I heard two years ago in Washington, D. C. It was By a Mr. Rae, who was running for city council in Washington, D. C. And he told me this story About this little city boy from Washington , D. C., John, who went down to his cousin’s farm in North Carolina! He’d never been in the country. And he went in the house, and there was two 22’s over the fire place. And he said, “Man, I’d love to go shooting.” So his cousin took little Johnny out, and they went shooting. They were walking along, and Johnny would see a rabbit, and shoot it. He’d see a butterfly, he’d shoot the butterfly. He saw a turtle on a log , killed the turtle. Any critter he saw, he shot and killed. And his cousin looked at him and wondered, “What’s with this guy? He just loves to shoot things.” Well they were walking down this path, And Johnny sees a hornets’ nest on a limb. And he goes to shoot the hornets’ nest. And his cousin says, “ Hey wait a minute! You don’t mess with those guy!s” And Johnny says, “Why not man? I’ve been shooting everything else.” And his cousin says, “You don’t mess with them, because they’re organized!”

I believe this old boy is from Canada.

CARPENTERS AND JOINERS OF AMERICA LOCAL UNION No 2046

LETTER DATED January 31, 1984

Bruce Sutherland, Administrator Carpenters Pension Trust Fund for Northern California 995 Market St. San Francisco, Ca, 94103

Dear Sir:

Carpenters Local 2046 member, Elvin Scott, has appeared before the executive board of this local as well as before the general membership, to discuss problems he has encountered in obtaining his pension. He asked that this local help him with the following problems:

1. Brother Scott feels that he was shorted credit for approximately eight years of work. He feels that he should receive pension credit for his military service time from December 11, 1942 to November 21, 1945. Brother Scott also feels that he should receive pension credit for the period from 1949 t0 1953.

2. Mr. Scott feels that he should be given a Pro-rata type of pension instead of the Early retirement that he was recommend for to the Pension Approval Committee on Jan. 18, 1984.

Please reply to Brother Scott regarding these problems and provide him with copies of the regulations in effect that affect his pension credits for past-service time.

Fraternally.

E. A. Pete Perez-Montalvo Recording Secretary

Opeu-29 Afl-cio At this time I did not know to what lengths this would go, to be able to present the facts as you will be able to see from this point on. The CARPENTERS PENSION TRUST for SOUTHERN CALIFORNIA

Prepared by: Marsha A. Lynch Date Prepared 3/26/84 Prepared for Meeting of: 4/26/84 2 ELVIN F. SCOTT Case No. 009-84 Date of Birth: 10-03-23

This led to my: STATEMENT OF CONCERN JUNE 1984

So that you will have a better under standing of this Statement of Concern: Will explain about each paragraph or as the case maybe each sentence. As I understand it, past credit will be granted for periods of Military Service before a Carpenter’s Contribution DATE, provided the SERVICE was covered by the Federal Re-employment PROVISION.

1. We run into problems they do not follow these PROVISIONS and they also do not treat every member the same. They have given Military Pension Credits to some and denied others under these same PROVISIONS and even their own RULES, CARPENTER’S SOUTHERN CALIFORNIA UP TO THE YEAR 2000. FOR NOT ONLY PAST SERVICE TIME BUT FOR FUTURE SERVICE TIME UP TO YEAR 2000. I KNOW A MEMBER WHO MET EVERY REQUIREMENT OF THE PROVISION OF THE CARPENTER’S RULES AS WELL AS EVERY GOVERNMENT PROVISION I HAVE THE PAPER WORK TO AND FROM THE PENSION TRUST PLUS THE DISCHARGE OF THIS VETERAN. DENIED HIS MILITARY TIME UNTIL I TOLD HIM WHAT AND HOW TO GET HIS PENSION CREDITS DUE HIM FROM THE CARPENTERS PENSION TRUST OF SOUTHERN CALIFORNIA.

The Carpenter was to have been employed in a job that would qualify at the time he entered the Military Service, and had to be re-employed by the same employer within ninety (90) days of discharge, or if disabled, then after recovery. TiD-BiT : THIS OLD BOY COLLECTED ALL MONEY DUE HIM FOR HIS MILITARY TIME: HE HAS NOT COLLECTED ALL MONEY DUE HIM FROM HIS YEARS AS A CARPENTER AS OTHERS HAVE NOT COLLECTED THEIR FULL SHARE DUE THEM TO 2000. A presumption therefore established … that such a participant was engaged in creditable employment through his period of his membership in a Local Union in for periods prior to his Contribution DATE as qualified by the Internal Revenue Service … !st Day Sept, 954 5 C Jan. 1959, PENSION S. C. LABOR MANAGEMENT RELATIONS ACT OF 1947, AS AMENDED BY THE CONTRIBUTION EMPLOYEE RETIREMENT RELATIONS SECURITY ACT OF 1947. E.R.I.S.A., ALSO UNDER AGREEMENT, ESTABLISHING THE CARPENTERS HEALTH AND WELFARE PENSION COLLECTIVE BARGAINING AGREEMENT JANUARY 1, 1959, WORK PREFORMED ON AND AFTER AT ALL TIMES TO CONFORM TO APPLICABLE REQUIREMENTS OF THE LABOR MANAGEMENT ACT OF 1947 AS AMENDED BE QUALIFIED PURSUANT TO APPLICABLE PROVISIONS OF THE INTERNAL REVENUE CODE AS AMENDED FOR ALLOWABLE EXEMPTIONS AND IMMUTIES. SEC. 3 PAGE 7 CONTRIBUTIONS, HEALTH AND WELFARE PLAN, NOT WAGES.

These people 3/26/84 We subsequently reviewed all information available for any adjustment to be made and found that we overestimated his Past Service CREDIT due to the fact that we used union membership instead of the SOCIAL SECURITY EARNINGS RECORD.

They Denied me benefits, BY NOT COUNTING MY EMPLOYERS WHEN I WORKED FOR ONE IN YEAR 1953, 1954 AND 1955. PAI D $100.00 DOLLARS INTO SOCIAL SECURITY. This is in the days we worked on five hundred houses or more at the same time.

I worked for this employer as a pick up Carpenter on three to four different jobs, I and the foreman were the last two men on these jobs. This foreman was my employer in the year 1948. We had a disagreement in that year of 1948, I and my brother said, “GIVE US OUR CHECKS”. Year 1953, I was doing Pick up at this job-site had a partner who was about fifty five, payday I was handed my pay check and my partner received two checks. I said, “Give me that lay off check”. This old boy had not recognized me, I went up to him and tore up said check. And pulled my hammer out with the claws facing him. He said, “HE’S YOURS”. This started my being the last carpenter laid off for these jobs year 1953, 1954 and 1955.

DENIED THESE PENSION CREDITS FOR THESE YEARS, THIS EMPLOYER WAS UNION PERIOD, SAME FOR THIS FOREMAN YEAR 1948. Interesting I was a paid up member of the UNITED BROTHERHOOD OF CARPENTERS AND JOINERS OF AMERICA IN THESE YEARS OF 1953, 1954 AND 1955. Also interesting I had check stubs for these years but they did not have 1953, 1954 or 1955. Did show on Social Security year 1953. DENIED THESE YEARS, ANY ONE WITH ANY SENCE AT ALL WOULD ASKED HOW IN THE HELL DID THIS MAN LIVE IF HE COULD NOT CASH THESE CHECKS IN THESE TIME FRAMES. KEEP IN MINE NON-UNION 0R UNION COUNTED IN SOUTHERN CALIFORNIA FOR CARPENTERS.

THIS AND OTHER METHOEDS WERE USE THEY DID NOT REQNIZE MY PAY CHECKS OR STUBS, THEY ALSO DID NOT USE MY SOCIAL SECURITY RECORDS, IN FACT THEY NEVER USED THE FACT THAT I WORKED FOR RELATED TRADES IN THE DIFFERENT YEARS IF I HAD LIKE A YEAR OR SIX MONTHS THEY ALLOWED MY PENSION CREDITS, IF LESS THEY WOULD PULL THE STUNT OF DENING ME, PENSION CREDITS.

CASE IN POINT: YEARS 1949, 1950, 1951, 1952 AND 1953 OVERSEAS WORK, THEY GAVE ME TWO YEARS AND DENIED ME, THREE. UNDER THEIR OWN RULES THEY HAVE NOT ONLY CHEATED ME, OUT OF THESE YEARS BUT OTHER YEARS PAST SERVICE AND FUTURE SERVICE.

WHY? TO KEEP ME , FROM MY SERVICE PENSION IN SOUTHERN CALIFORNIA.

BEEN TOLD TO MY FACE TIME AFTER TIME SUE US: WITH THE HELP OF THE HORNET’S NEST, THAT I AM GOING TO EXPLAIN AS WE GO ALONG, THE PUBLIC AND ALL OF US TOGETHER IN THIS COMING YEAR AS THE CENTER WILL BE NON-PROFIT AND CAN START THE ACTIONS THAT ARE NECSARY TO PUT THE KICK IN THE PANTS TO GET ALL OF THESE PROBLENS IN ORDER SO EVERY PENSION IS SAFE IN YEAR 2000.

I BELIEVE I AM BEING DISRIMINATED AGAINST AND THAT IT IS POSSIBLE THAT THERE HAVE BEEN DISCREPANCIES IN INCOME REPORTED, OR LOSS OF INCOME ERRONEOUSLY REPORTED, TO SOCIAL SECURITY AND THE UNION. I UNDERSTAND THAT IN MANY CASES IT WOULD BE DIFFICULT TO SHOW CREDIT PRIOR TO CONTRIBUTION DATE, PAST SERVICE YEARS, OR VESTING SERVICES, I REQONIZE THAT IN MANY CASES IT WOULD BE DIFFICULT TO PRODUCE EVIDENCE OF PAST SERVICE YEARS IN COVERED EMPLOYMENT BECAUSE OF CHANGING EMPLOYMENT.

If you would drop me a line give me your opinion : Also as I understand it, contractors would not sign the agreement in Southern California for pension, health and welfare until the unions agreed to take care of the older workers (union members) who had time in before 1959.

Also as I understand it, contractors would not sign the CARPENTERS agreement for PENSION, or HEALTH and WELFARE until the SOUTHERN CALIFORNIA UNIONS AGREED TO TAKE CARE OF THE OLDER CARPENTERS AND UNION-NON-UNION OLDER WORKERS (UNION MEMBERS), WHO HAD TIME IN BEFORE 1959.

1. THIS WAS PUT INTO THE SOUTHERN CARPENTERS CONTRACTS WITH THE EMPLOYERS, BY OUR LEADERS IT WAS PUT IN OUR BOOKS THAT OUR UNIONS GAVE US.

IN THIS TIME FRAME OF 1958 T0 1959, I VOTED AS OTHERS DID NOT ONLY DID I VOTE FOR ALL OF THESE BENEFITS BUT TALKED ALL OF THE MEMBERS OF CARPENTERS LOCAL UNION #1062, IN TO VOTING.

THEY WERE GOING TO NOT VOTE FOR THESE BENEFITS PERIOD. I SAID, “MAYBE THEY ARE THE CROOKS YOU SAY THEY ARE, BUT ALL OF US TOGETHER CAN MAKE THEM TOE THE MARK”.

VOTE ONE HUNDRED PER-CENT FOR THESE BENEFITS: I AND OTHER MEMBERS OF THE UNITED BROTHERHOOD of CARPENTERS and JOINERS of AMERICA, WERE TOLD BY INTERNATIONAL REPRESENTATIVES, BUSINESS REPRESENTATIVES, and BY LOCAL UNION OFFICIALS, TIME -UNION AND NON-UNION RELATED TRADES and MILITARY PAST SERVICE COUNTED FOR OUR PENSION CREDITS.

WE WERE TOLD IT WOULD BE AN INTERNATIONAL PLAN: IN SOUTHERN CALIFORNIA WE WERE GIVEN THIS INFORMATION IN SEPCIALLY CALLED MEETING AND AT OUR REGULAR MEETINGS, AND INDIVIDUALLY:

INCLUDED IN THIS INFORMATION : WE WERE TOLD BY ALL CONCERNED:

1. STATEMENTS FROM OTHER WORKERS,

2. FROM CONTRACTORS OR EMPLOYERS,

3. W-2-FORMS, CHECK STUBS,

4. STATEMENTS FROM SOCIAL SECURITY,

5. STATEMENTS FROM YOUR OFFICERS,

6. RELATED TRADES UNION AND NON-UNION,

7. MILL-WOOD-WORKERS, ALL CARPENTERS, MAINTENANCE WORKERS AND ALL RELATED TRADES:

ALSO WERE TOLD, THAT MEN WHO WERE 30-35-40-YEARS OF AGE WOULD HAVE MONIES SET ASIDE TO TAKE CARE OF THEM WHEN THEY RETIRED.

THE CARPENTERS PENSION TRUST FUND PLANS VOILATED ALL OF THE ABOVE PLUS WHAT IS TO COME IN THIS WEB-SITE NOW AND IN THE FUTURE OF THE (CENTERS)::

Also as I understand it, under the pension reform act, a plan may accrue benefits for an employee in accordance with anyone of three minimum accrued rules, these are explained in (3051 Thai 3105.

ESSENTIALLY THESE RULES ARE AIMED AT PREVENTING THE EXCESSIVE (BACKLOADING), OF A DEFINED PLAN.

BACK LOADING IS THE PRACTICE of PROVIDING A FASTER RATE OF ACCRUAL AFTER AN EMPLOYEE HAD OBTAINED A SPECIFIED AGE OR SPECIFIED YEARS OF SERVICE.

FOR INTANCE, BACKLOADING WOULD OCCUR WHERE A PLAN PROVIED A BENEFIT 1.5% OF COMPENSATION FOR EACH YEAR OF SERVICE BEFORE AGE 55, AND 2% THEREAFTER

OVERSEAS WORKERS WHO HAVE BEEN CHEATED OR THOSE WHO HAVE RECEIVED ALL OF THEIR PENSION CREDITS WOULD LIKE TO HEAR FROM YOU. I CAN SAY TO ALL THE OLD BOYS I KNOW WOULD NOT STAND FOR THIS.

IF THIS IS TRUE, THEN I AND WE SHOULD HAVE ALL MY TIME AND ALL YOUR TIME COUNTED AS I HAVE BEEN TRYING SINCE THE YEAR 1959 TO YEAR 2000, TO BRING UP MY TIME UP FOR RETIREMENT PURPOSES. IF THIS IS NOT TRUE , THEN I WOULD LIKE TO HAVE IT EXPLAINED TO ME IN WRITING:

WHY A LOCAL UNION OR ANY AND ALL OF THE MEMBERS OF THE CARPENTERS IN AMERICA, CAN SAY BECAUSE I BELONG TO SOUTHERN AND NORTHERN CALIFORNIA CARPENTERS UNION:

THAT NOTHING CAN BE DONE BY MY UNION NOW IN THIS YEAR OF 2000, FOR MY TIME SERVED IN SOUTHERN CALIFORNIA, AND OR NORTHERN CALIFORNIA WHEN I AND OTHERS HAVE BEEN CHEATED AND SWENLED OUT OF PENSION BENEFITS AND ALSO SOME HAVING TO PAY TWO TIMES THE AMOUNT FOR MY AND MY WIFES HEALTH CARE.

I DO BELIEVE AS STATED ABOVE AND WILL BE STATED IN THE NEAR FUTURE THAT IT IS TIME TO CLEAN THE HOUSE AND HOUSES OF NOT ONLY THE CARPENTERS BUT OTHERS AS WELL WHO HAVE BEEN PULLING, ALMOST THE SAME SOME NOT AS MUCH AND ALL OF THE GOOD UNIONS WHO TREAT THEIR MEMBERS FAIR AND SQUARE IN THIS YEAR OF (2000)

I ELVIN F. SCOTT, BELIEVE THE UNION OFFICIAL’S PROMISE BINDS THE UNION TO PAY THE PENSION AS PROMISSED. I ALSO BELIEVE THAT WHERE NATIONAL OFFICIALS, BUSINESS REPRESENTATIVES, AND LOCAL UNION OFFICIALS ARE INVOLVED, IT WOULD BE RESONABLE THAT THE RETIREE (ME), WAS DUE WHAT WAS PROMISSED, AND OTHERS GET THEIR FAIR SHARE AS THEY WERE PROMISED. Tid-Bit: Two officials came to my house to in form me, that our Local had been changing the records of carpenters local union #2046, they both said, “They had observed this being done, and ask why?”

These two officials also said, “They were informed by changing these records if he sues us he will not have a leg to stand on”.

I HAVE LETTERS FROM THIS CARPENTER LOCAL UNION #2046, TO AND FROM THEM TO ALL CONCERNED, SOME OF THESE LETTERS WERE SENT TO EVERY ONE IN THE STATE OF CALIFORNIA, WILL PUT THEM ON THE CENTERS, WEB-PAGE IN THE NEAR FUTURE.

AND TO THE INTERNATIONAL UNION OF CARPENTERS: AND I HAVE LETTERS I SENT TO ALL CONCERNED: I HAVE ONE THAT WAS SENT BACK TO ME. HAVE NOT OPENED SAID LETTER:

ON A TV SHOW WILL OPEAN SAID LETTER FOR ALL TO SEE: THIS WILL BE AN EYE OPEONER:

When the CENTER, becomes NON-PROFIT:

I WILL HEREBY BE REQUESTING ALL OF THE PUBLIC, TO ASSIST THE (CENTER), IN INSTITUTING (CLASS ACTION SUITS), TO RECTIFY THE INEQUITIES OF NOT ONLY THE CARPENTERS BUT OTHERS AS WELL)

BY US EMPLOYING AN ATTORNEY AND/OR ATTORNEYS FOR SPECIFIC REPRESENTATION PRIOR TO INSTITUTING (CLASS ACTION SUITES), BEFORE FORMAL LEGAL ACTION AND AFTER LEGAL ACTION IS TAKEN TO PROTECT ALL OF THE PUBLIC

TO ALL OF THE MEMBERSHIP OF THE UNITED BROTHERHOOD OF CARPENTERS WORKING THROUGHOUT THE UNITED STATES AND CANADA OR MEXICO.

OR IN SOUTHERN AND NORTHERN CALIFORNIA: Y OU AND YOUR FAMILIES MAY HAVE PENSION MONEY DUE,

IF OFFICERS AND OFFICIALS OF THE SUBORDINATE BODIES OF THE UNITED BROTHERHOOD SIGNED PRIVATE CONTRACTS AND NEGOTIATED SPECIAL WAGES AND PENSION AND HEALTH AND WELFARE AND FRINGE BENEFIT PROVISIONS IN YOUR BEHALF, WITH EMPLOYER AND/OR EMPLOYERS IN THEIR OWN GEOGRAPHICAL AREAS AND THEIR OWN JURISDICTIONS AND THEY SENT YOU OUT AS A UNION CARPENTER FOR UNION CONTRACTUAL WAGES AND UNION CONTRACTUAL FRINGE BENEFITS. POINT OF ORDER: THESE PERSONS SAID, “ THIS ALL WAS DONE IN THE TIME FRAME OF BEFORE AND AFTER THE

CHANGE IN SERVICE PENSION ELIGIBILITY REQUIREMENTS THE TRUSTEES AND MANAGERS AND THE ADVISORS AND THE ATTORNEYS WHO DREW UP THESE ILEGAL RULE AND/OR RULES AS I WAS TOLD BY TWO OF THE ATTONEYS WHO SAID, “ THEY INFORMED OUR CARPENTER LEADERS IN SOUTHERN CALIFORNIA, WAS AGAINST (ERISA) RULES.

Union officers and officials of the subordinate bodies of the United Brotherhood of Carpenters and Joiners of America, in both Northern and Southern California have said to me, they have knowledge of the option that both Southern and Northern Carpenters pension and health and welfare trust funds were allowing and had made exceptions to firm and/or firms to pay into the Trust Funds of the Carpenters Subordinate Unions In the same time frames as they were cheating me, and some of the participants.

ON THIS I KEEP GETTING SUE US: Believe me, With the ( HORNENTS ), HELP, INTEND TO DO JUST THAT:

As promised in the year 1944, in a less then half a second, I found out that in the next five minutes that I was not only a leader of men but an organizer as well.

I came up from the safety of the sturdiness of my cellar in the Siedfried Line in the Village of Beggendorf, to the following:

Three men one the LT. , WHO I HAD NEVER SEEN BEFORE AND TWO MEN FROM THE FIRST PLATOON, LT. HAD A forty five on one, WAS FACING THE SAME AS ME, and the LT. WHO WAS FACING THE ONE HE SAID, “Was going to shoot”. The third had a fifty from the haltrack on all three of us as I now was in the line of fire. I had to even this up I stepped in front of the one to be shot and in back of the LT. and put my gun to the back of his of his head saying, “ONE GOES ALL GO”. Did not faze him….the one on the fifty ready to fire. I said, “Put that gun away now you loose what the hell started this?” Lt. says, “ I told them to put my bags away, and they refused”.

To sum this up, I talk all of them in to putting guns away. BIG MISTAKE. THE OLD BOY ASKED ME TO STEP ASIDE. I COULD NOT DO THIS NOT BECAUSE I CARED ABOUT THIS LT., THIS GAME HAD BECOME INTERESTIN I HAD A CHANCE TO SAVE THE BOTH OF US BECAUSE HE’D HAVE TO KILL US BOTH.

MY WORD WOULD SAVE THE DAY, I TOLD THIS OLD BOY THAT US SOUTHERNERS ALWAYS KEPT OUR WORD WHEN IT CAME DOWN TO US. I WAS NOT AN EASY GUY TOGET ALONG WITH AT THIS TIME, BUT THIS CHANGED MY THINKING AND I KNEW

THIS YEAR 2000, I DO NOT THINK I AM AN ORGINIZER I KNOW I AM IN THIS YEAR OF 2000. UNION PENSION FUNDS MUST WORK FOR WOKERS, RETIREMENT FUND MANAGERS MUST BE AWARE OF SITUATION, A FURTHER PROBLEM BEING EXPERIENCED IS THAT THESE FUNDS ARE INCREASINGLY BEING MANAGED BY PROFESSIONAL INVESTIMENT ADVISORS HOSTIL TO THE RIGHTS OF WORKERS AND THE GOALS OF ORGAIZED LABOR.

THIS WAS PUT OUT BY THE CARPENTERS YEARS AGO:

TID---------------------------------------------------------------------------------------------------------------------BIT:

THE FACT AND FACTS, SPEAK FOR THEMSELVES, I HAD TO SIGN A WAIVER TO HAVE MY DUES PAID OUT OF MY CHECK TO WHAT EVER EMPLOYER I WAS WORKIG FOR IN THE INDUSTRY OF ANY AND ALL RELATED TRADES IN PAST SERVICE AS A CARPENTER FROM YEAR 1959, BACK.

CONFIRMED BY THE CHAIRMAN OF THE CARPENTERS AT MY APPEALS HEARING. DENIED MY PENSION CREDITS EVEN WHEN I HAD EVIDENCE THAT I WORKED IN THE INDUSTRY IN THESE TIME FRAMES OF PAST SERVICE FOR CARPENTERS.

POINT TO REMEMBER: THESE SAME LEADERS AT MY APPEALS HEARINGS WERE SOME OF THE ONES WHO THREATENED AND TOLD OUR OFFICIAL AND OFFICIALS NOT TO HELP IN ANYWAY.

I HAD AN OFFICIAL OF CARPENTERS LOCAL UNION #25, INFORM ME PERSONALY PLUS OTHER MEMBERS OF LOCAL #25, HE WAS ORDERD TO NOT HELP IN ANY WAY FOR A MEMBER NOT JUST ME, BUT FOR ALL MEMBERS OF THE BROTHERHOOD OF CARPENTERS. I CAN NAME OTHER OFFICIALS WHO WERE TOLD TO STOP HELPING ME, AND WERE ALSO THREATENED. I CAN NAME OTHER OFFICIALS OF THE CARPENTERS IN BOTH SOUTHERN AND NORTHERN CALIFORNIA WERE TOLD NOT TO HELP ME. I CAN PROVE THEY ORDERED OTHER OFFICIALS OF THE CARPENTERS WHO WERE GOING TO HELP ME. DATE AND TIME OF MY APPEALS HEARING THEY WERE ORDERED TO GO TO A MEETING PERIOD BY THEIR LEADERS. REFUSED TO READ THE DEPOSITIONS OF OFFICIALS WHO WERE TRYING TO HELP ME.. WITH NOT ONLY PAST SERVICE BUT WITH FUTURE SERVICE AS WELL.

BY THEIR ACTIONS, THE SOUTHERN CALIFORNIA AND THE NORTHERN CALIFOR NIA LEADERS OF THE CARPENTERS HAVE SET IN MOTION THE FOLLOWING:

AS A MEMBER OF THE CARPENTERS I AND OTHERS HAVE BEEN CHEATED AND SWENDLED OUT OF OUR PENSIONS AND BENEFITS WE EARNED AS CARPENTERS THROUGH THE YEARS UP TO YEAR 2000. AS WERE ALL OF THE PARTICIPANTS WHO NOT ONLY HAD THEIR SERVICE PENSIONS, BUT ALL OF THE ADDED.

DOUBLE FOR HEALTH AND WELFARE AS THAT IS WHAT I PAID FOR YEARS.

12 PER-CENT FROM ONE AND 6 PER-CEN FROM THE OTHER AND OTHER FORMS ALSO USED: THE AVERAGE IS TWO HUNDRED DOLLARS FROM THE START: THIS ALSO IN SOME CASES YOU LOOSE NOT 20 PER-CENT BUT 30 PERCENT: AND IN OTHER CASES IT IS 50 PER-CENT: AND IT GOES TO 70 PER-ENT AND IN RARE CASES 100 PER-CENT.

MUNK, I Mads J.

THIS WAS AND IS BEING DONE TO SHOW ALL OF THE PUBLIC, I KNEW FROM THE START WHAT THEY AS TRUSTEES WERE DOING. I LOOK AT IT IN THIS WAY OR FASHION, A JURY, JUDGE, COURT ROOM OR ANY ONE LOOKING AT THIS WOULD VOTE IN MY FAVOR.

WOULD LIKE TO HEAR FROM ALL OF YOU THE PUBLIC, IF I AM IN THE RIGHT IN MY THINKING.

The year 1960 the members were told they would have to acquire a minimum of 200 hours in a 90 day period-Jan-Feb-March_April-May-June- July-Aug-Sept-Oct-Nov-Dec.

Point : Another way to do you out of your pension:

I asked the Trust Office-why the cancellation?

If you have you had less than 200 hours why you could not pay the difference-plus what expense to add to your hours of delinquency-I then brought this up a number of times which cause a lot of discrepancy. Before the next election their were (2) international men ! from Northern California and one from Southern

California came to Santa Maria-they had the Union books locked up-They called a special called meeting to have me removed from office-They had false charges against me I was fined $150.00 with my book removed- I called the Union Lawyer paid $150.00 for a new book (Plus Dues).

I SIGN ALL THESE CHEKS ((((PARTIAL PAYMENT, OR WORDS TO THAT EFFECT, YEAR 2000 )))))

THIS WAS AND IS BEING DONE TO SHOW ALLOF THE PUBLIC, I KNEW FROM THE START WHAT THEY AS TRUSTEES WERE DOING. CHEATNG ME, OUT OF MY RERVICE PENSION.

718-855-6650; www.uniondemocracy.com These are just the start of the HORENT’S, that the CENTER, is going to ask to join the NEST, as we are going to ask all of the PUBLIC to come JOIN THE NEST.

Law.

A little TiD---BiT:

These UNION”S were taken over by Brother McCarron, and these Officials who were going to use their resources to fight this corruption, were all fired.

CARPENTER UNIONS ARE SUBORDINATE BODIES OF THE INTERNATIONAL UNION: TiD-BiT: INTERNATIONAL SAY’S THE TRUSTS ARE SEPARATE AND WE CAN NOT INTERFEAR: THESE UNION’S ARE NOT SEPARATE THEY ALL COME UNDER THE INTERNATIONAL, WHO ARE RESPONSIBLE FOR THEM PERIOD: THEY ARE ALSO RESPONSIBLE FOR THE ACTIONS OF THEIR MEMBERS AND ALL OF THE OFFICIALS OF THEIR SUBORDINATE BODIES :

5-28-91, Roy Connell,

To Whom It May Concern:

BY THEIR OWN ADMISSION I HAVE 9-3/4 YEARS CREDIT. 10 YEARS TO BE VESTED. I HAVE ONLY 3 MONTHS NEEDED TO DRAW BENEFITS.

THE SO. CALIFORNIA PENSION BOARD WOULNT LET ME MAKE THIS 3 MONTH NEEDED. I WOULANT HAVE LEFT SO. CALIFORNIA FOR COLORADO, HAD I KNOWN ALL OF MY CARPENTER TIME IN THE SEVEN WESTERAN STATES. (CALIF. OREGON, WASH. ALASKA, ARIZONA, NWVADA AND COLORADO) WOULAN'T COUNT! Truly yours, Roy Connell Patricia C. O'Neal

THERE IS MORE TO THIS STORY CONCERNING: (MILITARY TIME)::::::::::::::::::::::::::::: TID BITS" , FIRST ON WHAT YOU HAVE JUST READ ABOUT MR. CONNELL CASE IN 2000.

5 Point: First I worked with Brother Connell, when he was a member of Carpenters Local Union #1062. TID BIT : WE BOTH WERE TOLD BY OFFICIALS OF THE SUBORDINATE CARPENTERS LOCAL UNION #1062, THAT OUR PENSIONS COUNTED FOR SOUTHERN CALIFORNIA PENSION AND BENEFITS, AND SO MANY DOES I COULD NOT START TO NAME THEM. IN MY CASE AND HIS CASE WE WERE TOLD BY OUR LEADERS OUR TIME COUNTED FOR PENSION CREDITS, THIS WAS TOLD TO ALL THE DOES ALSO.

I WAS TOLD BY NORTHERN CALIFORNIA CARPENTER UNIONS LEADERS THAT OUR TIME COUNTED AS A LOT OF OTHER DOES WHO WILL READ THIS. WILL AS HORNET'S SEND THE (CENTER), A LINE CONFIRMING THESE STATEMENTS MADE BY ME AND MR. CONNELL, ALSO OTHER HORNET'S WHO WERE TOLD OUR PASTS SERVICE PENSION CREDITS COUNTED SAME AS SOCIAL SECURITY, UNION-NON-UNION COUNTED ALL RELATED TRADES COUNTED UNION NON UNION SAME FOR MILITARY PAST SERVICE. TID- BIT

IF OUR PENSION BENEFITS WERE TO COUNT UNION AND NON UNION FOR CARPENTERS IN SOUTHERN CALIFORNIA HOW CAN THE TRUST FUND DENIE US, HOW CAN THEY DENIE US OUR MILITARY TIME WHEN THEY ALLOWED HUNDREDS OF THE VETERAN'S TO GET THEIR PENSION CREDITS IN SOUTHERN CALIFORNIA AS WELL AS ALLOWED HUNDREDS TO GET FULL PENSIONS FOR PAST SERVICE TIME UNDER THESE SO CALLED RULES THAT WAS SET UP BY OUR CARPENTER LEADERS IN THE YEAR 1959: TID----------BIT: THESE RULES ARE IN OUR BOOKS UNION AND THE TRUSTS: Mr. Connell , SAID, "NOT FAIR" , I SA Y, "HE SURE GOT THAT RIGHT" Lets hear from all of you "HORNET'S", I say, "As a HORNET, LETS SUE AS SOON AS THE CENTER, BECOMES NON PROFIT AROUND JUNE. 2000."

TID*****BIT: WILL GET TO THE MILITARY ON MR. CONNELL, MY AND ALL THE DOES ON A TV PROGRAM, WILL TRY AND GET THE WORD OUT AS WHEN THE DATE AND DATES ARE FORTH COMING IN THE NEXT THREE MONTHS IN YEAR 2000.

POINT OF ORDER:

I ELVIN F. SCOTT, CAN ASK FOR THEM TO REOPEON MY CASE AS A VETERAN, THIS I CAN DO AT ANY TIME WITH THE NEW EVIDENCE THAT YOU ARE READING ABOUT. THIS DOES NOT COST ME, AS IT ALSO WILL NOT COST ANY VETERAN AND THEIR FAMIALY TO ALSO ASK THE GOVERNMENT TO INVESTIGATE HIS OR HER RIGHTS UNDER THE LAW THAT PROTECTS VETERANS. (THIS IS FREE): INTERNATIONAL LETTER FROM THE CARPENTERS DATED MARCH 25, 1987, STATES. THESE PENSION TRUST FUNDS ARE LEGALLY SEPARATE ENTITES FROM THE UNITED BROTHERHOOD WITH THEIR OWN GOVERNING DOCUMENTS, AND THE GENARAL OFFICE HAVE NO SAY IN THEIR ADMINISTRATION. COMPLAINTS OR REQUESTS FOR INFORMATION ABOUT THE PENSION FUND DETERMINATIONS AND POLICES SHOULD BE DIRECTED TO THE RESPECTIVE TRUST FUNDS. TID BIT: THE TRUST FUND WHEN YOU RETIRE IS YOUR ENPLOYER PERIOD:

THE INTERNATIONAL IS RESPONSIBLE FOR ALL OF THE ACTIONS OF THEIR OFFICIALS AND/OR MEMBERS:

US HORNET'S, WILL FIGHT FOR RESTITUTION, BILL OF RIGHTS, SECURITY AT TIME OF RETIEMENT.

WE WILL ASK FOR A FEDERAL CONGRESSIONAL INQUIRY. A STANDARD MANDATORY INSURANCE PREMIUM PAID TO U. S. GOVERNMENT IN YEAR 2000, FOR ALL PENSIONS.

WE AS HORNET'S, DID NOT WORK FOR OUR BENEFITS TO HAVE THEM GO DOWN THE DRAIN, BELIEVE ME AND THE CENTER, THEY HAVE WENT DOWN THE DRAIN IN SOME OF THESE PENSION PLANS. ˙
