The pater/mater of the gens Martiana shall have the authority to declare "nemo" any member of the gens who, not being a citizen of Nova Roma, has not been in communication with the pater/mater for one year.

Whereas on ante dies VII Idus November MMDCCLVIII AUC, sol XIV Tulae AM CCX, an unprovoked attack on Philadelphia (Decapolis Provincia, modern name: Amman, Jordan) resulted in the murder of more than fifty civilians and the wounding of several hundred additional civilians, and

Whereas the criminal barbarian band known as Al Qaeda has admitted responsibility for this attack, and

Whereas Al Qaeda has been determined to be culpable in unprovoked attacks against civilians in Nairobi, Dar es Salaam, Novum Eboracum, Washington, Bali, Mombasa, Riyadh, Constantinopolis, Madrid, Khobar, Londinium and other places around the world during the past seven years, resulting in the death or injury of many thousands of innocent victims, thereby demonstrating an abiding hatred of humankind in general, and thereby presenting a clear and continuing threat to the peace of the world,

Therefore be it resolved that the familiae of the Gens Martiana condemn this cowardly and barbaric attack, and

Resolved that the familiae of the Gens Martiana call upon the Senate of Nova Roma to declare Al Qaeda "hostis humani generis."

The quorum for a vote of the gens Martiana shall be determined as a simple majority the number of members who have been in communication with the pater gentis Martianum within 180 days prior to the scheduling of a measure on the legislative calendar.

Minimum Membership for Familiae

Lex

A familia is a human group; thus "a familia of one" is an oxymoron. This act requires familiae within the gens Martiana to consist of a minimum of two members.

If two or more new members wish to create a new familia, they may do so with the consent of the pater/mater of the gens. Any single new member must join an existing familia with the consent of the pater/mater of the familia.

Paters/maters of familiae may consent to their members splitting off to form a new familia within the gens, so long as the new familia consists of two or more members. Paters/maters of familiae may not consent to the depletion of their familiae to less than two members.

If a familia is reduced to one member, the member shall be required to recruit a new member within one Roman calendar year; failing this requirement, the pater/mater of the gens shall declare the familia extinct, and the orphaned member shall join another familia within the gens with the consent of the pater/mater of the familia.

Sententia

Nova Roma is a micronation. Referring to the Wikipedia article on "Micronation," a list of attributes defines a micronation. In international relations terminology, Nova Roma might qualify as a transnational non-governmental organization (NGO), part of international civil society. In international relations literature, Al Qaeda is called a "non-state actor," but consider how many of the attributes that organization has with "micronations," especially:

Micronations are quite small, both geographically and in terms of membership. They rarely have more than a few thousand members....

Considering other attributes of micronations, Al Qaeda is certainly a "vehicle for the promotion of an agenda." Also, can anyone doubt that Al Qaeda is an intentional community of people sharing similar agendas, organized in large part via the medium of the Internet? Although Al Qaeda is not among the many micronations that "wish to be widely recognised as sovereign states," this does not necessarily exclude it from the category. The nation-state is a concept that emerged from 17th century Europe, and that has been spread around the world by the European-centered capitalist world-system of production, and in many cases by means of European imperialism and colonialism. Thus, nationhood is a foreign concept to much of the world, and for a group such as Al Qaeda that seeks to wield power on the world stage, the absence of a claim to nationhood can be view as a rejection of that European construct. Al Qaeda is not interested nationhood in the European sense; rather, it seeks to create the nation of the believers (Ummah Al-Muhmini) in Islam, i.e. the whole Muslim world. In theory, this is not much different from Nova Roma's aspiration to create a nation of believers in the Religio Romana and practitioners of the Via Romana (although certainly their methods differ). Understood in this sense, is fair to regard Al Qaeda as a micronation.

The gens Martiana also takes note of Public Policy Statement MS-DGA 524.003: Statement Concerning the London Terrorist Bombings of the Empire of Atlantium:

The Government and Citizens of the Empire of Atlantium extend their deepest sympathy to the victims of the London terrorist bombings on 5 Sextus 10524 (7 July 2005) and to the victims’ families.

We condemn in the strongest terms these senseless acts of violence, for which groups claiming links to the al-Qaeda organization have proudly admitted responsibility in the name of Jihad.

Given that Nova Roma and Al Qaeda are members of the same class (micronations), it is appropriate for the one to respond to the acts of the other, as the Empire of Atlantium has. The gens Martiana asserts that as an entity in international civil society, Nova Roma has every right, indeed it has the duty, to formally express its outrage regarding the depredations of Al Qaeda. As a gens of Nova Roma, Martiana aspires to begin that process by calling upon the Senate of Nova Roma to act.

Mode of Voting in the Gens Martiana

Lex

As the gens Martiana now consists of three familiae, with the potential for more to join us in the future, the gens now considers whether voting should be conducted by individual members of the gens Martiana or by familiae, and if by familiae, whether we should require a majority in all familiae or only a majority in a majority of the familiae. Also, in any of these cases, specification of a quorum shall be specified.

On Idus Quinctilis, MMDCCLVIII ab urbe condita, Sol XI Simhae anno Martis CCX, the following votes were recorded:

1. Mode of voting:
     8 a. Per personam. Half of the gens members shall constitute a quorum. However, a motion shall fail on a tied vote.
     1 b. Per familiam. Half of the familia members shall constitute a quorum for each familia. The pater/mater of each familia may cast a tie-breaking vote.

The result of this measure was determined by a majority of the gens members, a quorum of seven being required.

2. If the mode of voting is per familiam (1.a.--do not make a selection here if you vote for 1.b.):
     1 a. Maior pars familiarum (example: two out of three familiae voting in favor carries the resolution).

To expand the Martiana pantheon beyond the present Mars and Victoria. It is proposed that two female and two male deities be added, and that Martianus Minneus Felix Capella be adopted as the household lar, for a total of seven places of honor in the Martiana pantheon.
