PART II - TERMS APPLICABLE TO SHAREWARE VERSION

GRANT

You are hereby licensed to:

  1. Except as otherwise expressly provided in this EULA, use the PASSWORD to install, use, access, run, or otherwise interact with ("RUN") only one licensed copy of the SOFTWARE PRODUCT on the COMPUTER. The fully-licensed SOFTWARE PRODUCT may not be installed, accessed, displayed, run, shared or used concurrently on or from different computers, including a workstation, terminal or other digital electronic device;
  2. Make a single back-up copy of the PASSWORD. You may use the back-up copy solely for archival purposes. Except as expressly provided in this EULA, you may not otherwise make copies of the PASSWORD.

You are specifically prohibited from:

  1. Charging, or requesting donations, for any such copies, however made, and from distributing the PASSWORD with other products commercial or otherwise without prior written permission from ABLE;
  2. Modifying, translating, reverse engineering, decompiling, disassembling (except to the extent applicable laws specifically prohibit such restriction), or creating derivative works based on the fully-licensed SHAREWARE;
  3. Copying the PASSWORD other than as specified above;
  4. Renting, leasing, granting a security interest in, or otherwise transferring rights to the PASSWORD;
  5. Because the fully-licensed SHAREWARE and the PASSWORD are a single product, separating the password from the SHAREWARE, except as otherwise expressly provided in this EULA.

TITLE

Title, ownership rights, and intellectual property rights in the PASSWORD and the fully-licensed SHAREWARE shall remain in Able Ebooks and/or its suppliers. Copyright laws and treaties protect the PASSWORD. Title and related rights in the content accessed through the PASSWORD is the property of the applicable content owner and may be protected by applicable law. ABLE or its suppliers own all title and intellectual property rights in and to the PASSWORD and the fully-licensed SHAREWARE (including but not limited to any images, photographs, animations, video, audio, music, text and "applets" incorporated into the fully-licensed SHAREWARE) and any copies of the PASSWORD or the fully-licensed SHAREWARE. This EULA gives you no rights to such content. This EULA does not grant you any rights in connection with any trademarks or service marks of ABLE or its suppliers.

TERMINATION

The EULA will terminate automatically if you fail to comply with the limitations described herein. On termination, you must destroy all copies of the SHAREWARE, Documentation, if any, and PASSWORD.

PART III - DISCLAIMER OF WARRANTY

THIS PASSWORD AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the variety of hardware and software environments into which the fully-licensed SHAREWARE may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.

Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE. NEITHER THE AUTHOR NOR ABLE EBOOKS SHALL BE HELD LIABLE FOR ANY KIND OF DAMAGES OR CLAIMS THAT DIRECTLY OR INDIRECTLY RESULT FROM USING THIS FULLY-LICENSED SHAREWARE OR PASSWORD.
