Hi there..
I am posting this all on a website because I feel that the Seller involved is wrong. He continues to take advantage on “new” ebayers in particular.
I have been accused of: “Defamation of Character” by this man. Although he has made numerous fraudulent sales I have been more than nice to him.
This person should be investigated and all the people who have written to me I thank you. Keep in mind that anything over $200.00 is a felony. If you feel that you have in anyways been taken advantage of you should contact your local police department and file a report.
Seeing as a majority of these transactions are: Garbage Pail Kids Cards. And seeing as the same excuse had been given to us all. The excuse that “we didn’t choose insurance” meant that our items were not covered and that was our fault.
I have dealt in the past as a Seller and a Buyer and I can happily say that all but one item was delivered. The 1 that wasn’t was actually lost in the mail. How I know this? The packaging was torn and resent to us by the USPS.
I feel it is impossible for this many packages of the same item to be “lost “in the mail.
Let’s do something about it. If Littlegiant2 doesn’t want to comply to our request, and wants to be really unprofessional as far as out remarks against him go. And Ebay doesn’t want to investigate. Then I think it is time to write our local Newspapers…Editorial
Thank you for all of the support. Melanie :)

I originally had gotten involved because one of my friends who was new to Ebay had been taken for over $240.00. I had only wished she told me ahead of time what was going on. I immediately started writing this Seller and after finding I was not going to get anywhere with him I started writing the other Buyers who had posted negative ratings against this man. What I had received for responses was amazing. Here are my letters and the responses I had received to date. I am only hoping that others will send me their stories so I can post them also.

3/23/02 Letter to Little giant2
Back in January of 2002 a payment was sent to you via money order. It is against Ebay policies to not come true to your end of the transactions . I know that you have been contacted on more than one occasion and the person I am writing for may not know what to do from here but I do . I am very willing to help her along in flowing up on this transaction.
The items involved were :
1063636469
1063636763
1063636996
1063637790
1064973267
1064398872
1064482413
1064215896
These are all for Garbage Pail cards. I will be more than happy to report you for fraud . I have the receipt in hand from the person you had received it from . It shows it has been cashed . I se you have no negative ratings which makes me wonder if this is the first time you have done something like this but noone was able to catch up to you . Your lack of providing the correct information to the person you sold these items to is also questionable. She had asked for the item numbers at hand and you never gave them to her . Which only goes to show the unprofessionally that you have .
You had contacted her over two weeks ago stating that if she had not received them by Wednesday of that week you would resend them . Which probably meant you had extras at hand or maybe never sent them at all .
I from here on will take the matter of this transaction over. It has gone out of her hands and into mine . She is new to the Ebay community. However I am not .
If I don't hear anything from you within a 24 hour period I will report you to fraud and leave negative feedback for all of these item numbers.
I have been told that they would still like these cards. However if you don't have them you should just send back the money .
Fraud is illegal and can lead to imprisonment in some cases.
You taking the money and running is fraud and I think you should think . I am not a newbie and I am not inexperienced ...
In fact if you want to send them I think an overnight delivery would be good and I would like them sent here :
MY ADRESSS WAS ENCLOSED HERE.

hello, first of all the items were shipped after payment was received, therefore we never violated any ebay policies.second of all,on march 8th i replied that said items were shipped and to let me know if they didn't arrive.then i receive this email 2 weeks later making all kinds of unwarranted threats and accusations and when i just got in also checked my messages on the answering machine and caller i.d. and noted you called at 2:45a.m.-----2:45a.m.!!first of all i think calling someone at that hour is not very professional to say the least especially when no attempt was made during normal daytime hours to contact me.now let me tell you something,i will not tolerate unwarranted threats for shipped items and am sending your unprofessional email to ebay..i don't care who you are!!the items were shipped-priority mail.as a courtesy the shipping was combined and insurance was optional and not placed on the package.we offer insurance and it is up to the customer to pay for that service if they choose to do so,tracy did not!!we clearly state we are not respondsible for lost, damaged or misdirected packages if insurance isn't placed on the package.we gave a combined shipping rate and the insurance was optional as stated and not taken!!out of courtesy i stated to let me know if the package didn't arrive and i'd proceed from there.we sell hundreds of items weekly and have a large inventory and have more than 1 item of just about everything we sell and highly take offense to your accusations that we may never have sent them at all.we have a 5800+ rating and didn't get that by not shipping items!!i also will not tolerate your unwarranted threats of leaving negative feedback for shipped items and will make ebay fully aware we are not happy with this transaction and your unprofessionalism and unwarranted threats and may reflect that in your feedback (XXXX)if we choose to do so.i would also be very careful of your unwarranted threats of reporting us for fraud!!just who do you think you are??again, the items were shipped, understand??also we keep excellent records and have all item #'s stored for reference,so your comment about not providing information is just plain silly and stupid.the items were paid for and shipped so if a customer pays,i would assume they had that information and if requested, there would be no problem providing it.we never received a request.now let me tell you something, you make repeated references to fraud and i will not tolerate this especially when items were sent.if you continue to imply this i will turn this matter over to my lawyer and proceed with defamation of character suit against you and again i don't care who or what you are.you of all people should know about unwarranted threats and slanderous accusations.since you are claiming to be a professor of law you of all should know what an unwarranted claim of fraud and slanderous remarks can result in.i will expect an immediate apoligy for your unwarranted and slanderous accusations against me and my company.this is not open for discussion and i won't tolerate this from you or anyone.now i will seriously rethink my courteous reply and very professional response stating to let me know to tracy and about resending a 2nd shipment.since insurance was never taken and we clearly state we are not respondsible if it is not,i am under no obligation to resend something that was already shipped out.while i feel your intentions were good in helping someone, your accusations are very unwarranted and offensive and have only resulted in alienating me.if you are indeed a professional person you have a lot to learn about proper communication and courtesy.we've been in business over 25 years and again won't tolerate this unwarranted garbage.i will await your apoligy for the unwarranted email and then make a decision on if i feel sending a 2nd shipment is warranted as i am under no obligation to do so after sending the initial shipment as our policies were clearly stated.i look forward to a more professional response and then will decide if i will extend professional courtesy to xxxxx or not.i am not some college kid that you can make unwarranted threats and accusations against and again won't tolerate it or a complete lack of professionalism on your part.i hope i have made myself very clear and in case you still need to hear it again----the items were shipped!!hank -----------------------------------------------------
3/24/02 response from me
Hello Hank,
I am sorry I did not write back to you sooner. As for the phone call at the hour it was made I will apologize only for at this moment. We are in different time zones and I did not realize what time it was in your area.
I had XXXX print me up all of her emails between the transactions and there are two in question. On January 20,2002, you had quoted her a shipping price of $12.00.
On January 26,2002, you had quoted her $15.03 for shipping.
In no place do you even mention Insurance as an additional option.
Your auctions do not even mention Insurance as a preventive measure in case something were to happen within transit of the package.
We have sold with Ebay and after 1 incident we started charging an extra .40 for delivery confirmation . Is the package you sent to Tracey equipped with this feature?
If so is there a tracking number?
I am not going to argue about your thoughts of "i will turn this matter over to my lawyer and proceed with defamation of character suit against you and again i don't care who or what you are"
As I see it still the information was vague and if you look at it also you will to see that there must have been a part of "miscommunication" on this issue . I have not seen anywhere that Insurance was an option. In fact when you sent her a total I would have thought after sending a second one at higher rate that this included insurance. At least not with these transactions . I went and checked each one after you wrote me once again to double check and make sure that I did not miss something.
As of this date the cards have not been received and a money order had been cashed . You quoted her 2 different shipping costs and she paid you the higher of the two . Most people would not. They would take the lesser.
I will be more than happy to send you copies of these letters. But you being a "business man" you should have record of all transactions for the last 90 days at least.
So if you do need copies please let me know will as I said gladly send them along .

3/25/02 response from Littlegiant2
hi,i gave both shipping rates-the first was quoted for 1st class delivery-i have a combined shipping rate that goes like this(1st class---12.00--3.00 for initial set and 1.50 for each additional set=13.50,but i charged her 1.50X8 sets=12.00) which we usually use and when i emailed her a few days later i gave her the priority mail rate-priority----(3.50 initial set and 2.00 for each additional set=17.50,but i charged her 2.00X8 sets=16.00 and then reduced it even further to 15.03 to round it out to an even figure for her payment---240.00 total.shipping rate by first class=238.47--adjusted rate to go priority 240.00---it's clearly plain to see that based on the two options, priority was the fastest and best way to ship combined items as it was not much more.every after auction notice we sent had the insurance option available, check the end of this email(if you read it carefully, you'll see it's very detailed and specific about our policies)-i copied and pasted one of the originals-and we have copies of all the correspondence we sent or received on file and each notice plainly states we strongly suggest insurance be taken out on any purchase.it wasn't taken.we do not place either delivery confirmation or insurance on packages unless we are asked to do so at additional cost.although it is only .40 for confirmation--we sell around 300 items a week--multiply that by .40=120.00,then multiply that by 52 weeks=an amount well in excess of 6,000 dollars a year.although .40 seems trivial-it's not on a volume level.that's only for confirmation-insurance being placed on packages without customer paying for it would bring that figure up to between 15,000 to 20,000 dollars per year additional costs.i believe you'll agree that is a substantial amount of money.although i sympathize with you that the package hasn't been received,it indeed was shipped and should have been there long ago.it has not been returned to us,but if for some reason it is,i will resend it.thanks, hank

Hey Hank....You have over 9 people claiming they didn't get these cards. One day you give one total ..another day you give a different one ....
Smells really funny to me ..
Face it .. you are a fraud ...you screwed up and the only way to fix it is to become honest .
Send the emails to ebay ...
You pick on the new members as if they are stupid and when someone leaves a rating you don't like you slam them .. how can all these people be wrong about this one type of cards ...
A real business man would own up to it ..
Send the cards and be done with it .. I have never lost anything in my whole time as a yahoo'er or ebayer...I don't charge for insurance because insurance doesn't cover shit .. It's an extra $2.00 in your pocket ...
.
You lied ..you cheated .. you pay the piper .. it's how it goes ..
OH by the way .. these are the emails we have .. Check the dates... Compare them and let's see whose match .

you seem to like to make unwarranted slanderous statements alot now you can deal with the forthcoming actions resulting from this.your items were shipped and i am an honest businessman.i gave you the courtesy of combined shipping on your items and now you're trying to say something else.i didn't lie or cheat anybody.i shipped your items long ago.i've watched your email tone change from one claiming to be a legal professional to this one starting to use vulgar language and showing you for what you are.if i'm correct you're a college student that's angry at themselves because they opted not to place insurance on their package and now that it didn't arrive and is out there somewhere, you need somewhere or someone to put the blame on.i stated before i wouldn't tolerate this garbage from you or anyone and i won't. you can now deal with the legal results of your unwarranted slanderous remark, hank

March 25 me
I don't believe I was in any way vulgar and I am in the process of getting ahold of all the negative feedback givers you have gotten, a great number of them are for the SAME items.
We will be taking this matter to EBAY, and also to the authorities as anything over $200 is a Felony.
Your emails are vague at best, and I think you will find that legal action is going to be difficult as the amount of evidence against you is substantial. I have taken the liberty of copying all the appropriate feedbacks to word processing documents so that we have a hard copy of them in case of retribution. To be honest, I think your upset because we are the few people who have been determined enough to take this a step further.
Nice to see that you have your ratings private now . If you have nothing to hide why would you do that ?

Letters to Ebay and responses:
Hello,
Thank you for writing in and letting us know of this difficult
experience. Fortunately, there are avenues you can explore for
resolution both through and outside of eBay.
As you mentioned, fraud reports can only be filed between 30 and 60 days
from the end of auction date. However, a fraud protection claim can
still be filed up to 90 days following the end of an item listing.
Although you're not eligible to use eBay's online fraud reporting system
in this situation, you can still file a fraud protection claim if it is
under 90 days from the date the item listing ended. Under the eBay Fraud
Protection Program, most items on eBay are covered for up to $200 (minus
$25 of the item price).
Here's an important link to read more about our fraud reporting system
and a fraud protection claim:
http://pages.ebay.com/help/community/ins-guide.html
Before you resort to filing a fraud protection claim, we suggest that
you request the seller's contact information and give him or her a phone
call to see if this issue can be resolved amicably. eBay encourages open
and honest communication, and we believe that such issues can often be
resolved with a conversation. I've included a link below that will help
you to request the seller's eBay registered contact information as well
as provide other options available (sited below) to you to help resolve
this situation:
http://pages.ebay.com/help/rulesandsafety/43110001.html
· File a Dispute Claim with our online mediator Square Trade.
· Contact the NFIC (The National Fraud Information Center).
· File mail fraud charges
.
If your attempts to resolve the situation are unsuccessful, you can file
a fraud protection claim by filling out the form at the link provided
below to mail it to eBay Claims Administration within 90 days of the end
of the auction:
http://pages.ebay.com/services/safeharbor/frs-claimform.html
Leave the space on the claim form blank that asks for a claim number and
be sure to include all of the following:
1. The completed Fraud Protection Claim Form.
2. A copy of the end of auction notice or a copy of the auction page.
3. Proof of payment, i.e., photocopy of the front and back of money
order, cashiers check, personal check, etc.
4. Any other supporting documentation
Please mail the above documents to the following address:
Fraud Protection Program
Attn: Claims Administration Dept.
P.O. Box 188
Draper, Utah 84020
If you paid by credit card, you will need to contact your credit card
company as many have protection against these types of problems. If your
credit card company denies your request for reimbursement, please
forward that information with the other documentation of your claim to
the Fraud Protection department.
Once our Claims Administrator receives your claim, they will review the
documentation, assign a claims adjuster, and contact you regarding your
claim usually within 45 days of the receipt of the above documents. You
will then be provided with a contact email for the claims adjuster
assigned to your case. You may address any questions regarding the claim
directly to the claims adjuster assigned to your case.
Again, thank you for writing.

Riley

My response seeing as my 90 days was up the 26th and this was sent to me on the 27th …My 90 days were up at this point.
Well 90 days is the 26th of this month and I guess that I missed out on that
too .He took me 240.00 and He has taken many others . His user id is
Littlegiant2 ....He is now under privacy .. and now noone can see his
ratings .
I really wish there was a way you can get rid of people like him .Darchel's
Farm is the same way . I had problems with them and they are both nasty .
Even if you leave a nuetral rating .. It is demeaning how they pick on New
Ebayers and because of it these new people will find elsewhere to shop .
Does that make it fair to sellers like me who is more than accomadating to a
customer, More than willing to resolve issues without being vulgar . I have
letters from numerous ebayers concerning this LITTLEGIANT2 .. He steals ..
he lies and cheats .. then he makes sure the time period in which to dispute
or file a claim is up before you get a chance to file .
I really want this guy to pay for his actions .
I was shut down beacuse I
let someone use my user ID at one point .
While away on vacation he bidded
on a few things .
When I questioned him he told me he didn't want a few of
the items anyways . Well it's a binding contract and I tried to reason with
the seller and they would not give in .
I WAS SHUT DOWN WITHIN 3 WEEKS....
but this guy can still do what he's doing ?????
Please could you explain to me exactually where the fairness is in this??
Their reply on March 28th
Hello,
I appreciate you notifying SafeHarbor with your concern regarding seller
"Littlegiant2".
As a venue for buyers and sellers to meet, eBay has limited legal powers
to become involved in a buyer and seller dispute. eBay will only take
action on our site as described in the third section of our user
agreement. You can view this page by using the link I have provided
below:
http://pages.ebay.com/help/community/png-user.html
This means that we cannot mediate, make decisions for a member, take
sides, reimburse a member, force a member to live up to their obligation
after the end of the auction, or initiate a criminal investigation
against a member.
Please be assured that we will be happy to respond to any questionable
activity that occurs on the eBay site such as registering, bidding,
listing, and board postings. In addition to reporting fraud to eBay, you
may also want to report fraud to law enforcement who will be able to
better assist your needs based on their authority. Although we
sympathize with your situation and certainly understand your
frustration, we are unable to act as intermediary or mediator in these
situations, legally eBay must remain neutral.
Aside from taking possible disciplinary action to a member's account,
which we do according to established protocol, eBay cannot initiate
contact for a member or initiate formal proceedings against a member.
From a legal standpoint we can only suggest options that you may take
action on. If you are unable to resolve this issue with the other
member, you may want to file a fraud report with the National Fraud
Information Center at www.fraud.org.
This organization is a primary contact for reporting internet and phone
fraud. Their internet site is equipped to help you with any questions
you may have about the fraud reporting process and is even set up to
allow you to process your complaint on-line.
In extreme cases, you may also want to consider contacting authorities
in your area and where the seller resides. If you choose this option, we
will gladly help Law Enforcement with any inquiries they may have.
Please have the investigating officer contact us at safeharbor@ebay.com
with the following information:
1. The case number
2. The officer's name
3. The officer's telephone number
I appreciate your patience and understanding regarding this matter.
Kind Regards,
Caleb

Well my feeling on this is Ebay is supposed to investigate these matters. However, in cases like ours we are supposed to do all the leg work . There is something wrong here.
