It has become necessary for the people, of the United States of America, to come forward to plead with our elected officials about the issues of injured workers and the workers' compensation system. American citizens, who are injured, suffer terrible inhumane treatment. Rights, Life, Liberty, Justice, the Pursuit of Happiness and being Free are infringed upon and in jeopardy, for the people of the United States of America.
The United States of America is ‘Democracy’, a government in which the people hold supreme power and social equality. The current laws support ‘Dictatorship’, a tyranny of ‘abuse of power’. Jeopardizing the security and future security of the people and this country.
The United States Government is for the whole, all people, yet laws are continuously passed to favor businesses, corporations and professionals. Creating more "abuse of powers" over the people.
Regardless of the state, the current workers’ compensation systems and laws destroy American lives. Creating a long list of devastating damages to individuals, families, society, future generations and our entire country.
American citizens are deprived of our country's rights, liberties, "laws of nature and of the nature's God entitled them".
Our tax dollars are used to rebuild and care for other countries, while the citizens of the United States suffer.
* When a person is injured, an all out attack is waged against the injured worker, by many employers, workers’ compensation doctors, insurance companies, lawyers, government offices, the media, co-workers, society and our very own government.
*Within the workers' compensation system is a multitude of offices and people to cause harm to the injured worker, American Citizens. The multitude of offices and people, conspire to commit fraud, to lessen their liability. Knowingly and willingly providing false information, incomplete and misleading information, for the purpose of committing fraud.
* There is no "equal protection" of the law. The people are cut off from being protected by the law or enforcing the law.
* The current workers' compensation system, are "prejudiced and biased", in regard to workers' compensation doctors, medical treatment, medical records and justice, causing repeated injuries and altering lives to loss and destruction.
* Proper medical care is not given or completely denied, to lesson the liability to workers' compensation insurance companies, businesses and corporations. Needed surgeries are postponed or completely denied. Causing further inhumane suffering and damages to the people.
* Injured workers are forced, in inhumane conditions, to continue working with injuries, without proper medical treatment and care, causing great suffering, compounded injuries, permanent disabilities and diseases, such as RSD, Fibromyalgia and arthritis, to name a few.
* Injured workers are "discriminated" against. Discrimination of age and disabilities.
* Everything possible is done to discredit, punish, ruin, discourage claims, prevent and deny benefits, medical care, terminate employment and means of financially supporting self and family.
* Injured workers are written up, harassed, degraded and threatened. Co-workers are incited against the injured worker. Medical records and personal information is released and discussed, by employer staff, to other office personnel, management, and co-workers of the injured worker. To people whom have no need to know, such information.
* Employers refuse to honor work restrictions, if even given by workers’ compensation doctors.
* Employers refuse to allow necessary doctor appointments. Employers control when and if, doctor appointments are made. Even when the doctor states to return or as needed.
* When employers are in charge of making the doctor appointments, for the injured worker, it is to terminate the injured worker. Appointments are made to use up days an employee is allowed to take for the year. Once, the days are used up, the injured worker is terminated. Appointments made by the employer, are not made at reasonable times. Appointments, when allowed, are made to use up the most time, for days off.
* Employers put injured workers on jobs that are too difficult to physically do, to punish and force the injured worker to quit. Being placed on jobs too difficult, if the injured worker can not keep up their work rate, the injured worker’s employment is terminated.
* When the employer causes further physical damage to the injured worker, worsening or compounding injuries, the injured worker is terminated for being a liability.
* Employers refuse disability forms and other benefits, in which, the injured workers are entitled, including benefits paid for by the worker.
*Injured workers are left with no or poor medical treatment. Workers’ Compensation insurance refuse payment. Private insurance companies won’t pay for work injuries. State insurances won’t help. Medicaid and Medicare is denied. An injured worker is told they have to pay out-of-pocket. With the extremely high cost of medical care, it is impossible for an injured worker to pay out-of-pocket.
*Seriously injured workers, whom can not work, are cut off from any financial means of supporting self and family. It is a long battle, which may take years, to try to get workers’ compensation insurance payments, privately paid long term disability, or social security.
*Government offices, refuse help and favor employers, insurance companies and doctors. Including but not limited to, Labor Boards, Workers’ Compensation boards, medical boards, equal employment opportunity commission, district attorneys, fraud investigation commissions, and social security administration. Legislation favors employers, insurance companies and doctors over the people.
*Physically, financially, emotionally and mentally the injured worker is left with tremendous suffering and damages.
*Injured workers lose their health and homes. Many are forced to go hungry and have utilities disconnected. Suicides are committed from the overwhelming pain, loss of health, their homes and ability to earn a living. Lives that have been changed and destroyed.
This is the United States of American. The workers’ compensation system is against everything this country stands for and the people. It can not be allowed. The grave injustice and inhumane treatment, to the people, abuse of power, loss of rights, liberties, freedoms, and life, must be stopped. The prejudice and biased, workers’ compensation system, must be changed.
We the people, of the United States of America, petition the United States Legislation, elected officials, to stop the tyranny and tremendous inhumane treatment to injured workers, the American people.
Setting forth our American Rights', as a Democracy and free country, we demand these rights and changes:
*Injured workers shall not be forced to see "prejudiced and biased" company or workers' compensation insurance doctors. Injured workers shall be able to see their own personal doctor or doctor of choice. Medical treatment shall take precedent over the greed of fighting about money. The company and workers’ compensation shall have their own doctors for a second opinion only.
*For fairness, both sides shall submit “Independent Medical Expert” findings.
*Personal insurance, shall have to pay for medical examinations and treatments, the same as for, any other medical reason. With a clause that they will be reimbursed by the workers’ compensation insurance, shall it be found to be work related. At present, neither insurance, personal or workers’ compensation, has to pay for necessary medical.
*If, a person, does not have personal insurance, workers’ compensation shall have to pay and not deny medical care, to the doctor of the injured workers choice.
*If, fraud is committed, by a person claiming a work injury, they shall be punished by law and made to repay medical. Fraud being that a person is not injured or did not get injured on the job, to gain money. Fraud notbeing the disagreement of the doctors or insurance companies.
*Benefits shall not be withheld, for any reason, by workers’ compensation insurance when an injured worker’s personal doctor or doctor of choice, states the injured worker can not work. Immediate payment shall begin.
*When an employee, has a personal paid insurance policy, to include, but not limited to, a long or short term disability policy, employers nor insurance companies shall be allowed to withhold forms nor benefits.
*The Social Security policy, for “dire need”, shall include the injured worker.
*Present policies of overlapping insurance payments, shall remain in force.
*OSHA shall investigate work injuries, talking with employee, employer and visiting site where injury occurred. Safe work places must be provided for the citizens’ of the United States of America.
*EEOC, Equal Employment Opportunity Commission, shall immediately investigate the discrimination towards injured workers. In regard to, but not limited to, harassment, punishments, write-ups, and degrading of injured worker.
*Injured worker shall not be terminated for having a work injury or disabilities.
*When private investigators are used by the employer or insurance companies, rights and benefits shall not be withheld or denied, without a hearing.
*An injured worker has the right to justice and equality in the courts. Injured workers and Attorneys hands shall not be tied, to prevent justice and equality. There are no frivolous cases when it comes to a person being injured.
*In the event of fraud, to lesson or deny liabilities and benefits, in regard to work injuries, employers, workers’ compensation insurance, or workers’ compensation doctors, shall be investigated, held responsible and punished the same as an employee committing fraud.
We, the people, set forth these grievances and demands, to preserve our rights, liberties, justice, equality, the pursuit of happiness and freedoms. The losses and inhumane treatment to the people, must be stopped.
