Their case against owner Bob Lin's plans to raise the rent at the 113-lot Lakeview park on West Discovery Street was to be decided by the San Marcos Mobilehome Rent Review Commission Tuesday evening. The meeting was canceled, however, after both sides requested a postponement to try to settle the dispute, according to the city clerk's office. Although Lakeview residents and Lin have been feuding since August, rent disputes are rare because residents and owners are generally cooperative, city officials said. The commission has not had to settle a dispute in three years. "They (residents and owners) have been working together reasonably well," said Councilman Mike Preston, who along with his four colleagues on the City Council are members of the Rent Review Commission. The Lakeview dispute began when Lin, a Seal Beach resident, announced he would be raising the park's rent, which ranges between 319 and 429 a month, by 40 to offset the cost of maintenance. The residents say the increase is unjust and Lin has not kept the park well-maintained. Lin said the increase is necessary and the park is in good condition. If the sides don't reach an agreement, the council will set another hearing date for the commission at its next council meeting on Dec. 14. The commission has not held a settlement hearing since December 2001, according to the city clerk's office. During that hearing, a request from the owner of the Villa Vista Mobile Home Park to raise rents there by between 23 and 38 a month was rejected by the commission. Preston said he believes a reason that rent dispute hearings are rare is that more of such parks are being converted from private ownership to ones owned by residents. Of the city's 18 parks for mobile homes, seven are owned by residents, seven are privately owned and four are owned by nonprofit organizations. Resident-owned parks are rent free, while rent increases at parks owned by nonprofit organizations are generally lower than privately owned parks, city officials said. A park owned by a nonprofit organization is a place where homeowners don't own their lots, but the organization is required by the city to keep rent increases low and to give residents some control over park maintenance. Nonprofit organizations are allowed to increase rents annually, but not higher than 75 percent of the year's consumer price index. In a privately owned park, owners don't have set limits for annual rent increases and are not required to give residents a say over maintenance issues. Private owners do not have to follow the price index guidelines for an annual increase, but residents can challenge the raise if they don't feel it's justified. If an increase is challenged, the Rent Review Commission makes the final decision. Pam Jordan, a 10-year resident of Lakeview, located south of Restaurant Row and San Marcos Creek, said she believes the park is deteriorating to the point that she is embarrassed to invite friends over. "It's kind of run-down," Jordan said. "Mr. (Bob) Lin, the owner, hasn't done any of the repairs at the park. He doesn't fix the things we ask." Jordan said weeds need to be pulled, mold on the clubhouse roof needs to be removed and the clubhouse roof needs to be made leakproof. Other residents, such as Virginia Cotton, who has lived at the senior citizens' park for three years, said the park's gardens are not well maintained, and trees and a row of 20-foot high oleander that line the front of the park on Discovery Street need to be trimmed. Cotton, who is vice president of government affairs for the San Marcos Mobilehome Residents Association, an umbrella organization that represents mobile home park residents citywide, said the park's manager, Bob Nieto, is allegedly rude and unresponsive to the residents. Nieto could not be reached for comment, but Lin said Nieto was the best manager he has had at the park since he purchased it in 1986. Lin said the park is well-maintained and the rent increase is reasonable. Lin said the last time he raised rents was in 2001, when rents rose 17 a month.
