Ours is the most literate state in India, we call it “Gods Own Country” certainly we are rich in all walks of life, our legislations are beyond comparison. Kerala has given necessary recognition to all sections and groups of people but all the while, we have forgotten a very important group who contribute to sixty percent or even more income to the state economy, you have guessed it correctly, ITS THE NON RESIDENT KERALITES or for short the NRK’s. They include casual labourers, white collar employees, and businessmen who work outside the country mostly in the gulf sector.


Think about the sourly experiences you had when you visited your home land. Imagine the harassment you face as the law for resident keralites does not consider the problems which a no resident face due to his residency status. There problems are heavy, some are even scared of coming back to their home due to legal & administrative bottlenecks, Our laws aid the residents to those who contribute to the bulk of the income to the state economy, NRK’s are treated like second grade citizens for the purpose of extracting money even though he is the back bone of the economy; he is compelled to pay more for his needs. They spend sleepless nights due to the legal problems faced by them or their dependents back home.


Compared to other countries who provide special privileges to there non residents when they return home, our state legislations are week and insensitive to the vast majority of Malayalis who sweat their whole life for there families back home. Hypothetically speaking what can a non resident do if there is a property or a money dispute between him or his dependents and a resident, those who have gone through this would know that it’s a disastrous situation, you have to either issue a power of attorney to someone else or come the court when ever called upon which is highly impractical, now you might ask what can be done in such a situation ……..infact a lot can be done. One quick solution to this problem is speedy trial. A lay man always has the impression that courts take up much time for its decisions but the truth is, the delay is actually caused by procedural bottle necks. So, can’t we put it into a statute that if one of the parties are nonresident the trial should not take more than one month or a appropriate period then these procedural delays will be gone.


There are lots of similar situations which will surely come up when we go deep into the issues. As I said earlier to overcome these problems it is necessary that a comprehensive legislation be enacted which would address the problems faced by NRK’s. Only by forcing the government to enact laws which would be friendly to the NRKS we can over come the problems.
