JUDGE GAITHER'S SECOND AFFIDAVIT CONCERNING HIS INVOLVEMENT ON BEVERLY BRABHAM'S CASE

(Note, in particular, the last statement in this Affidavit.)



This Affidavit was written after Judge Gaither has testified under oath before Judge Smithart in August 1999 that Beverly Brabham was not placed on probation. Judge Burt Smithart and/or D. A. Boyd Whigham lied about Judge Gaither's testimony in Smithart's order after the hearing.

Judge Gaither has made the statement that he was the only one who could have placed Beverly Brabham on probation (after the sentencing Judge suspended the sentence), but that he did not do so.

Judge Gaither has also stated that he is willing to testify under oath before Federal Court that Beverly Brabham was not on probation in April 1999 when Judge Smithart sentenced her to prison on the expired case.
