Refusal of a credit issued by RescueTech Computer Service


In September of 1997 I had RescueTech Computer Services format the hard drive on my computer because it was performing slowly. It took some time and headaches to backup everything so that I wouldn't lose all of my documents. I asked them to install a Tape Drive in it so I could backup my work much quicker and easier. When I got it home and tried to use the Tape Drive to back up my documents it wouldn't work.

I took it back to their shop to have it replaced. When I brought it home again it still would not work. I took it back a total of 4 times with the same outcome. On the 5th time of taking it back the store over a 2 month period they decided to issue a credit to me for the next time I needed their services.

I did not need their services for 4 years. When I brought my computer back to them in February of 2002 to have them work on it they would not allow me to use the store credit they had given me. I even had the invoice they had given me showing the credit!!!! They said that I was to use the credit in the same accounting year that it was issued. I asked them why they didn't bother to inform me of the fact when they issued it to me. They did not have an answer for me.

I argued with the owner of the store for several minutes but they would not let me use the credit they had issued me and was forced to pay the computer work they had done on my computer before they would let me take it home.

Since I had a Pre-Paid Legal membership I called my attorney to get advice from them as to what course of action I should take. They told me to send them a demand letter to them by Certified Mail Return Receipt Requested demanding a return of my credit. I did so. He asked me to call him back in 30 days if they didn't return the money to me.

After 30 days had past I called my Pre-Paid Legal attorney to inform him they had not returned my money. My attorney then sent them a demand letter for me. Below is a copy of the letter that he sent them. The only cost for my legal consultations and the letter was the cost of my membership!!!





Well 2 days later I received a call from the same man I had argued with just a few weeks earler. He asked me "What do we need to do to rectify this situation." I told him to send the money demanded by my attorney as instructed by him or I would file a lawsuit in 30 days as recommended by my attorney. I received the money within a week.

I have been a Pre-Paid Legal member since November of 1984 (over 20 years)!!! I am very happy with the services I've received during this time.
