The Pacifica National Board's first Board meeting to be broadcast over the KPFA Ku channel

Thanks to KPFA, KFCF, and Democracy Now in Exile, the first meeting of the interim Pacifica Foundation Board of Directors will be satellite cast over the Ku band provided by KPFA.

The meeting follows an historic settlement of four lawsuits that forced the embattled Pacifica Board to return control of the Foundation to community control.

The first test of this power transfer will be the telephone conference call meeting of the Board, scheduled for TOMORROW, Sat. 12/29. The meeting will follow the below agenda, and will serve as a test of the willingness of the former majority members to relinquish control.

Peaceniks, socialists, progressives, anti-imperialists, anti-racists and anti-Bushniks, war veterans and retirees, teachers and trainers, students and federal employees -- it's a motley collection that gathered at the eastern edge of Lake Merritt a couple of Sundays ago.

They came in puffy jackets and in Birkenstock sandals with a range of issues and flyers: saving Social Security, promoting Palestinian rights and -- in the case of one earnest couple -- spreading the word that the human race was created by aliens.

But this hard-to-define assembly is united by a common goal -- world peace. So, as they've done every Sunday since the end of September, they brought their candles, arm bands, pins and signs that read "Honor our dead with peace not bombs" or "No military tribunals!" or "No war, no racism."

And a little after 3 p.m., under a menacing sky, the 35-strong group began its peace walk around the lake.

"Being together and being different is really how peace is going to work," said Jane Esposito, whose pacifist dogs, Wrex and Chaos, brandished bandanna-signs declaring "Make love not war" and "No more war."

"I just feel morally compelled to to do this. It's no more complicated than that," said Mark Boynton, 72, a self-described leftover from the Vietnam War and die-hard progressive. "You just do what you can. This is what I can do."

Lake Merritt Neighbors Organized for Peace has had these weekly vigils on and off over the past decade, said organizing couple Beth and Steve Wagner. During the Gulf War, as many as 300 anti-war protesters came out weekly; a smaller group materialized during the Balkans War.

The Wagners were intimidated to march in the immediate aftermath of Sept. 11, but a few weeks later, they announced that the Lake Merritt peace walks would resume. Eighty people came the first week, and 200 showed up when the bombing in Afghanistan began. Since then, the weekly turnout has leveled off at 35 or 40.

"It just seems like a good way to have a place for people to go to meet like-minded thinkers, to register their dissatisfaction with what's going on and as an educational thing for people going by," Steve Wagner said.

The Lake Merritt crew is part of a small society of locals who have decided that the gentle, reflective act of walking is an appropriate way to promote peace. A group, started by a Lake Merritt regular Don Najita, meets at 7:30 p. m. on Wednesdays at the North Berkeley BART station for a similarly spirited trek through town. Berkeley twins Angela and Lisa Porter are in the midst of organizing a cross-country peace walk.

They plan to leave Berkeley with a group of six women on Jan. 21 and arrive in Washington, D.C., in December 2002.

"If I say that peace is the answer, then I guess I have to be willing to live that," said Angela Porter, 37. "One of the things I can do is offer my walking as a prayer. . . . Maybe it will inspire someone."

Pacifists around the country -- from Arizona to Tennessee -- have offered to host the walkers and plan events for them. "The news keeps telling me how people feel about what's going on," Porter said. "I don't think it's representing the views of people who live in the country."

The Lake Merritt perambulators heartily agree: Peace activism is alive around the country and world, but people don't realize it because of skewed media coverage.

"This is what you would call countermedia," Najita said. "We're reminding people that this point of view exists and is still thriving. . . . It seemed like the most public and significant way to say, 'This is what I stand for. What do you stand for?' "

Apparently, many of those driving around Lake Merritt also stand for peace. Several marchers carried "Honk for peace" signs and indeed, the group was trailed by a steady stream of piercing honks and almost no detectable negative responses. Passers-by waved. They stuck up their thumbs. They shouted encouragement. A group on the Scottish Rite Temple steps cheered.

"It's amazing how much support we have," said Ken Meyercord, 57, of Pleasant Hill. "If 10 percent were to get out of their cars and walk, we'd have quite a crowd."

Of course, this is Oakland -- Barbara Lee land -- several said.

Who knows what kind of reception they'd meet with in a different part of the Bay Area or nation. But still, it's uplifting, they said.

"And even if it were true -- that we're isolated," Steve Wagner said, "we have a legitimate point of view, and we have the right to express it."

Beth Wagner likes to point out that though the weather has been terribly wet, the walkers have been rained on only once. "I don't really believe in metaphysical stuff but. . ."

As usual, on the recent walk, the sky remained gray and dour, but the weather held. Then about an hour later, once the orange lights around the lake had flickered on, and the sun was all but gone, the rain began.

The complicity of United States media correspondents in Latin America in the silence that protects those war criminals supported by Washington has never been clearer than this week.

Buenos Aires, Argentina, is crawling with U.S. correspondents, due to the recent upheavals caused by the failure of the dollarization of the Argentine economy that had been imposed by the World Bank and the International Monetary Fund, and led Argentine president Fernando de la Rua to resign and flee.

This week, right under the noses of this overpopulation of North American reporters, a Federal Judge in Argentina ordered the arrest and capture of former Bolivian dictator-turned-"president" Hugo Banzer, for his participation in the brutal alliance of South American dictators in the 1970s known as Operation Condor.

But has a single United States newspaper or North American wire service reported this inconvenient news in English?

No, and through its silence, the North American media -- and its inauthentic journalists, as individuals -- make themselves complicit in crimes against humanity.

For example, how proud can the Washington Post's Marcela Sanchez be, today, of her November 30th puff piece on Banzer's hand-picked successor, Jorge Quiroga, now that Quiroga impedes INTERPOL's extradition warrant against his former boss?

Or, at the New York Times Buenos Aires bureau, where are the official hitmen who pose as "journalists," Larry Rohter and Clifford Krauss, who purportedly are assigned to report the news from this region?

It is as if the arrest warrant comes for them too: they are in hiding from this story.

The Bolivian government, headed by Banzer's former Vice President and protege Jorge Quiroga, continues to give haven to this war criminal, who, according to the evidence collected in Argentina, Italy and Spain, participated in an international plot to detain, torture, disappear and assassinate opposition leaders, and, in those cases where the leaders were young mothers, conspired to kidnap their infant children and sell them on the black market.

This story is hard news, and not only because an arrest warrant has been issued for a former head of State.

The element of this story that gives it currency is how today's regime in Bolivia, and its presiding Viceroy -- US Ambassador Manuel Rocha -- are committing the crime of obstruction of justice.

To Washington, Banzer must be protected at all costs, lest he spill the secrets of the Narco-State and those who protected him as he built it. As a military general, a dictator and a president, Banzer presided over the development of the South American model for the modern Narco-State: the denial of democracy and civil liberties in the name of the "war on drugs," while allowing military and government operatives to control and profit off the illicit cocaine trade; a model that Quiroga and his Viceroy Rocha preside over today.

The international arrest warrant and prosecution of Banzer opens a window to the darkest secrets of the US-imposed "war on drugs": a "war" that requires brutal repression and the prevention of democracy in our hemisphere. Today, Narco News publishes a new translation of various stories from the national daily La Razón in Bolivia's capital of La Paz. To which we add and declare: Those "journalists" who cover-up the hard news about war crimes will be remembered by humanity as war criminals, too.

Action Alert for the Mattole Forest!

Votes are needed for the upcoming March 2002 ballot. Letters are needed now.

Vote YES on Proposition 40 in March, 2002. This Safe Parks initiative authorized by Keeley will give almost $3 Billion to watershed protection and the formation of new State Parks in California. Many grassroots, as well as government agencies, will benefit directly from this bill.

Please write to the Wildlife Conservation Board and urge them to use the money that they recieve from Proposition 40 towards the purchase of the Mattole Forest.

Points for your letter:

The Mattole Forest contains roughly 3000 acres of old-growth Douglas Fir. Globally, very few old-growth stands of this size are still in existence.

The Mattole Valley is the most seismically active area in the continental U.S. It is at the juncture of three tectonic plates, the Punta Gorda plate, the Juan de Fuca plate, and the Pacific Ocean. The proximity of these earthquake faults combined with the high average rainfall (over 100 inches) magnify the instability of these steep hillsides. Logging these hillsides puts downstream landowners and businesses at risk of flooding and physical danger.

Large tracts of low elevation Douglas Fir are scarce in California and provide crucial habitat to a number of rare, threatened, and endangered species. This intact ecosystem is home to Peregrine Falcons, Northern Goshawks, Northern Spotted Owls, Marbled Murrelets, Bald Eagles, and Summer Steelhead.

The Mattole Valley is sandwiched by Humboldt Redwoods State Park and the Kings Range National Conservation Area. To protect this area would be to create a vital biological corridor from the redwoods to the Pacific Ocean.

Federal Judge Throws Out The Death Sentence of Mumia Abu-Jamal.
Police Attack Mumia Supporters.

Facing protest and international pressure in support of framed political prisoner Mumia Abu-Jamal Federal Judge Yohn threw out his death sentence on December 18th 2001. Yohn ordered the state to conduct a new sentencing hearing within 180 days. If the state does not conduct a new hearing Mumia will, according to Yohn's ruling, be sentenced to life in prison.
In earlier sentencing Mumia had been given the death penalty largely based on arguments that he had been a member of the Black Panther Party.
This was in violation of Mumia's 1st Amendment rights. Former membership in the Black Panther Party was used against Mumia effectively.
This is largely because of the way the party was portrayed in the corporate media while the FBI, working with local police departments, carried out a systematic campaign of murder and frame-ups against the members of the Black Panther Party killing 39 members in 1969 and 1970.
While Mumia Abu-Jamal survived that period of bloody political repression in American history, he was later framed up for a 1981 crime he did not commit.
Judge Yohn's ruling, while possibly sparing Mumia the death penalty, did not overturn Mumia's conviction or grant him a new trial based on new proof of his innocence. Mumia could appeal the ruling to the U.S. 3rd Circuit Court of Appeals.
On November 21st Philadelphia State Judge Pamela Dembe also rejected Mumia Abu-Jamal's appeal to have the same new evidence heard in state court.
That new evidence includes the confession of Arnold Beverly to killing Officer Faulkner, the crime Mumia has been framed of committing.
One of Mumia's attorney's, Eliot Grossman, stated that Dembe's decision will be appealed to the Pennsylvania Supreme Court.
As a freelance journalist Mumia exposed the murderous police brutality and political repression carried out by the police against the MOVE organization in Philadelphia.
That murderous repression was then directed at Mumia Abu-Jamal in 1981.
The many supporters of Mumia Abu-Jamal include the European Parliament, Nelson Mandela, the Japanese Diet, the Congressional Black Caucus, The Rev. Jesse Jackson, Sam Jordan (Director of the Amnesty International USA Program to Abolish the Death Penalty), Leonard Peltier, and many unions in the United States and around the world.
In addition protesters for Mumia Abu-Jamal this December 8th were informed by a French delegation that Mumia Abu-Jamal has been made an honorary citizen of Paris by the French City Council. That honor was last bestowed on Pablo Picasso in 1971.
That spirited Dec. 8th Philadelphia protest of 1,000 people in a bone chilling winter rain, was attacked by the Philadelphia police. The Philadelphia police have been campaigning for the execution of Mumia since they first framed him. They stepped up this campaign in an unprovoked attack on Dec. 8th where without warning the police beat protesters sending three people to the hospital.
One of those beaten, Hai Au Huynh, a 100 pound Vietnamese woman, suffered a broken tailbone.
According to eyewitness accounts and video footage dozens of police converged on the protest and attacked the crowd as police commanders looked on. This caused Mumia's legal team to refer to the police attack as pre-meditated.
Eight people were arrested. The total amount in bail was set at the outrageous number of $350,000 which was raised to get all out of jail. Some of that money was raised on generous loans that need to be reimbursed.
Serious charges against Mumia supporters include the felonies of assault on a police officer, conspiracy to riot, and rioting. Charges also include a number of misdemeanors. So far the charges against two protesters have been dropped. The police have not been charged for their crimes.
Coverage by the Philadelphia corporate media has turned events on their head, blaming protesters for the police riot. This is no different from their coverage of Mumia Abu-Jamal that regularly refers to him as a cop killer without giving the real facts in his case.
The frame-up trial of Mumia twenty years ago included the testimony of three eyewitnesses (Veronica Jones, William Singletary, and Robert Chobert) who later said they were threatened, coerced, or made promises by the police to get them to give false testimony against Mumia.
False evidence against Mumia also included a supposed confession to the police by Mumia the night he was arrested. The original police report by Officer Gary Wakshul who was with Mumia the entire time through his arrest and medical treatment stated, "during this time the Negro male made no comment."
Yet Gary Wakshul testified at Mumia's trial that he heard Mumia confess that night. Gary Wakshul didn't "remember" this confession until almost three months after Mumia's arrest when prosecutor McGill met with police asking for a confession. Officer Wakshul absurdly stated that he didn't think the confession was important at the time he wrote his original report.
This past August 17th Mumia was not even allowed into his own hearing in State Court on the incredible excuse that there was no room for Mumia to be transferred to a Philadelphia jail where the hearing was taking place.
Mumia's exile from his own hearing was reminiscent of 20 years ago, when Mumia was barred from attending his own trial. At that time Mumia was convicted in his absence. Judge Albert Sabo claimed that Mumia was barred for being disruptive. Yet court records have now revealed that Sabo barred Mumia from his own trial at the request of Mumia's incompetent and now disbarred defense attorney, Anthony Jackson. The court-appointed attorney made his request on the grounds that Mumia was about to fire him and would if Mumia wasn't barred from the trial.
Sabo's granting of Jackson's request was a clear violation of Mumia's right to legal representation of his choice and of his right to be present at his own trial.
This past May Mumia's attorneys dropped a legal bombshell by submitting into court a sworn affidavit that contains the confession of Arnold Beverly to the murder that Mumia is accused of committing.
The new evidence that both state and federal courts are refusing to hear include the confession of Arnold Beverly who states in his sworn affidavit, "I shot Faulkner at close range."
Faulkner was the cop Mumia is framed for killing. Beverly also states very clearly, "Faulkner was shot in the back and in the face before Jamal came on the scene. Jamal had nothing to do with the shooting."
Arnold Beverly's confession is corroborated by eyewitness statements. Beverly says he was wearing a green army jacket the night he shot Faulkner. William Singletary was there the night of the shooting. He says he saw a man shoot Faulkner and it was not Mumia. He also states that the actual killer was wearing a green army jacket.
Four eyewitnesses, including two cops, put a man wearing a green army jacket on the scene. Five eyewitnesses described a man fleeing the scene the way Beverly describes he did. Mumia of course was not running anywhere, he was lying on the ground with a bullet in his chest.
According to Arnold Beverly, Mumia arrived on the scene after Beverly had already shot Faulkner. Beverly says that Mumia was then shot by an arriving officer. The prosecution claims that Mumia was shot by Faulkner in self defense as Faulkner laid on the ground dying. Yet Beverly's story does fit with forensic evidence and the report of a cop at the scene that night. The cop stated that Mumia was shot by an arriving officer. The downward trajectory of the bullet into Mumia's chest also makes it physically impossible for Faulkner to have shot Mumia from the ground.
In fact, five hours after the shooting a police medical examiners report states that Mumia "was shot subsequently by arriving police reinforcements."
On every level Arnold Beverly's sworn confession to a capital offense is in fact backed up by evidence, while the prosecutions version of events is not This, however, has not been cause enough for the prosecution to reconsider pushing for the execution of an innocent man. Instead they are arguing that the new evidence was not brought forward in a timely manner.
Ramona Africa spoke on this point at demonstration of 3,000 for Mumia on August 17th stating, "Judge Dembe has said she wants, in three weeks, some briefs to determine whether or not it's too late to prove his innocence, whether or not this information comes too late. We're saying it's never too late! What is she talking about, too late?
We aint interested in legalities. We're interested in what's right.
Slavery was legal, but that wasn't right! Apartheid was legal but that wasn't right!
The murder of Shaka Sankofa down in Texas, despite his innocence, was legal but that wasn't right! We don't care about legality. We care about justice and what is right."

In State court Mumia's attorney, Eliot Grossman put forward important legal arguments on why the 60 day limit should not apply to Beverly's confession which was first made in 1999. He pointed out that Mumia's former, and fired, legal team of Leonard Weinglass and Dan Williams misinformed Mumia that they were investigating Arnold Beverly's confession when in fact they never had any intention of presenting it for evidence.
Williams makes this point clear in his new book "Executing Justice" where he states that he doesn't believe the Beverly confession and that he doesn't believe the police would ever frame up an innocent man. These attorneys allowed the 60 day time line to expire without Mumia's permission or knowledge.
Mumia fired Weinglass and Williams after Williams betrayed attorney client confidentiality in May by publishing the money making book, "Executing Justice," purported to be an insiders account of Mumia's case. The publication of the book at a critical time in Mumia's appeal process shows that Williams was not looking out for Mumia's legal interests.
Weinglass also knew the book was coming out, but did not inform Mumia.
This, like their treatment of the Arnold Beverly confession, was a betrayal of the interests of their client and shows that they were not adequately representing him.
In July Mumia's new legal team filed a petition to suspend legal proceedings in federal court in order to pursue these new legal challenges in the state court.
That state appeal is still being pursued as well.
In federal court Judge Yohn has ruled that Beverly's confession is inadmissible citing the Anti-Terrorism and Effective Death Penalty Act signed into law by Bill Clinton in 1996. The act, among other things, sets a time limit of one year for death row inmates to present new evidence.
Yohn echoed the prosecution by falsely stating the "petitioner chose not to present his claim to the state court or even to this court until May 2001."
Yohn's chilling decision also cited the infamous 1993 Herrera decision that proof of innocence is no bar for execution.
These rulings and statements of both Judge Dembe and Judge Yohn, along with those of Judge Sabo before them, are in effect saying that an American court of law is no place for evidence proving Mumia's innocence.
On September 4th of this year Terri Maurer-Carter, an official court stenographer in the courts where Mumia was framed, came forward with more information on the state of mind of Judge Sabo during the trial.
She states in a newly submitted affidavit, "Judge Sabo and another person were engaged in conversation. Judge Sabo was discussing the case of Mumia Abu-Jamal.
During the course of that conversation, I heard Judge Sabo say, "Yeah, and I'm going to help them fry the n______." There were three people present when Judge Sabo made that remark, including myself."
Judge Sabo presided over Mumia's original frame-up trial, but he didn't just do that. He came out of retirement to rule against Mumia at subsequent appeal hearings on whether Mumia got a fair trial. At these hearings Sabo ruled that Sabo had not violated Mumia's legal rights by denying him legal representation of his choice and denying him the right to attend his own trial.
Judge Sabo also ruled for the prosecution against the admissibility of the testimony of a key eyewitness in the original trial, Veronica Jones, who stated that she was coerced through threats from the police into giving false testimony against Mumia in the original trial. Jones was a prostitute who says that the police threatened her with prison on warrants and of taking her children away if she didn't say what the police wanted. She was later arrested off of the witness stand on a petty warrant while she told the truth testifying at the hearing for a new trial.
This testimony was important evidence of the fact that a frame-up had taken place. Yet Sabo did not allow a new trial based on this information or any of the other evidence brought forward.
Another key ingredient missing in the prosecution's case against Mumia is a motive. Beverly's confession, however, does contain a clear motive. Beverly states, "I was hired, along with another guy, and paid to shoot and kill Faulkner. I had heard that Faulkner was a problem for the mob and corrupt policemen because he interfered with the graft and payoffs made to allow illegal activity including prostitution, gambling, drugs without prosecution in the center city area."
The entire chain of police command that "investigated" Mumia have in fact since been removed from the Philadelphia police force for corruption. At the time Faulkner was killed in December 1981, the FBI was involved in at least three investigations of the police in the center city area for corruption including extortion and bribery connected to the mob, prostitution, after-hours clubs, and gambling in the center city area.
Targeted in the FBI investigation were Inspector Alphonzo Giordono, the senior cop at the scene of Faulkner's shooting, James Carlinini, head of homicide, and John DeBenedetto, head of the division where Faulkner worked.
Witnesses and informants in the FBI investigation were murdered. This included a witness who testified against DeBenedetto in 1983.
Police concern that Faulkner may have been an FBI informant could easily have led to his murder. Donald Hersing who was a source for the FBI at the time testifies in an affidavit for the defense that the Philadelphia cops were very concerned about possible FBI informants at the time.
In a similar situation the LAPD Rampart cop who blew the whistle on police corruption and murder in LA was released from prison this summer. He immediately went into hiding out of fear for his life from fellow officers.
Attorney Eliot Grossman stated at a press conference, "Mumia Abu-Jamal was in the wrong place at the wrong time when a hit was in progress on a police officer causing problems interfering with police corruption."
But for the Philadelphia police, he was at the right place at the right time. He had exposed the murderous police violence used against the MOVE organization. Corrupt police officers used the opportunity to kill two birds with one stone.
What we do makes a difference, however. The government's attempt to murder Mumia Abu-Jamal in 1995 was halted by mass protests, including 10,000 people in Philadelphia, and international support. Those actions stopped Mumia's execution within days of it being scheduled to take place.
Continued support for Mumia Abu-Jamal in the streets will be necessary to keep Mumia alive and free him.
Mumia has sat on death row for the past 20 years, removed from his family. Yet he now stands out as an uncompromising voice for the oppressed and exploited.
Many have called him the voice of the voiceless. Mumia stands up for unions, against war, against racism, for equality for gays and lesbians, for the poor, and against the many injustices of the so-called criminal justice system. Mumia speaks up on many of the issues ignored, lied about, or glossed over by the corporate media and the corporate politicians.
We need Mumia, yes we need him alive, but we also need him free. Yet all of the evidence shows that Mumia won't get justice in America's courts unless we turn up the heat.
For protests, teach-ins, and strikes (like the west coast 1998 longshoreman's strike for Mumia) to: Free Mumia Abu-Jamal! Do not reinstate the death sentence!
All new evidence should be heard! Drop the charges against the Philadelphia Mumia protesters!
Charge the police for their crimes!

LORI BRUTALLY MOVED TO NEW PRISON

As the US and Peruvian governments were recessing for the Christmas holidays, we were horrified to learn that when Lori was moved to the remote mountain prison in Cajamarca it was done brutally.

At 3:15 a.m. Friday morning, while Lori and 17 other prisoners were sleeping, more than 30 police in gasmasks and wielding clubs stormed her cellblock, filling the corridor and then the individual cells with tear gas. Lori was overcome by the gas, brutally manhandled, and forcefully removed from her cell. She was carried semi-conscious, wearing only her sleeping clothes (tee-shirt and shorts), leaving behind all her possessions including her eyeglasses, medicines, and shoes. Other women in the cellblock were gassed, beaten, and threatened with rape. Only one other prisoner was transferred (not to the same prison as Lori).

This move was "conveniently arranged" just before the holiday and if it weren't for a friend who visited the women's prison at Chorrillos on Saturday we would not have learned of the "method" by which she was moved or the fact that her possessions were not moved with her, even though she was taken a mountain where the temperature drops to 40 degrees at night.
Peruvian authorities did not inform the US Embassy of the manner in which she was moved and misleadingly insisted her possessions were transported with her.

The Counselor official (who brought Lori's possessions) and Lori's lawyer who visited her on Sunday assured us she is okay except for the cuts and bruises on her arms, wrists, and legs and some lingering effects of the tear gas.

On Sunday, in the presence of her lawyer and a Peruvian prosecutor, Lori filed a "denuncia" against the Peruvian Justice Minister, the director of the Peruvian penal system, the prison director at Santa Monica de Chorrillos Prison in Lima, and other officials for abuse of authority and injury.

In addition to this unprovoked brutality, the Peruvian government once again denied Lori due process. They claim she was transferred for disciplinary reasons. But Peruvian law requires that the prisoner be informed of any infractions and be permitted to respond in defense. This was not done.

Once again, we assume she was moved for political reasons. The move on Friday was followed by media articles again portraying Lori in a highly negative light while not reporting the manner in which she was teargassed, dragged from her cell, denied all her rights, and brought to the mountains.
Justice Minister Fernando Olivera, who announced Lori's move to the media, has learned well from the Fujimori-Montesinos years of bashing Lori that this is a useful mechanism or increasing one's popularity in Peru. In addition, he would have had backing from the Fujimori-Montesinos supporters who still yield much influence within the judiciary, military, police, and Peruvian penal systems.

Rhoda will be visiting Lori this weekend and we will report further on her move and her well-being as soon as we learn more.

HAITI ACTION ALERT: Lift U.S. Sanctions Against Haiti

Last week, 30 commandos attacked the Presidential Palace in Haiti in an attempted coup against the democratically-elected government of President Jean Bertrand Aristide. This is the latest and most serious assault in a widespread campaign of destabilization, including increasing violence, disinformation, and economic sanctions - aimed at destroying democracy in Haiti. It is urgent for friends of Haiti to raise our voices and be heard.

Lift the Sanctions Now!

Upon returning from a recent mission to Haiti, Bishop Thomas Gumbleton deplored the injustices of the international community led by the U.S., which have prevented Haiti from receiving a $146 million loan from the Inter-American Development Bank (IDB). The loan is intended for health care, education and public works. This loan is part of a blocked total aid package of $500 million earmarked for Haiti by international financial institutions.

A letter dated Nov. 8 to President Bush and signed by all 38 members of the Congressional Black Caucus also deplored the unjust blocking of the loan and requested a meeting to discuss aid to Haiti. The meeting has not yet been scheduled nor has the Caucus received a response.

Contracts for the loan were signed by the government of Haiti with the Directors of the IDB who fully approved the loan toward the end of the year 2000. At the point of disbursement of funds early this year the U.S. Dept. of State and Secretary of Treasury, in an unprecedented action, exercised their veto power at the IDB. Since that time the government of Haiti has been fulfilling its interest obligations on the loan (so as not to void the contract) and by the end of 2001 will have paid the IDB almost $10 million for a loan it has not received!

Consider the following:

· The UN has designated Haiti the third hungriest country in the world.
· Average Illiteracy rate in rural areas is 85%.
· Average life expectancy is only 53 years.
· Dental care is almost non-existent; Medical care - 1.2 doctors to every 10,000.
· Infant mortality is 74/1000 births.
· Less than 40% of the population have access to potable water.
· The HIV/AIDS rate is 4% or 300,000 persons (163,000 children orphaned and 30,000 new cases a year).

PLEASE JOIN US EACH WEEK AT THE OAKLAND FEDERAL BUILDING.

Afghanistan shadow over Indo-US ties

NEW DELHI - Indian-Pakistan rivalry in Afghanistan is beginning to cast a shadow over newly revitalized Indo-US relations. Diplomatic observers in New Delhi, like senior US administration officials in Washington, are concerned.

Influential voices within the ruling establishment are asking if it is wise for India, with its 200-million strong Muslim population and important ties with the Muslim world, to join hands with the US in what is clearly emerging, in view of its blind support for Israel, as its continuing war against Islam.

Doubts also persist, despite US rhetoric, about its sincerity in the war against terror. Unfortunately, for India, all this is happening at a time when several meetings between top leaders of the two countries have infused a new life in their relations and India seems to need the US more than the other way round.

An Indo-Pak sideshow has been clearly going on in Afghanistan and it is making the US worried. "As version two of the Great Game is being played out in the killing fields of Afghanistan, Western analysts are watching with great interest the India-Pakistan sideshow that has all the trappings of a regional rivalry," reports The Times of India from Washington.

Sacramento, CA “ The California Department of Corrections (CDC) revealed Friday that it received more than 1000 comments raising deep concerns about the state's plan to build a $335 million prison in Delano. The City of Delano, the California Department of Transportation and Delano residents joined others from across the state in arguing that the proposed prison is a social and environmental disaster.

Last summer, a Kern County Court found the CDC's environmental review of the proposed prison inadequate and ordered the Department to revise its environmental report. In July, the Court also rejected a CDC request to bar public participation in the process, ordering the Department to accept public comment on the new report.

The rulings came in a lawsuit pursued by a statewide coalition of more than two dozen organizations including the Fresno and Los Angeles NAACP, the Delano Center on Race, Poverty and the Environment, the California Chapter of the National Association of Social Workers, Critical Resistance and the California Prison Moratorium Project.

Plaintiffs in the lawsuit were served with the CDC's responses to public comments on the new report on the Friday before the Christmas holiday, eight days after CDC published the report. The CDC said it would not automatically send the document to all persons who filed comments.

In their letters of comment, the City of Delano and the Delano Joint Unified School District argued the mitigation funds earmarked for Delano schools were inadequate. The Delano officials asked for additional funding, noting that Delano's high school was designed for 1,830 students, but currently has 3,555 young people attending classes.

In response, the CDC refused to provide additional mitigation for Delano's overcrowded schools.

The California Department of Transportation and the City of Delano raised further concern about the proposed prison's impact on traffic. Both the Department and the City argued the CDC is required to do a 20-year traffic analysis in accordance with Caltrans guidelines. The CDC rejected the request.

More than one thousand residents from Delano, surrounding Central Valley communities, and throughout the state filed comments, many arguing that the prison is not needed. In October, the CDC revealed that severe budget cuts and empty prison beds might require the agency to close one or more existing prisons.

New felony commitments in California have steadily dropped. And last year, California's prison population actually declined, says Professor Ruth Wilson Gilmore of the University of California. The CDC's most recent five-year prisoner population projections forecast 25,000 fewer prisoners than estimated one year earlier. At the same time, the State forecasts a $12 billion budget shortfall. It is hard to understand how the state can justify building a new prison while also cutting education equity funding for Central Valley kids.

With crime and prison populations leveling off, building another prison now is like building a dam in the desert, says Rose Braz, Director of Critical Resistance. It's a sad statement on our state that plans to build this unnecessary prison proceed, while the state simultaneously chooses to cut education and health care to save money.

Craig Gilmore of the California Prison Moratorium Project notes the CDC waited until the busy holiday week to inform plaintiffs of the report. Gilmore asks, Why is the CDC so afraid of the democratic process enshrined in the California Environmental Quality Act? Why is Governor Davis so afraid of the democratic process that he refuses to permit Californians to vote on whether they want this prison?

In addition to refusing to circulate the report to all who filed comments, the CDC also rebuffed dozens of written requests from Delano residents to translate the report into Spanish. In response to comments noting that many Delano residents have been disenfranchised by CDC's decision to issue the report in English only, the CDC wrote, The government does not have a duty to make itself understood to non-English speakers.

The CDC is scheduled to seek the Court's approval for the new environmental report on January 23, 2002. Governor Davis, meanwhile, has scheduled a special session of the legislature in early January to address the budget crises.

What is cointel.org? It's a voluminous collection of information about the FBI's domestic "counterintelligence programs" against political activists. This is the same webpage I've maintained for about five years, with various internet providers: most recently derechos.net and icdc.com. Please update any links you may have to http://www.cointel.org.

New additions to the cointel.org webpage include 250 more pages from the Church Committee reports on Dr. Martin Luther King, Jr. (107 pages), the Black Panther Party (40 pages), the use of informants (Gary Rowe et al, 45 pages) and the CIA Chaos program (54 pages).

I've also posted Noam Chomsky's Domestic Terrorism: Notes on the State System of Oppression, an updated version of his introduction to Nelson Blackstock's book, COINTELPRO: The FBI's Secret War on Political Freedom (Pathfinder, 1975). Much of the material used in COINTELPRO: The Untold American Story, the report for the UN World Conference Against Racism last September, was drawn from this article.

Below are a few anecdotes I pulled out of these "new" sections of the Church Committee reports, followed by a recent article by Earl Ofari Hutchinson that puts AG Ashcroft's political spying idea into historical context.

While the Church Committe reports are 25 years old and there's nothing new in them, few people have actually seen any of this material firsthand. Now that the reports are available for everyone to read on the internet, I hope they can provide a historical reference point for our current situation.

Yair Khilou, on whose case we have reported in the past already, has been arrested yesterday morning by the military police at his home and brought to the Induction Base in Tel-Hashomer. There he was sentenced to 28 days of imprisonment. Today he will be transferred to Military Prison No. 4 in Tzrifin. For those of you who do not remember the details of the case, here is a review.

BACKGROUND INFORMATION:

Yair Khilou, is a young activist in several radical left-wing groups (including New Profile), and one of the organisers behind the "letter of the twelfth-graders" (a letter to Israeli Prime Minister Sharon, signed by 62 youths, announcing their refusal to cooperate with the Israeli army's actions. The text of that letter appears on our website here.

Yair announced his conscientious objection to military service at the age of 16 and has refused to go through preliminary military medical and psychometric examinations (which most Israelis are obliged to go through at the age of 16 or 17). As a result, the military Conscience Committee refused to examine his case (they insisted that they need to have the results of his medical tests before they can decide on his case!) Two and a half weeks ago he reported at the Tel-Hashomer military compound, where he expected to be arrested for refusing to be enlisted. However, for bureaucratic reasons, he was only arrested yesterday.

STATEMENT:

Here is a statement that Yair Khilou has prepared for the occasion of his imprisonment:

My name is Yair Khilou and I am 18 years old. I have refused to enlist in the army, and will soon be sent to military prison for that. I decided to write this statement before I am imprisoned because I believe that the reasons motivating me in my refusal to enlist in the army are shared by many people.

When I am asked to become part of a large and violent body such as the Israeli army, I should ask in what activities this body is engaged and whom does it serve. My parents, teachers and peers might answer that the army of the state is necessary to preserve my own security and the security of the citizens of the State of Israel. I desire very much that there will be security for the citizens of Israel and for me. And still, I find this answer to be unsatisfactory. I fail to understand how does that pure Jewish space, which the State of Israel persistently tries to create by force since its establishment increases our security. I fail to understand how the repression of the Palestinian resistance to Israel by means of state terror - more cruel and of wider scale even than the counter terror which it provokes - serves the society that I am part of. How does the activity of the state, implemented through the army, can benefit me and those I care for? The 'sterile' Jewish space created by the State of Israel is a ghetto for its Jewish residents as well. It prevents them from integrating into the Middle East. Nobody is safe in this space - neither Jews nor Arabs.

Still, my opponents might claim, the State of Israel is a democracy and its army is the people's army. I wonder where these people live. I have no ability to affect the actions of the army, although my friends and I definitely try. I am unable to stop war, unemployment, inequalities. The vast majority of Israeli citizens wish to change this state of affairs. And still, the state does everything to block peace, welfare and equality.

Mysteriously, everything ends up serving the interests of capitalists and generals. The Israeli military men and capitalists, together with their Palestinian peers, do everything they can to remain in power. Their mass media and educational system spread vicious nationalistic propaganda, hatred and fear.
Thus they divide and rule us. They incite against each other Arabs and Jews, East and West, while they continue to reign. These are our real enemies, preventing us from attaining physical and economical security. Against them Arabs and Jews should stand together.

I am not willing to accept such a reality. I am all the more unwilling to contribute to its continuation and fortification by serving in the Israeli army or in any other terrorist organisation.

It was a very hard-fought victory to win that much in a country that has no labor movement and has not seen a labor movement in some 52 years, which is why the US, unlike the rest of the industrialized world, still has the death penalty.

FROM A CLUTTERED warehouse on Third Street in San Francisco, Rudy Rucker, Jr. runs Monkeybrains.net, a tiny dial-up Internet service provider and Web-hosting service – and on Nov. 25 his servers were moving at a seriously sluggish pace. "My first thought was, 'This sucks, my mail's not going fast enough,' " Rucker Jr. tells me.

Some quick detective work revealed that a worm called Badtrans was transmitting data stolen from more than 100,000 computers to an address at IJustGotFired.com, a Web site Rucker Jr. hosts. The Badtrans traffic – 100 e-mails a minute – was the source of the slowdown. He promptly disabled the account.

Hacker attacks are old news. What's fascinating about Rucker Jr.'s run-in with Badtrans is that it offers a glimpse at the kind of personal information the Federal Bureau of Investigation has publicly acknowledged it intends to collect. And it has thrust Rucker Jr., the son of acclaimed sci-fi author Rudy Rucker, into a cyber-standoff with the FBI.

Badtrans seems to be similar to an FBI project dubbed Magic Lantern, a new "spy virus" first revealed in news reports by MSNBC on Nov. 20 (see "Wartime Profiteers of the Digital Age," page 22). Magic Lantern, reportedly, can record every keystroke a suspect makes and then transmit the information – e-mail messages, passwords, what Web sites the suspect has visited, etc. – back to the bureau.

You should know that we have confirmed that law enforcement officials in nyc did recently pick up and interrogate a young activist from the "prison moratorium project" there. the most recent interrogation took place on december 6.

Police reportedly asked him numerous questions about progressive political organizations and activists. (for the record, many of these individuals and groups apparently were not connected to arab/muslim/south asian causes in any way.) without benefit of legal counsel, the young man apparently answered some of their questions. he was not physically hit or harmed.

In the course of the "interview," the police showed him lists of names of activists and also asked if he knew certain people. the young man reported that among the names mentioned were "van jones, edget betru and jia ching chen" - whom he acknowledged that he knows.

A few days ago in nyc, some key organizations met about the "interviews" (including ella baker center staff in nyc). my understanding is that the various groups there are now informing their members and supporters about the best way to deal with such situations (right to remain silent, right to counsel, etc., even or especially with the FBI). and the young man now has legal counsel, has apologized for cooperating with the police investigation, etc.

For me, none of this is alarming news. i have been quite clear for some time about the true nature of the U.S. democratic system, and i have tried to govern myself accordingly. however, i certainly want to encourage everyone to strictly follow the guidelines that i shared earlier in the week. (they are appended below.)

Also, i want to encourage all ebc staff to take one additional step: please inform your close friends and associates about these developments, and make sure they know their rights - in case the police try to interview them. people you know and trust could be talking to the FBI right now, thinking they are doing you a favour by being helpful and trying to clear your name.

Make sure: (1) that all your friends and relations know that your preference is for everyone to be fully aware of their rights to silence and to legal counsel, and that you support everyone exercising those precious democratic rights during this difficult time, and (2) that all your friends and relations know that you want to be informed immediately about any attempts on the part of law enforcement officials to contact them - so that you can help them get the legal counsel they will deserve and need.

Law enforcement tactics work best for the police when the persons whom they grab to interview are not (1) legally informed and-or (2) emotionally prepared.

Please make sure that you and your loved ones fall into neither category. That will help to safeguard and secure them, you, this organization and the movement as a whole.

And, certainly, feel free to share or forward this email as you like. Thank you very much for your dedication.

Let's be smart during this period. Please follow these guidelines:

1. Remember that you have the right NOT to talk to any FBI agent or police officer at all for any reason. If agents drop by unexpectedly, you have the right to tell them that you refuse to talk to them without a lawyer. You have the right to ask them to leave and the right to tell them to contact your attorney (Diana Frappier at 415.951.4844x22). If an agent calls and asks for an interview, you have the right to tellhim/her to contact your lawyer (Diana). In general, FBI agents are smooth-talking, well-dressed lawyers who are good at getting people to talk to them. But remember: it is your right NOT to do so, without a lawyer.

2. From now on, do not say or do anything that would indicate that you are advocating, supporting, condoning or initiating violence against anyone for any reason. Even in private. Even as a "joke." And "joking" about such things on or near telephones, or via email, is especially foolhardy.

3. Ask yourself, "Are there things I am doing in my life right now that could put me in a compromising situation, either legally or ethically? Am I doing anything that I would not want on the front page of the SF Chronicle or the NY Times?" Now would be a good time to stop doing those things, and to take all prudent steps to clean up any lingering messes.

4. Ask yourself, "Are there unresolved conflicts or closed lines of communications that separate me from other activists?" Now would be a good time to repair those relationships and sew things back up. Unresolved hostilities are the breeding ground for slander and disruption campaigns that pit activists against each other - at the worst possible times.

In the meantime, we must continue with our work. In fact, one of the main dangers in the new period is that we will over-react to this news, succumb to our hidden fears and feelings of intimidation - and then spread panic and paralysis among ourselves. That's called: doing the Man's work for him.

So let's not go out like some bustas. Just know and exercise your rights. And never let 'em see you sweat.

(Artists' Response To Illegal State Tactics)

As he leaves office Mayor Giuliani has been handed yet another rebuff from the court system over his eight year campaign to take away the First Amendment rights of NYC street artists. The Mayor's appeal to the NY State Supreme Court in a long-standing criminal case, People v Balmuth and People v Christiano, has been denied.

In an order published on 12/27/2001 NY State's highest court ruled, "There is no question of law presented which ought to be reviewed by the Court of appeals and permission is hereby denied."

Balmuth and Christiano are A.R.T.I.S.T. members and plaintiffs in Lederman et al v Giuliani, a lawsuit that was decided in favor of the artists by Federal Judge for the Southern District of NY Lawrence McKenna on July 7, 2001. Judge McKenna is the same judge Mayor Giuliani openly criticized in his farewell speech on 12/27 for preventing the police from arresting homeless people who were sleeping on the steps of a Fifth Avenue church with the church's express permission.

In his speech Giuliani stated,

"All of those things have to be dealt with, all of them have to be dealt with differently. None of them are helped by ignoring homelessness, by doing the kind of thing that the judge allowed last week. That's cruel. He doesn't think it's cruel. But he's having a hard time thinking through the ideology that he brings with it to analyzing his decisions. It's a cruel thing to do to have people laying on the street. It's a much kinder, more generous, much more mature and much more responsible thing to go take them, try to help them and put them in facilities where they can get help, which is what we've done and what really has to continue if we really, really care about people."

Since becoming Mayor in 1994 Giuliani has ordered thousands of homeless people arrested and put through the system for doing nothing more than sleeping on the street.

People v Balmuth and Christiano was part of the second wave of artist arrests initiated in 1998 by the Mayor and Parks Commissioner Henry Stern after artists won two earlier Federal lawsuits against Giuliani, Bery et al v City of NY and Lederman et al v City of NY. The earlier lawsuits involved a license requirement to sell art on the street. From 1994 until 1997 more than 1,000 artists were arrested and had their artwork confiscated by the NYPD, which later sold the art at auction or destroyed it.

Now, for the first time

A systematic independent study has been carried out into civilian casualties in Afghanistan by Marc Herold, a US economics professor at the University of New Hampshire.

Based on corroborated reports from aid agencies, the UN, eyewitnesses, TV stations, newspapers and news agencies around the world, Herold estimates that at least 3,767 civilians were killed by US bombs between October 7 and December 10. That is an average of 62 innocent deaths a day - and an even higher figure than the 3,234 now thought to have been killed in New York and Washington on September 11.
Of course, Herold's total is only an estimate.

U.S. Boats Attack Iran Oil Tanker in Gulf - TV TEHRAN (Reuters) - U.S. speedboats attacked an Iranian-registered Saudi oil tanker in the Gulf on Wednesday injuring two people, Iran's state television reported.

Iran's Foreign Ministry summoned the Swiss ambassador, whose country represents U.S. interests in Iran, later on Wednesday to deliver Tehran's ``strong protest'' and demand explanation, it said.

The television did not give any details on the attack.

The Swiss envoy told an Iranian Foreign Ministry official that the American boats had mistaken the tanker for an Iraqi vessel smuggling oil, according to the television.

U.S. forces are patrolling the Gulf to enforce sanctions imposed on Iraq by the United Nations after Baghdad's 1990 invasion of Kuwait.
