Uncontested divorces are those in which the parties agree upon every aspect of the divorce. This must include an agreement on property division (real estate and personal property), custody of the child, child support, visitation, who pays which debts incurred during the marriage, alimony to be paid (if any), health insurance, life insurance and any other matter which arises out of the dissolution of the marital relationship. The parties should set this down in writing and take it to the attorney. The attorney can only represent one of the parties and he has an obligation to represent the best interest of that party only. He will be bound to advise the other party that they have a right to obtain a lawyer of their own and that it may be in their best interest to do so. Fees for this kind of divorce are set based on the amount of time likely to prepare the divorce papers. In case of large estates or those with complicated business aspects it is likely to cost more because other professionals will need to be involved to handle tax aspects, estate planning, valuation issues, etc..
