we have been blessed with a new opportunity to change something that can benefit a lot of people.

Please do not panic on me or get all paranoid. This adds up to nothing to get disturbed over; at least not at this time.

As reported last month; on November 1, 1999 the tax court judge was directly anti- government in his trust case ruling, He asked District Council why the IRS sent the Trust a Notice of deficiency if they did not believe it was real; reviewed the documents and ruled in our favor then and there. My conclusion is that the audit and deficiency process is where the jurisdiction of the court was created.

In the history of law you are what you say you are until and unless someone proves otherwise; that adds up to innocent until proven guilty, a very proper situation in American law. We will have to see if we can pry a decent ruling out of his presiding judge on the other 7 trust cases argued in April. We received the written order from November 1, 1999 last week; four or five weeks is so quick we are amazed.

Sadly we did not get a proper ruling in the Doctor’s case tried October, 1998. In that case the Judge almost copied the government’s brief. He ruled that it was Okay for the IRS to make false statements under oath and to accuse multiple parties of the same income facts. This is significant since it is directly opposite the intent of congress as expressed in RRA 98 where making false statements under oath is an error worthy of dismissal. It also flies in the face of the GAO audit since it allows and encourages the overstatement of taxes due and owing. He also said that we failed in our burden of proving the substance of the direct controlling involvement of the trustee in the operation of the office. (Does this suggest that we have to have more direct involvement and control to substantiate the trust?) This is in direct opposition to the governing state law that has exclusive jurisdiction vested in the Superior court of the state of Arizona. Woe unto ye lawyers! This judge is first a lawyer, second an IRS attorney; then a judge.

The poetic justice in these two rulings is that they create an ideal issue for appeal. We now have the opportunity, duty, and responsibility to cause this issue to be settled in a proper, logical, and legal manner. And I believe we have the needed power to overcome this act of evil by doing the right and proper job.

I have for some time been working on figuring out what the proper amount of direct involvement for the trustee really is for our future. I regard this as very important since there is no definition available to answer the question; in one court the mere reservation of the signatory authority for the transfer of assets is enough control; while this tax court judge feels we have to control daily actions too. I am confident we put in as much effort as any trustee; and more than most. You tell me; what is the proper measure?

Here is my idea; the law and issue is that the mere having of a power in most cases removes the need for it’s application. The real trustee has a lot of power with, hopefully, only the least amount of needed application; after all that is how we were proven to be a super power and won the "cold war" of bluffs of powers never demonstrated other than in tests of the theory. The key must be whether or not the other guy accepts your bluff as fact. How does one go about establishing that he has a power without destruction?

My best example is Almighty God; he has the power to destroy any or all of us at any time, yet he chooses not to exercise that power. In his case it is called "grace and mercy"; yet when the trustee fails to prove he has the power by documenting the exercise of that power the court says we have failed to prove the power. The commissioner has the power to manage and control 95,000 agents; how often does he have direct control of an agent or office. I guess we need to make a display of the power (perhaps a little flood of paper); sort of like a Karate demonstration of breaking boards to prove you have the power to break a neck or arm. Of course the simple fact that boards do not hit back may be a factor in the validity and selection of the demonstration not actually proving a power.

Power is defined in science and law as the ability to do a thing or work. It is not the doing of the thing or work that is important particularly where the task does not need to be done at that time. Power is stored up ability to be used when needed; the fact it is not needed or used in adversity does not mean it does not exist. Woe unto ye lawyers!

I think it is wonderful timing that we received both rulings in one week. The fact that they are in essence directly opposite should be a clue (Alan Keyes referred to black as the color of confusion, are the judges wearing the right robes for the merchants of babble); and it lets us have the opportunity to have a legitimate hearing of the appeal.

So one thing you should anticipate is more documentation when we say "no" to a request. It seems the saying of yes because we are in agreement and functioning properly does not make sense to the merchants of confusion as proof of the validity of the agreement. This judge thinks there has to be disagreement and disapproval to verify the power; similar to the lawyer who said our only way to verify the contract was to lie under oath. That is for lawyers and IRS agents. One of the politicians in the race for President referred the other day to black being the color of confusion; duh; wonder what these judges are all about? Confusion = babble; the merchants of babble are on the bench in our courts. Is it any wonder the criminal is guaranteed justice and not the innocent victim. Only after a generation or two of suffering this wrong have we begun to discuss victims rights or to propose legislation to limit charity to criminals.

God’s law specifies restitution to the victim; and you think this is a Christian nation with righteous courts of justice. Shame on us and our fathers for we have made a terrible mess of our government failing to properly train our agents and supervise them.

Is it possible we deserve the confused and confusing black robed merchant judges? Yes, of course it is exactly what we need to bring us to our humble repentance from our evil slothfulness and laziness.

God has the power to replace our justice system with one that works exactly as he directed; yet his grace tolerates our frailty and gives us these many years and generations to work it out to do the right thing of obeying HIM.

Truth will overcome in the final deciding of the issue; and we get to be the ministers of truth in this dark place. We have to know that we are endowed with the power to overcome all evil. And we have the duty and responsibility to justly and properly exercise that power to do just works that glorify GOD in the highest while defeating the love of money interests of evil men.

Yes, I am insulted that the enemy demands we prove truth while the judge accepts lies by the presumption of regularity charity given to "our" hired government agents. We recently were loaned "Harry’s War" and we enjoyed the re-watching of that movie. It again reminds us that truth overcomes evil and will result in the proper legal action by our agents. Sadly for 40 years the bluff was accepted as fact because we were too negligent and lazy to do the work to overcome the lies with truth.

The research efforts continue and all the advocates of the "liberties granted by Almighty God" are growing stronger while the enemy wanes in its weakness of pretense, bluff, and illusion. It is greatly empowering to see the attorneys for the district council shake and quiver when we are in the room; and to hear the crack of confusion in their voices. Their fear proves we are shedding light in this darkness. Woe unto ye lawyers!

Get use to the idea good does not loose to evil in this important spiritual warfare. Knowledge is power and only truth qualifies as knowledge; know the truth to be free. Is there anything that can still cause you to live in fear of men? We must remain diligent in our truth to fear only God; and that fear must be all joy. "Whom ye fear ye will serve" sets the standard to go along with "you can not serve two masters" and "choose ye this day whom ye will serve". Sounds like a plan to me. So long as "our" government fears "we the people" it will serve us. When we forget to keep them in fear of us they start thinking they rule by our fear; this is how the IRS has gotten away with the bluff for years. Now they are learning to fear us again (Praise God) and they really do not like the feeling (hooray). I like knowing they are afraid of me; someone needs to be afraid when there is a conflict between right and wrong. The recent revelations on Waco is causing other agents to fear the truth coming out to show their evil lies.

Recent disclosure and news articles give us some clues about the frailty of the bluff. GAO reports that over 4000 agents are under investigation. That means at least some of us are doing our job of overcoming the bluff with facts about errors and misconduct. The Commissioner complained in the Wall Street Journal that the agents are afraid to do collections; hooray. Commissioner in August complained about the size of his budget and the size of the job congress had forced upon him to tell the truth and control his agents. District council shakes and demonstrates confusion in our presence. GAO reports that the IRS continues to lie and overstate the taxes due. All these things are indications that the power is a pretense; and our fear has been from only a bluff and lies.

We have the right and ability to restore this government to it’s constitutionally proper boundaries.

Truth and trust in our own knowledge and ability makes us the holder of the keys and the true power within the confines of the "perfect law of liberty" and " the liberties granted by almighty God. God has given us the power, duty, responsibility, and authority needed for this task to overcome evil with good. We pray in error when we ask God to do the things he has empowered and directed us to do by his spirit.

Now let me give you some other facts about the tasks we have the duty and responsibility to take care of in this event.

Truth and power can come your way too; will you be ready when your call comes.

There is a process that can come your way; and a legal "Due Process" method and measure for exercising the "liberties granted by almighty God".

We have the duty and responsibility to know the law and do it; the laws of the land and the Laws of God are and must be entirely compatible. This means we have the duty of searching out the truth and using it to retrain our lawyers and judges with truth.

The process of correction can take days, weeks, or years; do not forget we were forty years in deciding we wanted a little truth mixed in with our desires to have those things we have not earned. We have taken the benefits and suffered the plagues.

Any mail from the IRS must be received and dealt with timely and properly. All Trust mail must get to the trustee quickly for proper timely action to occur.

Receiving a letter or invitation is not an indication we are wrong in anything we have done so long as we are in truth trusting and following the right path of law and life.

Now if you are just pretending or bluffing about control or trust you may have something to fear for all law is a double edged sword cutting both ways; we can not discipline the IRS by the right and propriety of the law while we lie and cheat.

Only a people dedicated to truth can demand truth from their government. The process can be arduous and disgusting; even annoying and trying; however we need that kind of exercise to get our lazy bodies back into shape for the just and right duty of self government. In one case for a blind man the court and IRS are in agreement to lie and deprive him of due process and help with the inconvenience of blindness as would be right.

We are still encouraged by all the avenues to just actions that are being discovered so we have a lot of good opportunities to advocate and do truth in our trust. It is essential that we have adequate communication as we go through this exercise. Phone, Fax, email, mail, and FedEx are all good tools to communicate truth. And the cost is minimal if we act reasonably and intelligently.

The process can take three or more years of advocating the truth to get the trust verified in law and fact; even after the law grants us the proper presumption.

Every correspondence has to be read and considered; almost all deserve a reply properly structured, researched, and communicated in law and "due process".

Not until all the due process of trial and appeal have been exhausted is there any reason to fear the IRS coming out to steal things they are not owed. And since the Commissioner admitted to congress in August that he has to write a whole new process of "Due Process" for the taxpayer in collection of taxes owed, even extending the taxpayer rights to years of added administrative process and litigation.

We win; WE WIN; we win! Praise God!!

DIVERSITY OF OPINION; RE ANDERSON and foreign trusts

The lawyers and other liars are coming out of the woodwork. The Lawyers opinion we discussed in the November 20 meeting (YES YOU NEED TO KNOW) is now on the bubble of attack. To date I see nothing except paranoia and panic on the part of lawyers who were lying and cheating in the first place. The author of the opinion was a practitioner who provided trust plans and litigated for them in the asset PROTECTION arena. I think he misread and misapplied the court’s opinion.

Here is one of the differing opinions:

Although I have heard a number of attorneys (like the author of the opinion we discussed earlier) contend that the Anderson case sounds the death knell of offshore asset protection trusts, I strongly disagree.

The Court of appeals broke no new ground in Anderson; in fact, the promise on which such trusts rely - that the settlor will be insulated from contempt if he is truly does not have the power to repatriate trust assets - is based on Supreme Court precedent. Although the Court of Appeals in Anderson was, admittedly, antagonistic toward offshore asset protection trusts, it was constrained to hold merely that the Andersons had not met their burden of proof on the control issue and since the Andersons were the co-trustees of their own trust, they retained certain powers that were significant.

I, for one, was not surprised. This decision simply demonstrates what can go wrong if such a trust is not properly drafted. In contrast, in a recent case in which I served as an expert witness on offshore asset protection trusts, the court validated the trust by holding that the physician had established the trust "for the legitimate purpose of protecting family assets".

In addition, factual dissimilarities between Anderson and the type of lawsuit in which the average physician is likely to be involved makes a contempt claim against Physicians highly unlikely. Most significantly. The solo practitioner prosecuting a medical malpractice claim on a contingency fee does not have the resources of the Federal Trade Commission and wants a quick and easy settlement. While in the post-Anderson world the threat of contempt might diminish a physician’s leverage vis-a-vis creditors, questions what leverage the physician would have had if he had never established the asset protection trust in the first place. EDITOR’S NOTE: it is okay when the lawyers agree with me. Much ado about nothing unless you are participating in some sort of consumer fraud scheme. It is such a pleasure to see a lawyer who is not so filled with paranoia as to sell out his clients in a scheme of compromise. Wouldn’t you know a Rothchild would understand the validity and value of offshore planning? Perhaps due to the length of the article he failed to add up all the points settling for emphasizing that when it is done wrong it does not work. The Andersons were creators, trustees, beneficiaries, and protectors; and each of those offices had a reserved and reversionary control interest because they did not trust the people they hired to do the trust in the first place. The creator had the right to terminate and replace the foreign trustee; as did the protector with the added ability to override trustee actions. The Andersons as co-trustees were domestic US taxpayers and business operators yet tried to claim offshore protections; they were the problem.

The court’s antagonism was in my opinion rather well deserved by the Andersons in their lack of ability to tell the truth, trust, or even be consistent. They missed the issue that they had the burden of proof; just like we often loose because we fail to adequately prosecute.

In retrospect I can show you a lot of things we did not know and thus did not do in the 1998 trial. First we made a tactical error in timing on the filing of the personal bankruptcy; had it been filed a day or two later the outcome would have been different and it is likely there would have been no trial. Second we failed to do adequate preparation for trial just in the off chance the courts failed to follow the rules. Guess what? The IRS and Bankruptcy court failed to follow the rules; which remains under appeal in the higher court. When that appeal is granted and the bankruptcy stay restored that trial will be thrown out and we get to do the job right the next time. Last and worst we fell into a situation where the Doc had to go it alone without even a helper.

All this has been a valuable education; yes, valuable to you now and in the future.

TIS THE SEASON TO BE JOLLY; BAH! HUMBUG!-- OH JOY!

Fa la la la la la la la la; however many las that is suppose to be; bah humbug.

As we approach the greatest "love of money" commercial event ever invented by the merchants of confusion I intend to do my job of spreading a little reality.

If you disagree with what I tell you here; you have the right, duty, and responsibility to show me where I am in error to give me the opportunity to repent. There is not one reference or suggestion that Jesus ever commanded or desired that we celebrate his birth. Yes, I am very glad he was the only Begotten son of God. For at least that one reason I will never be capable of being like Jesus.

Paul wrote about the necessity of believing Jesus was the Begotten of God, not the born of Mary. And yes, she was special and selected for that special service to bring forth the Son of God born of woman. Personally I doubt this is the time of year He was born and may be closer to the time of the begetting. THE Only begotten son of GOD.

The other important time in HIS life for celebration was the time and fact of His being raised from the dead. His resurrection is a very important event for all of us today just as his begetting.

And there is no suggestion that Jesus advocated a commercial holiday for either event. In fact he routinely opposed commerce and religious ritual celebrations even chasing the merchants out of the temple. THEY ARE BACK!

Jeremiah 10 spells out the story pretty well for me on trees and decorations; no it was not abolished or put away; Jesus said all the law and the profits are contained in his two commandments of love; and not one jot or tittle will pass away until all things are accomplished. I for one believe more is to be done by us for his kingdom.

Isn’t it a horribly sad note that we have to invent lies and tell them to the children in order to create the illusion of giving to our fellow man one day a year. The Christian servant of Jesus Christ as King is charged with the duty and responsibility of giving those blessings of truth every hour of every day to everyone.

How did the "Christian" mothers ever get tricked into giving some fat lie in a red suit credit for the loving gifts they work to give their children. All the mothers, and fathers, I know like their children knowing everything they give them; especially the things that require sacrifice on her or their part.

I have a real problem with lying to the children about anything; but at this time of year especially where the gifts come from and the whole idolatry of Santa (Satan) in the red suit. Now there is a good thought; why do you suppose Santa and Satan are depicted as red suited? Somebody promised Eve extra gifts for breaking God’s commandments and we have this dude called Santa that is created by a big bunch of lies and pretenses in violation of God’s Commandments whom we try to pretend has something to do with celebrating the birth of the KING. This is not reality and we need a big dose of truth.

If parents want their children to value truth they must set the example of living and telling the truth even to the issue of Santa. We must not lie in order to falsely glorify some idolatry; nor surrender our children to the love of money merchandising of this false time of HIS birth. Once the children figure out that the parents are liars who give gifts to cover up lies; what do you suppose has happened to the trust of the child for his parents? Isn’t government schools calling parents liars enough opposition to truth? Do we have to repeatedly prove them right in our stupid commerce celebrating a day the King did not desire or dedicate for celebration.

The same concepts of truth must be real to us and our children in all generations every day or we can not be regarded as trustworthy. If we do not give them a foundation of truth how can they properly build a life of truth and honor?

Will your children honor their father and mother by lying to your grandchildren in rebellion and disobedience to God?

How many of God’s commandments do you think it okay to break for the "love of money" and gift giving to celebrate servitude to santa’s commerce in the love of money? How can these lies honor Jesus birth?

If we are to have this time as a celebration of Jesus that can only happen in the direct deliberate truth. Commercial lies for the enrichment of anti-Christ merchants of evil can not glorify God in the highest; but rather makes us into the lukewarm nation worthy of being vomited from his mouth. Sort of like the great celebrations of the "holy days" of those who openly reject Jesus as Messiah and King.

The nation brought forth by divine providence for the free exercise of our Protestant Christian religion has succumbed to the lusts of the flesh and all the other whoredoms of the mystery Babylon system and the harlot of Revelations. We lust to have it so as we partake in her benefits and pleasures in total and utter rejection of the King, George Washington spoke of and believed in as a reason for the divine providence and blessing on the American colonies and states.

Jesus Christ is the only living true King of all the heavens and the earth. He routinely conflicted with and opposed the wealthy merchants who capitalized on the weakness of others.

Woe unto ye lawyers is the call Jesus would give to the judges of confusion and the crooks of the tax court; and we need to follow HIS example. GOD’s Woes are a bad thing to get from the almighty of the universes. Lawyers lie for profit; about like most Preachers I have ever heard. Both refuse to be ruled over by Jesus as King and subject themselves to His righteous Judgment for their unjust acts and lies; both get a big dose of woe in scripture for preventing the simple truth from reaching the ears and hearts of the people. We need to be here for truth and right in the "perfect law of liberty".

Vermin is how Paul Harvey and George Washington referred to lawyers; even attorney Joe Izen openly admitted in a 1997 meeting that he is a parasite to society and the people. Vermin are commercial merchants stealing the inheritance from the widows and orphans and need to be driven to productive work instead of bloodsucking theft.

It is lawyers with their compromises and lies that have stolen the truth out of our courts because we paid them our fortunes to lie and steal on our behalf and to protect us when we lie and steal from others so there is no justice. We were too lazy to do right. Why should we do right when we can call on a "Christian [Constitutional] Lawyer."

No I am not even impressed with the great pageants of pretense created for entertainment that spread lies about the righteous king for the glory and enrichment of commercial religion and false doctrines of government controlled lawyers.

If this season were to be a memorial to Jesus birth it would have to be a spiritual time of great truth and trust. Commerce in the love of money controls the American people through debt; and, more of our people go into debt to carry on the lie of Santa than any other single false god and idol. Santa is the trick of our Pharisees to steal the souls of man as merchandise through the fears created by usury, debt, and these false doctrines.

One of our guys today talked to me about decorating the living trees in his yard. I do not like that either. What is wrong with the beauty God gave that living tree? Do we really think we can improve on the beauty of the truth that brings our children the trust they need to carry out God’s purpose in their lives? Do you think they do not notice you lied for commerce when it was convenient? Is that really the lesson you want to convey in the pretense of this season of birth?

May God have mercy on us all and drag us back to truth by any means he may choose. We deserve all this ugliness because of our lies and frauds for profit and love of money. Can we be trusted to do right while lying about Jesus and the holidays?

I am annoyed by peanuts, frosty, Rudolph, the grinch, and all the other false doctrines and lies the commercial merchant so generously create to stroke the flesh and bury the spirit of truth. Perhaps all the falsity will parish with the Y2K advent of commercial correction. There are several different versions of who steals Christmas and who will save it and all are lies for commercial entertainment.

Since this holy day is suppose to be about the ONLY SAVIOUR; how can these lies and frauds be saving Christmas? This is simply man proving we are not trustworthy with God’s truth. We continually work to prove God and Jesus wrong; SHAME ON US.

My daughter caught on to the selfishness of the idea of getting credit for the gifts but could not figure a way out of the lies about Santa. Truth my dear is all that is required. We can not guarantee to protect the children from anything we are willing to lie about to them. If we lie about Jesus birth how are they suppose to accept our other teachings as truth? How do they learn to discern between truth and lies when we claim truth while living lies; after all the Santa lie brings all those gifts? Do we really want to teach them that lying brings profit?

The whole basis for trust is truth; and the reason the judge can not see trust is he has never been trained and taught truth as the only standard for his behavior. Can we be the example to turn him from his wicked ways to truth and trust? WE caused repentance from prejudice on the part of one judge in the Ohio trial; who is next?

Ministers say "Jesus is the reason for the season"; so why don’t they tell you to drop all the commerce and "love of money" out of the whole season? The answer to that is both simple and painful; they are merchants profiting from the false doctrines and commercial efforts of entertainment.

Why do you suppose we wound up with this false date for His birth to coincide so conveniently and commercially with the Jewish festival of lights that denies his existence and refuses to acknowledge Jesus as king to rule over them?

The Jewish traditions and Talmud not only deny Jesus but directly and intentionally blaspheme his majesty King Jesus. Yet we honor his declared enemies and their holy days that oppose HIM. Shame on us!

The divine providence that brought forth this Protestant Christian nation was honoring our forefathers rejection of the false doctrines of the church of England, Catholicism, and especially judaism. In fact in some communities in colonial America the practice of judaism was a capital offense of treason against King Jesus. An oath of loyalty to Jesus Christ as a condition of immigration until the commercial vermin Lawyers were glorified as our masters. The high percentage of lawyers that are jewish and homosexual should be enough to wake up a righteous servant people.

Both Washington and Franklin warned against the Jew as the greatest danger to our liberties; Washington even suggesting they be hunted down as traitors.

The Ever-living King we serve is not a baby; he is a victorious warrior having overcome all evil for us and demonstrating his Majesty in defeating even the devil and the grave. Why is not that truth enough to celebrate? No, we have to have a false doctrine of lies for an idol of a fat man in a red suit; with lies of flying reindeer; and love of money merchants getting wealthy off the entertaining lies of frosty and peanuts and all the rest.

Thanksgiving is my favorite of our national holidays, for it seems to have the best reverence to truth and the fewest commercial lies.

Let me see if I can select events from Jesus’ life more important than the birth. How about conception or spiritual begetting as scripture refers to the event? It is true that begetting is when the genetic traits are established; so as the scripture states the begetting was more important than birth. Conception is when Jesus was named and made the only begotten son of God. And I for one am extremely glad there was no such thing as abortion (baby murder) in the Bible. Now find the scripture where the disciples were told to remember him as a baby. Did any of you catch the lighting of the Menorah at Washington D.C.? Let Christians try to put up the 10 Commandments or a Cross to remember their King and see what happens.

How about His great sacrifice of crucifixion? Now there is an important event for you and I; that is the day He gave Himself as a sacrifice in our place to pay the penalty for our disobedience to Himself and His law. We deserve God’s wrath and destruction and yet He bought and gave us loving salvation and grace by His own body and blood. Wow, that is an important day to me! Yet we do not place much emphasis, celebration, and commerce on that day; crucifixion is not a big seller like Santa. Good Friday is a quiet time of reflection and a few of us pay attention to what was done on our behalf even if it actually was Thursday.

Bought with a price so precious we can not even conceive of it’s value is my status. And I am proud to say I appreciate HIS effort on my part. He had the power to lay down his life for me; another reason I can never be like HIM.

He had the power to raise himself from the dead; and because he chose to exercise that power he gave me a gift of the sure hope he can also raise me from the dead. PRAISE GOD for the promise of resurrection!

Then there is the resurrection when he picked up his life again. That is the true coronation day of the righteous King with "all power in heaven and earth". WOW; what a marvelous important day for me to celebrate in honor of HIS greatness. No, we have to lie to the children again about some Easter bunny that lays chocolate eggs with prizes inside. Do you for a minute see this as anything other than a love of money merchant anti-Christ decoy to an idolatry of lies? Some greedy merchant figured out if there was something Christians felt good about they were ready to be skinned in commerce; and as a reward we were given these lies and false doctrines. We become the blasphemers.

Now my most solemn and surest choice for the most important holiday for all followers and servants of Jesus as King; and our Father who created us all. Pentecost is the day I choose; not to act like some of the nuts I have known but for the solemn truth that this is the anniversary of the day when Jesus baptized with spirit and POWER. The power to overcome all evil is my free gift I have no way of earning or deserving. I get to take this gift and advocate truth anywhere and everywhere without fear of what man can do or might choose to call me or threaten to do. Threatening a Christian with Heaven is not a real threat.

A GREAT THANKS TO THE CALLERS THE LAST FEW DAYS; I am often amazed at the way the master works with his servants. God is great; God is good; let us thank him for all the amazing things he gives us to keep us aware he is in control. Every time I get to feeling sorry for myself God sends me an angel; or someone in true need. In this case he sent me five of you to draw me out of the shell and to exercise his truth. Thank you one and all for your help; and for needing mine.
