Guy switched
from seller to buyer.
When he infrequently represented
buyers who were referred to him by friends, Guy discovered how much
FUN it is to be in the Buyer’s court 100% of the time helping them
find their dream home, working to help them get the
best deal, prepare the contract making the offer,
negotiate the best price
& terms, handle the details-to-closing and enjoy their excitement as
they sign papers, get their keys and head for THEIR DREAM HOME.
As an
Buyer’s agent exclusively, Guy places the Buyer’s
interest before every one else, including his own interest.
WHY
DID
GUY SWITCH TO A BUYER’S AGENT
EXCLUSIVELY?
Guy
loves helping clients find and negotiate
for their dream home.
FIRST
Licensed as a “Traditional” agent in l977, Guy listed homes for
sellers then became a dual agent when with a buyer showed interest.
Although dual agency is legal in Arkansas,
he could not harmonize
representing both the seller and the buyer at the same time.
So in l997, Guy organized
an exclusive “Seller’s Agency”,
U Show & $ave Realty.
He stressed to callers on
listings that he represented the Seller.
Guy
learned that most home buyers thought all real estate agents
represented the buyer.
That is not true. The agents representing the
agency with its name on the sign, by contract, must
represent the best interest of the SELLER, try to get the
highest price to the seller and tell the seller everything he
learns about a buyer.

Dual Agency is much like me suing you for $100,000 then you
hire my lawyer to defend you.

‘A Buyer’s Agent REPRESENTS THE BUYER in the
transaction.’ .....’the
Buyer’s Agent’s PRIMARY DUTY IS TO PROTECT AND PROMOTE THE
INTERESTS OF THE BUYER.’ ”

Comment: Ask yourself,
“Do I hire Guy to work for me exclusively and get his 100%
loyalty, 100% of the time or
maybe work with the
Sellers Agent?”
“A
real estate agent who enters into an agreement to sell property for
an owner is known as the ‘Listing Agent’ or
“Agent for the Seller.’
‘That means that the Listing or Seller’s Agent may
assist the Buyer who is not represented in purchasing the property,
BUT THE LISTING OR SELLER’S AGENT’S PRIMARY DUTY IS TO PROTECT
AND PROMOTE THE INTERESTS OF THE SELLER.
..........THE SELLER’S AGENT HAS A DUTY TO PASS THAT
INFORMATION ON TO THE SELLER’.”

“Often,
the broker has been in the company of the purchaser for many hours
and has conducted some fairly confidential interviews with the
prospective purchaser. Given such extensive contact with the buyer,
and such minimal contact with the seller, the buyer is justified in
believing that the agent will do his best to obtain the property for
the buyer at the lowest possible price and on the most advantageous
terms. Of course, for the agent to attempt to do so is a
violation of the agent's duty to the seller. However, it
would be unrealistic to expect the buyer to feel that a broker who
has worked with him extensively is attempting to obtain the
highest possible price for the seller, which, in actuality, is
the agent's duty.”

comment: This
confirms that a “Dual Agent’s” duty is to get the highest
price.
Additional
excerpt: “Therefore,
if an agent or broker desires to represent someone other than the
Seller, he or she must disclose this fact, in writing, to all
parties involved, and receive the acknowledgment of the Seller.”
