It is agreed that:
1. I am a self-employed Independent Contractor representing WebsiteXpress,
a website creation and services firm, and its division, "The Digital
Doctors--An Internet Practice !!!" Additionally, I am able to represent
Alquist Enterprises,
owned and operated by John J. Alquist, selling its
consulting, and public speaking services and
products at prices and commission rates then in effect (published at
the websites of this business). I understand that no taxes or any
other kind of deductions shall be withheld from my commission checks.
2. I am solely responsible for the conduct of my own business, complying
with applicable business law and retaining, when needed, professional
advisors of my choice.
3. As an Independent Contractor, I am free to pursue and participate
in all other forms of employment and self-employment, except that during
this contract term, and for six months after contract termination, I
cannot represent another website creation company and/or create or operate
another business directly competitive to WebsiteXpress.
4. This contract remains in effect until either pary, by giving 30
advance days of written notice, cancels it.
5. Acting as an Independent Contractor and Sales Representative, I
am solely respsonsible for gathering clients in neeed of website creation
service. WebsiteXpress shall not
supply sales leads to me.
6. I shall be paid 25% of the Total Contract Amount. This compensation
is provided from the first of two client payments, and WebsiteXpress pays
it within two calendar days after learning that the client check has cleared.
7. In the event of insufficient funds by the client, commission cannot
be paid until the financial problem with the client has been rectified and
funds have been collected.
8. Current rates are $ 999 up to three pages; $240 for additional
pages. Full pricing details are published at all times on the Internet.
9. This contract is governed by the laws of North Carolina, and should
any dispute arise, North Carolina is Choice of Law.
10. WebsiteXpress shall create at no charge to the Independent Contractor
a website not to exceed four pages, if he/she sells at least five websites
within 30 days of signing this contract. If this initial sales level is
not attained, we would produce a website at the full prices then in effect.
